MOST RESPECTFULLY SHOETH:-

1. That the above noted case is pending before this

Hon’ble court and fixed for 21.07.2017.

2. That the Hon’ble court impose cost of Rs.5000/-

on the plaintiff for non appearance of the

counsel as well as plaintiff.

3. That the counsel for plaintiff was suffering

from disk problem in back bone and was not in a

position to attend the Hon’ble court on

21.04.2017 and the plaintiff was in trauma due

to the death of the his son in law because of

it, counsel requested to his colleague to attend

the court and take adjournment by apprising the

Hon’ble court with the fact of unability to move


of the counsel and inability of plaintiff due to

the shock of the death of his son in law.

4. That one of the colleague of the counsel for

plaintiff apprise the Hon’ble court on

21.04.2017 with the problem of counsel and

requested for adjournment, hence this

application for waiver of cost.

It is most respectfully prayed that your

honour may kindly waive off the cost of

Rs.5000/- from the plaintiff.

over and explained to me by my counsel and the

same has been drafted under my instructions by

my counsel and the facts stated therein are true

and correct to my knowledge and the same may be

read as part and parcel of this affidavit.
