What if an agency does not comply?

1st offense : Reprimand
2nd offense : Suspension (1-30days)
3rd offense : Dismissal from service
APPEALS
Appeals process depends on the agency
concerned, as indicated in
its FOI Manual.
It is encouraged to establish a
Central Appeals and
Review Committee
within the agency.
Agencies may also assign the the person
or office next higher in
authority to receive appeals.
APPEALS
Written appeals must be filed by
the same person making the
request within
15 calendar days
from the notice of denial or from
the lapse of the relevant period to
respond to the request.
What if the citizen is not satisfied?
The appeal shall be decided within
30 working days
from the filing of said written appeal.
Failure of such person or office to decide
within the period shall be deemed a
denial of the appeal.

• Information that when disclosed, can lead to
significant financial speculation in currencies,
securities, or commodities or significantly endanger
the stability of any financial institution

• Domestic or international arbitration
proceedings pursuant to the Alternative
Dispute Resolution Act
• Preliminary investigation proceedings
before the committee on decorum and
investigation of government agencies
8. Confidential Information
under banking and
finance laws
• Law on Secrecy of Bank Deposits
• Anti-Money Laundering Act
