AN ORDINANCE IMPLEMENTING THE NUMBERING AND COLORING

SCHEME THRU STICKERING SYSTEM TO ALL PUBLIC UTILITY

JEEPNEYS, CREATING THE LOCAL TRANSPORT COUNCIL AND THE
GRIEVANCE MECHANISMS OF INTRA-ASSOCIATION DISPUTES AMONG
DRIVERS AND ASSOCIATIONS THEREBY AMENDING MUNICIPAL
ORDINANCE NO. 2009-29

WHEREAS, Article II Section 9 of the 1987 Constitution provides that “the State
shall promote a just and dynamic social order that will ensure the prosperity and
independence of the nation and free the people from poverty through policies
that provide adequate social services, a rising standard of living and improve
quality of life for all;

WHEREAS, Section 447 sub-paragraph (vi) of paragraph 5 of RA 7160 states

that the Sangguniang Bayan may adopt measures to regulate traffic condition for
better promotion and protection of the inhabitants;

WHEREAS, it is the primordial intention of the Municipal Government of General

Mariano Alvarez, Cavite to promote, develop and recognize the transport sector
as partner of the local government unit in delivering basic services to its
constituents with a vision to uplift the standard of transportation services to its
constituents and to promote industrial peace among associations, operators and
drivers;

WHEREAS, there were reports that there have been several public utility
jeepneys that are traversing within the Municipality of General Mariano Alvarez,
Cavite without any stickers or not members of any federation or association
recognized by the Municipality of GMA, Cavite

WHEREAS, it is also reported that members of some association and some

associations themselves has overlapping route and terminals that create strained
relationship among themselves;

ARTICLE I : TITLE

This ordinance shall be known as an “ORDINANCE IMPLEMENTING

THE NUMBERING AND COLORING SCHEME THRU STICKERING SYSTEM
TO ALL PUBLIC UTILITY JEEPNEYS, CREATING THE LOCAL TRANSPORT
COUNCIL AND THE GRIEVANCE MECHANISMS OF INTRA-ASSOCIATION
DISPUTES AMONG DRIVERS AND ASSOCIATIONS THEREBY AMENDING
MUNICIPAL ORDINANCE NO. 2009-29”.

ARTICLE II : DECLARATION OF POLICY

1. It is the policy of the state that every locality or the Municipality of

General Mariano Alvarez, shall adopt an integrated and comprehensive
approach to develop the status of transportation for better delivery of
basic and social services available to all people.
 2. It is a national policy as well that, the Municipality of General Mariano
Alvarez, Cavite must be given importance the role of transport group
being constitutionally organized;

3. It is the objectives of this ordinance to prepare necessary measures to

prevent the increasing “colorum” vehicles, traffic violators and problems
among drivers, operators and associations;

4. It is likewise the objective of this ordinance to recognize the

participation of the transport groups as active partner of this
municipality in nation building, by establishing a recognized Federation
for all Jeepney’s Association as provided for under this ordinance which
shall be named as UTRA FEDERATION.

ARTICLE III : DEFINITION OF TERMS

The following terms and phrases when used under the ordinance shall
mean the follows;

LTFRB - Land Transportation Franchising Regulatory Board

LGU- Local Government Unit
MTMO – Municipal Traffic Management Office
NGO’s – Non-Government Organization
PUJ- Public Utility Jeepney
LTC – Local Transport Council
SANITATION – the hygienic disposal or recycling of waste, as well as
the policy and practice for protecting health through hygienic
measures.
HIRE – it is the classification status written on the C.R. of the
vehicles after the franchise been granted.
ROUTE – it is the classification status written on the C.R. of the
vehicles after the franchise been granted.
DRIVER – one who drives any motor vehicle privately or for hire.
OPERATOR – one who owns the public utility jeepney.
PUBLIC UTILITY JEEPNEY – a business enterprise as transport
performing public services to transport person from one place to
another.
VEHICLE – a motor equipment design to convey , carry, and
transport passengers from one place to another
COLOR- designed stickers issued by the municipality to recognize
the respective organization or membership.
UTRA FEDERATION – is an association composed of different
transport organization accredited by the municipality.
ARTICLE IV : SCOPE

Section 1. This ordinance shall govern the Municipality of GMA, Cavite.

Section 2. It is the policy of the State to protect, adopt, and implement

necessary policies and procedure to improve the standard of
transportation services and traffic condition within territorial
jurisdiction;

Section 3. This ordinance shall be applicable only to the passenger

utility jeepneys plying within the territorial jurisdiction of GMA,
Cavite, herein routes was approved by the Land Transportation
Franchising and Regulatory Board.

ARTICLE V : PURPOSE AND OBJECTIVES

a. To provide a safe, effective, and efficient transportation services to the

riding public,.
b. To promulgate rules and regulations that shall govern the operation,
administration, and maintenance of their respective terminals, and
issuance of policies pertaining to their plying.
c. Coloring scheme will help enforcers to distinguish between for hire,
colorum, and out of line PUJ’s.
d. The numbering system will help the riding public to identify the
perspective route and association of every Public Utility Jeepneys plying
in the municipality.
e. The Local Government hereby create the composition of Local
Transport Board Council (LTC) wherein the Municipal Mayor is the
chairman.
f. The commission (LTC) shall handle all the issues pertaining to
transport.
g. This ordinance shall mandate all Jeepney Operators and Drivers
Association Inc. (JODAI’s) existing in the municipality to compulsory
render their membership to the UTRA FEDERATION of GMA, Cavite for
its unification.

ARTICLE VI IMPLEMENTING GUIDELINES

a. Coloring scheme will help the law enforcer to identify the respective jeepney

association.

b. The LGU shall be issued a colored sticker for every organization designed for

them.
c. Aside from the LGU sticker, every PUJ shall also secure an UTRAFED sticker

exclusively design for each associations. Payment of such sticker shall be

determined by UTRAFED and all the associations. This shall be considered as

a valid membership certification from the UTRAFED as required under Section

2 (d) of this Ordinance.

d. The size of the stickers shall be Three (3) inches in diameter which shall be
stick on windshield of each qualified PUJ.

e. Each sticker shall be charged of two hundred pesos (Php 200.00) and be
renewed yearly depending on the ending plate number. The amount of sticker
may be increased as provided by the rules.

f. The requirement in securing municipal stickers are as follows;

1. Xerox copy of certificate of registration (CR) and current official receipt

(OR) upon presentation of original.

2. Xerox copy of Public Conveyance or Decision issued by the LTFRB.

3. The President and Vice President of each accredited association shall issue
an endorsement certificate for their respective members stating that
applicant is a bonafide member of his/her association. The UTRAFED shall
thereafter issue an UTAFED sticker to the applicant.

4. Every unit is required to secure a federation’s certification before the

MTMO will screen/validate their submitted requirements before acquiring
secure a municipal sticker.

5. All organization shall submit a master list of all active members.

g. Those owners/operators of PUJ’s with legitimate franchise/route, who doesn’t

have a membership to any accredited JODAI’s are hereby mandated to be a
member of association listed below depending upon on their respective route.

h. No additional association shall be formed and thereafter accredited except

upon meritorious circumstance that will justify the forming of a new JODAI;

i. All are required to be a member of UTRAFED.

ARTICLE VII : COMPOSITION OF THE Local Transport Council

(LTC)

Section 1. Local Transport Council (LTC) Composition

There is hereby created the Local Transport Council of GMA, Cavite for the
purpose of handling and overseeing all issues pertaining to transport, which shall
serve as the grievance committee of the transport of the transport group for the
proper implementation of this ordinance.

The LTC shall be composed of the following:

CHAIRMAN - Municipal Mayor

VICE CHAIRMAN - Municipal Vice Mayor
MEMBERS - SMB-Chairman on Comm. On Transportation
SMB-Chairman on Comm. On Rules
MTMO Chief
PNP Chief
UTRAFEDERATION President

The members of the LTC cannot be altered by any executive issuances by

the Municipal Mayor.

Section 2. Function of Local Transport Council (LTC)

a.) It shall serve as he grievance committee of this ordinance which shall

hear, resolve and/or settle amicably all cases/question that may arise in
the implementation of this ordinance.

b.) And such other powers as maybe determined by the Municipal Mayor
through the issuance of an Executive Order.

ARTICLE VIII : UTRAFEDERATION COMPOSITION

There is hereby the list of duly accredited and recognize Jeepney

Operators & Drivers Association Inc. (JODAI’s) operation and plying in the
Municipality of General Mariano Alvarez, Cavite.

Section 1. There shall be UTRAFEDERATION of GMA, Cavite, which shall

be composed of the following JODAI’s;

a.) Number coding shall be in consonance with the national and provincial
coding.

Section 2. Function of the UTRAFEDERATION of GMA, Cavite.

a. To support the planning, implementing and monitoring of the plans and

programs implemented by the local and national government.

b. To participate issues regarding transport problems.

c. Help to improve the traffic condition in the municipality.

d. The UTRAFEDERATION shall review, verify the authenticity and veracity

the documents submitted by the JODAI’s for stickering system, and
upon completion of the requirements, the federation shall issue a
certification and endorsed to the MTMO office for their proper
disposition.

e. To hear and decide cases involving disputes among drivers and

associations;

f. To campaign simultaneously the observance of traffic rules in the

municipality.

ARTICLE IX : GRIEVANCE MECHANISM

a. In case that there are disputes among drivers, the association concerned
shall exert effort to reconcile the erring members themselves;

b. UTRA FED shall have jurisdiction over drivers and associations having
disputes such as but not limited to overlapping route, terminals, elections
and other matters;

c. Decision of the UTRA FED can be appealed to the Local Transport Council
which shall have final decision on every issue raised before it. Its decision
is final and executory without prejudice to any case that will be filed
before any court or administrative agencies and tribunal.

ARTICLE IX : PROHIBITED ACTS

1. All colorum or those jeepneys plying without franchise shall not be allowed
to secure sticker.

2. It is unlawful to all PUJ to convey, transport passengers/articles without

securing sticker as herein embodied upon.

ARTICLE X : PENALTY

Violations of any provision of this Ordinance shall be punished as follows;

 a. Drivers and/or Operation License shall be confiscated by the
apprehending officer (TMO/PNP) which shall be turned over to the
office of the Municipality Treasurer and can be redeemed only after
paying a fine in the amount of Three hundred pesos (Php 300.00) only.

b. Associations as Juridical Entity/Person-refusal to join the

UTRAFEDERATION is declared unlawful under this ordinance. Officers
of JODAI’s shall be imprisoned for a period of one (1) month but not
exceeding six (6) months and shall be paying a fine of one thousand
pesos but not exceeding two thousand five hundred pesos (P2,500.00),
or both fine and imprisonment as discretion of the court and shall be
the basis for the authority not to issue stickers for the members of the
said JODAI.

ARTICLE XI : PUBLIC DISSEMINATION

This ordinance shall be posted in all public places and shall be distributed
to all Barangays of the Municipality of Gen. Mariano Alvarez, Cavite.

ARTICLE XII : SEPARABILITY CLAUSE

If not any reason, any provision of this ordinance is declared by a proper

court of authority unconstitutional, the remaining provisions not affected
thereby, shall continue in full force and effect;

ARTICLE XIII : REPEALING CLAUSE

All ordinance, rules and regulations or parts thereof, whose provisions area
conflict with or contrary to, the provisions of this ordinance are hereby repealed,
amended and modified accordingly;

ARTICLE XIV : EFFECTIVETY CLAUSE

This ordinance shall take effect upon approval of the concern authorities.
