AFFIDAVIT OF DESISTANCE
I, KATYA SANTOS, of legal age, single, and a resident of Poblacion 6,
DEF, Missu Occidental, after having been duly sworn to in accordance with law
hereby depose and state that:
1. I am the private complainant for Violation of R.A. 10175 against Fidel
Castro in the case entitle “People of the Philippines versus Fidel Castro”,
Criminal Case No. RTC-1234, Regional Trial Court, Branch 101, Misao
City.
2. After my sober and soul-searching assessment and analysis of the
incident, I have realized that the said incident I narrated in my
Complaint-Affidavit was a result only of misapprehension of facts and
misunderstanding between me and respondent. I cannot point out
without a doubt respondent or any other person/s who made the
derogatory remarks of me on Facebook and/or inflicted harm against
me;
3. Since I could not state with certainty and without doubt the liability of
the respondent, in fairness to him, I am permanently withdrawing my
complaint against him. I clear him of whatever responsibility or liability
to me and that I am no longer interested, and I hereby desist, in
prosecuting the said case;
4. I hereby inform the City Prosecutor of Misao City that I am withdrawing
my complaint for Violation of R.A. 10175 in Criminal Case No. RTC-
1234, Regional Trial Court, Branch 101, Missao City.
5. I likewise request the Regional Trial Court, Branch No. 101, Misao City to
dismiss with prejudice the said criminal case.
