Nevada is in the 9th circuit court of appeals. The Education clause is specifically covered
in Article 11 of the state constitution. In Article 11 referencing education, there are 10 sections.
In this portfolio, I will name and briefly describe each of the different sections.
In section 1, the constitution states that education should be encouraged by the legislature
and describes the appointing, term, and duties of the superintendent of public instruction. So
therefore, the legislature must promote education with the most up to date standards and hold the
superintendent accountable to their duties.
In section 2, the constitution states that there needs to be a uniform system of common
schools. This means that all school need to be open and maintained for the same duration of
time. Additionally, this subsection includes securing general attendance by children.
In section 3, the constitution discusses financials. Here, all financial pledges and
collected fines that are directed to education cannot be diverted in any form. Additionally, a
percentage of revenue from government land sold will go to education, ie property taxes. Also,
fines under the law also go directly to support education.
In section 4, the constitution mandates a state university controlled by a Board of
Regents. In this section, there is a call to action about establishing and maintaining a department
for Agriculture, Mechanic Arts, and Mining. All these departments should be controlled by the
Board of Regents.
In section 5, the constitution mandates the establishment of Normal schools and
University, while teachers and professors must take an oath. With the establishment of grade and
upper level school as well as universities, teachers and professors must subscribe to the oath put
forth in Article 15 or face termination.

In section 6, the constitution discusses the allocation of funds for university and normal
schools. In subsection 1, the legislature is required to provide financial support and present
budgets. In subsection 2, the legislature must fund a budget for the next biennium to fund
operations for the subsequent school year. In subsection 3 and 4, if there hasn’t been a budget
formed by either between the end of regular session or held in the biennium respectively, that the
legislature shall enact 1 or more appropriation to provide a way to secure more funding. In
subsection 5, the constitution states that any money used elsewhere is a violation of subsection
2,3,4. In subsection 6, the definition of a biennium is given to be 2 fiscal years beginning on July
1 of an odd numbered year and ending on June 30 of the next odd numbered year.
In section 7, the constitution discusses the election and duties of the Board of Regents.
The governor, secretary of state, and superintendent of public instruction should all serve for
only 4-year terms.
In section 8, the constitution discusses the organization and maintenance of the state
university. The Board of Regents should organize the Mining department in addition to creating
a college to benefit both agriculture and mechanical arts.
In section 9, the constitution prohibits sectarian instruction, therefore there cannot be any
religious instruction or god in the classroom.
In section 10, the constitution instructs that no public funds can be used for sectarian
instruction, therefore funds cannot be used to teach religion.
