Foreword

Real estate is a highly-regulated industry and is among just a few industries that
require interaction with every level of government. From national agencies to
barangay councils, real estate firms comply with a gamut of regulations that both
impact project timetables and financial costs. For example, condominium projects in
Makati require about 18 different permits and would normally take 52 weeks to
process until formal occupancy; while house and lot projects in Quezon City require
about 17 permits whose acquisition can run for about 54 weeks before occupancy.

In an environment where things can be “easily discussed” or where there are “ways
to facilitate things faster,” it may be too easy to overlook the fact that shortcuts
should never be considered norms but rather exceptions. The highest standards of
integrity must be observed in any and all dealings.

Given that it is a closely-regulated business, real estate developers also often forget
that another implication is that there are guidelines as well as timelines that
regulatory bodies have to observe and comply with established to protect those who
would engage in this trade.

There are certain realities that developers need to internalize to avoid


inconveniences and delays throughout the permits process. Foremost is
understanding that permits have prescribed processes and consequently processing
durations. It is also important to realize that a permit application is dependent on the
input documents that are submitted in support of it.

All too often, “shortcut” becomes the byword – standard processing timelines are set
aside and input documents are forwarded on a “to follow” basis. But at the end of the
day, leaving this much room for disaster will often leave developers more exposed to
danger not to mention more financially-strained.

Further critical factors that need to be understood include:

• Every permit has a prescribed processing duration


• Shortcuts that may be taken by national government agencies or LGUs are
limited by their powers
• Shortcuts taken expose the whole company to liability
• Shortcuts taken to acquire permits could negatively impact the status of other
projects if protocols are not strictly observed

Challenges

It is easy to underestimate the power of regulatory bodies to enforce policy,


especially LGUs. Considering that effort and resources expended for relationship-
building, it is easy to miscalculate reactions to regulatory violations. LGUs show their
muscle by issuing Cease-and-Desist Orders (CDO), impositions of fines or penalties
and such other official orders that may result in work stoppage and consequently
added un-programmed costs.

On the other hand, it is just as easy to ascribe too much power to LGUs as far as
their capabilities and willingness to intervene on behalf of the developer. Verbal
arrangements can be forgotten when questioned and certain “arrangements” can be
ignored under official scrutiny, leaving a developer vulnerable or even liable for
overlooking mandated processes.

Goals

The procedures, input requirements and timelines in the processing of the different
permits for property development have already been set forth in different laws,
resolutions and decisions by national government agencies and LGUs. The
challenge however is for companies to improve permits compliance and implement
strategies for managing permits applications.

As part of the groundwork for coming out with a standard for permits acquisition,
Exad has identified the following goals as well as the challenges that need to be

Simply stated, high permits compliance is good business because it minimizes any
risk of exposure to the company and allows for stronger partnerships with LGUs.

The Exad Permits Manual

The Permits Manual is Exad’s latest innovation designed to help SBUs in permits
acquisition in the following ways:

1. By providing a PROCESS ROADMAP that will help guide SBUs in their


applications;
2. By creating a QUICK REFERENCE HANDBOOK where the information
pertinent to permits acquisition can be easily checked and verified; and
3. By compiling an INVENTORY LIST of forms, both applications and sample
permits.

The Manual will also include LGU information such as key Executive and Legislative
offices that issue permits, permits sequences and processing durations to help
navigate through this often confusing system. Input requirements as well as process
flows per permit have likewise been identified for easy reference to users.

This initial edition of the Permits Manual shall include information on the permits
process for the following areas, so that readers can see the process nuances in each
of them:

• Makati
• Quezon City
• Taguig
• Calamba City

The Permits Manual has been developed to equip SBUs with the proper tools to
confidently handle this stage of project development and encourage higher permits
compliance. It is Exad’s further intent to make the Permits Manual available in order
to promote the following ideals vis-à-vis permits acquisition:

• Information and familiarization


• Standardization
• Accountability
• Transparency

With the release of the Permits Manual and the continued implementation of its
Permits Tracker System or PTS, Exad hopes to provide SBUs the complete service
package at each stage of permits acquisition.

Overview

The City of Makati, or simply Makati, is Nickname: The


one of the cities and municipalities that Financial Capital of the
make up Metro Manila, the greater Philippines; The Wall

is also home to many first-class shopping
malls, which are located at Ayala Center
and Rockwell Center. Makati also has the
tallest buidlings in the Philippines like
PBCOM Tower, G.T. International Tower.

Makati came from the Tagalog word kati,


which means tide. This primarily refers to Country Philippines

3. Income tax return for the last 3 preceding years;
4. Certificate of registration from Securities and Exchange Commission
5. Articles of incorporation or partnership;
6. Corporation by-laws and all implementing amendments, and
7. For new corporations (3 years and below) statement of capitalization
and sources of income and cash flow to support work program.
J. Permit to drill from NWRB or certificate of coverage from concerned local
franchise holder.
K. List of names of duly license professionals who signed the plans and other
similar documents in connection with application filed indicating the following
information:
1. Surname; 2. First name; 3. Middle name; 4. Maiden name, in case of
married women professional; 5. Professional license number, date of
issue and expiration of its validity; and 6. Professional tax receipt and
date of issue 7. Taxpayer’s Identification Number (TIN)

Application form
1, Sworn Registration Statement using either:
a. HURB Form 001 for Corporation; or
b. HLURB Form 003 for Single Proprietorship
2. Certified True Copy of Transfer Certificate of Title (TCT or Original Certificate
Of Title (OCT) duly stamped with original marking “CERTIFIED TRUE COPY”
by the proper Register of Deeds and bearing its seal or security marker.
a. When a project covers more than 20 individual titles without the
required marks described above, the following shall be required:
a.1 Photocopy of TCTs
a.2 Certification from the register of deeds concerned with its
seal or security mark giving the
following information:
a.2.1 TCT or OCT numbers;
a.2.2 Name of all registered owner(s) and their
sharing, If any;
a.2.3 Area covered by each title;
a.2.4 Number of OCT or TCT from which the title is
derived;
a.2.5 Statement of all uncancelled liens and
encumbrances, If any;
a.2.6 Lot and block numbers as well as PSD/PSU/PCS
number. etc.
b. When certified copy of the TCT was issued more than one month
prior to the application for Certificate of Registration (CR), affidavit of
the owner that the property is free from liens and encumbrances. When
the applicant is not the owner, deed from the registered owner showing
clearly the authority of the applicant to the property, e.g., its
development and sale of individual lots or units; to sign and receive
documents; and other relevant authority. In case the
subdivision/condominium project or portion thereof is mortgaged.
c. In case the project or portion thereof is mortgaged, it is sufficient if
the instrument of mortgage contains a stipulation that the mortgagee
shall release the mortgage or any subdivision lot or unit as soon as the
full purchase price for the same is paid by the buyer. Otherwise,
accomplished the following:
c.1 Mortgage’s Undertaking (HLURB Form No. ____)
c.2 Morgagor’s Undertaking (HLURB Form No. ____)
3. Duly audited balance sheet (certified copy of the original) issued and signed
by the authorized official of the applicant and under the latter’s authority.
a. When individual persons are involved and no balanced sheet can be
submitted, income tax returns for the preceding year duly received by
BIR office and tax receipts evidencing payment.

b. When applicant is a new corporation, partnership, association or
single proprietorship, i.e., no financial statement or income tax return
has been prepared yet, sworn statement declaring:
b.1 Other assets or sources of funds and other resources;
b.2 The nature of control or ownership over such assets, funds
or resources;
b.3 Commitment to the effect that, if necessary, the same shall
be used to complete the project.
4. Articles of Incorporation (or of Partnership or Association), amendments
thereof and existing by-laws (or its equivalent) clearly indicating the authority of
the applicant to engage in real estate trade particularly in the development and
selling of lots or units. When an applicant deviates from the intended line of
business stipulated in its articles of incorporation (or partnership or
association), authorization from the Securities and Exchange Commission
(SEC) and/or the appropriate government agency to engage in the
development and selling of the subject project.
5. A copy of any circular, prospectus, brochure, advertisement, or
communication used/to be used for public offering of subject project and for
circulation upon approval by the Board.
6. Sample copy of Contract to Sell to be used in the public offering of lots, units
or lots and units. The provisions of PD 957. (The duties and responsibilities of
owners/developers to buyers as provided under Sections 17 to 20, 22 to 27, 30,
31 and 33 of P.D. 957 must be incorporated in all Contract to Sell.)
7. Affidavit of Willingness to Change Name [HLURB Form N0. ___].
8. Certified true copy of Environmental Compliance Certificate (ECC)/Certificate
of Non-coverage (CNC),whichever is applicable, duly issued by the Department
of Environmental and Natural Resources (DENR).
9. Zoning Certificate from HLURB Regional Officer
10. Certified true copy of Dept. of Agrarian Reform (DAR) conversion order.
11. Electrical plan and specifications duly signed and sealed by a licensed
professional electrical engineer and duly approved by the local franchised
holder.
12. Permit to operate a deepwell and subsequent submission of confirmed
water resistivity test from the national Water Resources Board (NWRB). Water
potability test results from concerned government agencies.
13. Road right of way and drainage right of way (if applicable).
14. Affidavit of Undertaking to Submit Titles

16. Additional requirements For All Types of Residential Subdivision projects:
a. 2 copies of verified survey returns with label for all non-saleable
areas including but not limited to parks and playgrounds, community
facilities and roads and easements.
b. Copy of the following documents in case the development permit
was issued by the Local Government Unit (LGU) pursuant to the 1991
Local Government Code and related issuances:
b.1 Sangguniang Resolution/Ordinance granting of
development permit/
subdivision development plan containing the following
information:
b.1.1 full name of the grantee or permit tee and his
address;
b.1.2 complete project name and its location;
b.1.3 date of the resolution or ordinance;
b.1.4 project area;
b.1.5 full listing of title(s) covering the project;
b.1.6 legal basis of the approval (PD 957, EO 648 and
other related laws);
b.2 Certified true copy of resolution conferring authority to the
mayor or other local government official to issue development
permit in cases where the same was not granted by the
Sangguniang Bayan/Panlungsod.

Evidence of approval of the subdivision scheme by the local


government official must be any original copy or one certified
as true copy thereof by the authorized local government
official, indicating clearly his full name and position and the
date of approval. It must contain the same data as described
above. Most important of all, it must bear an indication of
Sanggunian approval such as but not limited to words like
“APPROVED BY AUTHORITY OF THE SANGGUNIAN” or
others of similar import, it being understood that the
Sanggunian has properly issued such authority.
c. Proof of compliance to Sec. 18 of RA 7279 in any of the following
manner:
c.1 Development Permit of socialized housing projects within
the main subdivision.
c.2 License to sell of socialized housing project offered as
compliance if location of compliance is not within the main
subdivision project.
c.3.Joint venture agreement with LGU or other housing
agencies or other owner / developer.
c.4. Copy of bond issued by the Home Mutual Development
Fund /PAG-IBIG or Home Guaranty Corporation (HGC) where
the main project is located or by any of the housing agencies.
