Nevada is in the 9th circuit of appeals.
The Article that covers Education is Article 11 which has ten sections that cover
education.
Article 11 section 1, Legislature to encourage education; appointment, term and duties of
superintendent of public instruction. The legislation is indented to encourage the expand on
intellectual, literary, scientific, mining, mechanical, agricultural, and moral improvement. The
legislature also provides a superintendent of public instruction and by law advise the manner of
engagement, term of office and the duties.
Article 11 section 2, Uniform system of common schools. For at least six months in every
year, and any school district the legislature should provide for a uniform system of common
school which allows instruction of sectarian character that can be deprived of its proportion of
interest of the public-school funding during the infraction or neglect. The legislation can pass
that law to secure general attendance of the children in each school district.
Article 11 section 3, Pledge of certain property and money, escheated estates and fines
collected under penal laws for educational purposes; apportionment and use of interest. All the
lands, all estates, and all the property granted by Congress to this state for educational purposes
cannot be transferred to other funds for other uses. All fines collected under the penal laws of the
state are pledge for educational purposes and the money too. Portions should be distributed by
several counties for educational purposes and if necessary the state university for support. At the
end of the year any of the interest must be added to the principal sum pledge for education
purposes.
Article 11 section 4, Establishment of the state university; control by board of regrets.
This is effective through November 23, 2020 after this date unless the provision of Assemble

Joint Resolution is agreed to and passed by the law 2019 Legislature and approved and ratified
by the voters at the 2020 General Election. The Board of Regents whose duties shall be prescribe
by Law controls the emplacement of departments for Agriculture, Mechanic Arts, and Mining.
Article 11 section 5, Establishment of normal schools and grades of schools; oath of
teachers and professors. The legislature has the power to establish normal schools and different
grades of schools this include primary departments to the University. Professors or teachers’
discretion is required and they are required to take and subscribe to the oath as describe in
Article Fifteenth of this Constitution. No professor or teacher that fails to comply with the
provisions of any law framed should be entitled to receive any portion of the public monies set
apart for school purposes.
Article 11 section 6, Support of university and common schools by direct legislative
appropriation; priority of appropriations. One, legislature should provide support and
maintenance to university or common schools by law. General funds and presentation of budgets
in the manner required by the law. Two, Local money combine with funds to fund public schools
from kindergarten to 12 grades. Three, during a special session legislation is required to pay cost
of that special session. Four, Kindergarten to 12 grades population biennium in which the special
session was held. Five, any money enacted in violations of subsection 2,3 or 4 will be denied.
Six, the word “biennium” means a period of two fiscal years begging July 1 of an off-number
year and ending June 30 or an odd number year.
Article 11 section 7, Board of Regents: Election and duties. This is effective through
November 23, 2020 after this date unless the provision of Assemble Joint Resolution is agreed to
and passed by the law 2019 Legislature and approved and ratified by the voters at the 2020
General Election. The Governor, Secretary of State, and Superintendent of Public Instruction for

the first four years of the term and until their successors are elected and qualified constitute a
Board of Regents to control and manage the University affairs and the funds are also under the
same regulations may be provided by the law. The legislature at its regular sessions next
preceding the expiration of the term of office of the Board of regents for the election of a new
Board of Regents and define their duties.
Article 11 Section 8, Immediate organization and maintenance of state university. This is
effective through November 23, 2020 after this date unless the provision of Assemble Joint
Resolution is agreed to and passed by the law 2019 Legislature and approved and ratified by the
voters at the 2020 General Election. The Board of Regents interest accruing from the first funds
that are controlled by them should be imminently organize and maintain in a manner that is
effective and useful towards the Mining department. To provide all the proceeds of the public
lands donated by Act of Congress approved. In the second funds are to and should be towards
Military attics, Mechanics Arts, and Agriculture. If the portions that are set apart are lost or
misappropriated the state of Nevada should replace the amount lost or misappropriated funds that
the principals should remain forever undiminished.
Article 11 Section 9, Sectarian instruction prohibited in common schools and university.
It is prohibited to instruct any religious exercises. It will not be tolerated at any school or
university under the Nevada constitution.
Article 11 Section 10, No public money to be used for sectarian purposes. None of the
public funds should be used for sectarian purposes. None of the funds like State, County or
Municipal.
