Cross examination of Lara:

Question no. 11 – I object to question no. 11, leading.
Question no. 14 - I object to question no. 14, irrelevant as the issue is about the
arrest of the accused.
Question no. 17 – inconsistent with his prior answer. The accused stated in his JA
that he was blindfolded the whole time.
(Start of my cross examination)
Lara: Good Morning Mr. Nicoleta.
Dar: Good Morning Atty.
Lara: Can you please state for the record the reason why you are here right now.
Dar: I am giving my testimony for the case filed against me.
Lara: What are the charges against you?
Dar: I am charged with illegal possession of firearms.
Lara: Do you recognize this document, Mr. Nicoleta? ( Show the JA of Reg)
Dar:: Yes. That is a Judicial Affidavit that I executed.
Lara: Is this your signature, Mr Nicoleta?
Dar: Yes.
Lara: I would like to submit the Judicial Affidavit as evidence and marked as Exhibit
A.
Lara: What happened last December 21, 1990?
Dar: I was arrested in my apartment. . I was awaken by the loud thud caused by the
force exerted on the door.
Lara: So it is possible that the officers were actually knocking before entering your
door and after a lot of attempts to hear from you eventually forced themselves to
enter your apartment when they did not hear anything from you, is that correct?
Dar: Yes.
Lara: You said you were blindfolded after, is that correct?
Dar: Yes
Lara: You were blindfolded the whole time is that correct?
Dar: Yes
Lara: That after the officer blindfolded you, you did not know what happened after
when they entered the room, is that correct?
Dar: Yes
Lara: Cause the officer would not take any chances in blindfolding you so that you
won’t be able to see any vision, is that correct?
Dar: Yes
Lara: But you said earlier that the officers took your passbook, is that correct?
Dar: Yes
Lara: So it is possible that you had no idea that the officers took possession of your
passbook since you were blindfolded the whole time, is that correct?
Dar: Yes
Lara: So it is also possible that the officers did not take your passbook since you did
not see them, is that correct?
Dar: Yes
Lara: According to your JA Question no. 19, you were asked if you know the officers
who were present at that time, is that correct?
Dar: Yes
Lara: And that you said you can point them out when you see them, is that correct?
Dar: That is correct.
Lara: But you said a while ago that you were blindfolded when you arrived at the
camp crame, is that correct?
Dar: Yes
Lara: So it impossible for you to point out the officers who were present at the time
since you cannot see anything, is that correct?
Dar: Yes
