The goal in the headline of the letter is always to setup a situation where the burden of proof
relies on the consumer reporting agency (Credit Bureau). You do not want to make a specific
claim about a specific account in the first-round investigation request letter. The reasoning for
this is called factual disputing methodology. Making a claim of “Not Mine” or Never had account”
when the account is yours invalidates the claim if it is in fact yours. Write as if you are a
consumer without the fancy jargon in this round to prevent it being misinterpreted as coming
from a credit repair company.
You can’t go wrong with quoting 15 U.S.C. Sec. 1681i, since it is very broad and covers
“Procedures in case of disputed accuracy. 1681i(a)(1)(A), 1681i(a)(1)(B), and 1681i(a)(1)(C)
covers the general investigation overview, the extension of the period to reinvestigate, and the
limitations on extension of the period to investigate, while 1681i(a)(2) covers the promptness in
how the bureaus must handle the notifications. 1681i(a)(3) covers if and how the bureaus can
determine if a dispute is frivolous or irrelevant, all the way to 1681i(f)(3) where it governs how a
CRA notifies a consumer through a reseller (Credit Karma) (MyFICO) and others who furnish
third party disputes free of charge, etc.

if they are. I also read something called the Fair Credit Reporting Act where it said by law, I had
rights to challenge anything I am not sure is accurate. Some of the people reporting things on
me, I have never heard of which made me write you all.
Are you familiar with something called 15 U.S.C. Sec. 1681i(a)? I heard that if you can’t provide
proof, these accounts must be deleted. Well I want these accounts deleted if they are not 100
percent right and correct. So, could you please check on these and get back with me? I saw on
a Credit Site and Board where this lawyer said you have 30 days to complete this investigation.

investigating the accounts, I investigated directly from the source furnishing the data to you to
ensure that everything matches up as well. Upon looking at the history between all 3 credit
bureaus, I wanted to point out the inconsistencies in the reporting in the following accounts.

that balance on the reports on TU, but not EQ. The terms differ in months on TU, EX, and EQ
which is not possible on accurate accounts. The open date on each account has different
months on it, which is no possible way the accounts were opened on 3 different days.

Errors Found (examples): The terms in the collection stated 6 months. I never signed a term
agreement for any medical bill in which the terms can not be 6 months on a dead collections
account. The date of this collection account is wrong as it does not state the original date the
account went into collections.

I understand the process of the investigation is to reach every individual company to verify the
accuracy in the information. In accordance to FCRA, Section 611 A through D, you are
supposed to let me know who you verified with. In my original investigation request sent (date) I
asked you to delete anything that is not 100 percent accurate.
This is not the time to update since you had time to update after the first letter. Now that I have
pointed out the mistakes, by updating the terms is an admission of guilt and a direct violation of
my rights of a fair investigation. You stated it was verified. How is it possible that TransUnion,
Equifax, and Experian all verified the accounts above as accurate, but they all have
inconsistencies in the reporting? In fact, there is no possible way a full investigation could have
been done in accordance to Section 611 due to the inconsistencies coming after my original
request of investigation.
At this point, I demand you delete these accounts immediately, or I have no choice but to seek
counsel to point out the rights that have been violated under the FCRA. Please forward me an
updated credit report after you have completed your deletions and corrections.

disregarded my rights under the FCRA, and FDCPA in which you have a legal duty to comply

You failed to validate a debt at my request, which is a FDCPA violation and you continued to
report a disputed debt to the Credit Bureaus: another FCRA violation. You also failed to provide
me with the dunning letter, or proof of sending the original dunning letter notifying me that you
are reporting me to the credit bureaus within 30 days of sending my account to collections.
Not only have you ignored my prior requests for validation of debt letter will again request that
you follow the FDCPA and please provide the following:

failed to do so therefore, that must mean you agree with me that this debt is false. I will use the
Estoppel in my defense since I have a track record of you not sending documents back to me.
I expect to receive the proof requested above within 15 days of this letter. Should you again
ignore my request for validation of debt I reserve the right to sue your company for violations of
my consumer rights as specified under both the FDCPA and the FCRA. I may also seek

     First, I want to say thank you for taking the time out to read this letter. Recently, I have
been on a search for a home and I noticed that on my credit report, it showed that I had a
Bankruptcy reporting. Upon looking into it, I noticed there may be some things reporting
inaccurate in the accounts. Now, I want to be clear. I am not asking you to investigate the
accuracy in the bankruptcy because I know you guys are busy there.
When I investigated, I noticed that your address was on there as the source alongside Lexis
Nexis. I am not sure if Lexis Nexis is getting the information from you then furnishing it to the
bureaus or if they are resellers for you. The information came back as verified as accurate on
the Bankruptcy.
I find it weird that they verified that it was reporting accurate when I am sure it is not showing
accurate at all. The file on my credit report is showing like this:
