EMPLOYMENT AGREEMENT
AN AGREEMENT MADE THIS 8th DAY OF JUNE YEAR 2021
BETWEEN
ABJ ENGINEERING & CONTRACTING Co. KSC (Closed)
whose postal address is P.O. Box 28789, Safat, 13148, Kuwait,
(hereinafter called the “COMPANY”)
AND
MR. MOHAMMAD MERAJ ALAM
of INDIAN Nationality Passport No. N2897036
{hereinafter called the “EMPLOYEE”)
whereby it is agreed as follows:
1, The COMPANY hereby employs the EMPLOYEE on single status who age
the COMPANY in the position of SENIOR INSTRUMENT _AND_(
TECHNICIAN - F00703 CB or in any other reasonable capa
time be determined by the COMPANY, in any place in Kuwait or outside K»:wait where
the EMPLOYEE’s services may be required.
2. ‘This Agreement is subject to the terms and conditions stated herein and to the articles of
Kuwait Labour Law, (Private Sector) and to the COMPANY’s regulations now or
hereinafter enforced which form an integral part hereof, or any other relevant laws,
orders or regulations applicable in Kuwait.
3. ‘The EMPLOYEE may be called upon the COMPANY’s request to trave! outside the
State of Kuwait on the COMPANY’s business or work and at the COMPAN /”s expense
in accordance with the COMPANY’s regulations, the EMPLOYEE should be prepared
to implement any change of work site.
4. This agreement becomes effective on the date the EMPLOYEE commences his duty on
site in Kuwait, and valid for a period of (}—————year{s) /_ unlimited from such,

4.1-Fhe COMPANY reserves-the right te extend this-contrecton-amonte-by nonth basis:

4.2 The COMPANY has the right to terminate this contract by giving the EMPLOYEE
notice in writing as per Kuwait Labor Law (Private Sector). This clause is not
applicable in the case of summary termination by the COMPANY as per Kuwait
Labor Law (Private Sector).

At the time of appointment, the COMPANY shall provide the EMPLOYEE an economy
class one way air ticket from MUMBAI to the work location.
6. In case of resignation by the EMPLOYEE, he will be subjected to the Kuwait Labour
Law (Private Sector). The EMPLOYEE should give THREE months notice in writing
to the COMPANY. The COMPANY has the right to refund from the EMPLOYEE all
expenses incurred towards his employment, as well as any loss resulting from non
availability to perform duties on site.
7. The salary and compensation for EMPLOYEE will be as follows :
a) Minimum Take Home Salary KD.710 /- Monthly.
b) Free food and single status shared accommodation according to the COMPANY
standards.
c) Free transport from COMPANY accommodation to site and back.
4) Accident on duty insurance will be provided within the State of Kuwait.
¢) Free medical treatment to the extent provided free by the State of Kuwait
8. The EMPLOYEE agrees to work FORTY EIGHT (48) hours per week, at a rate of eight
hours a day, six days per week in any combination thereof. This excludes shift and call
‘outs which may be required from time to time by the COMPANY for performance of the
work.
9. The EMPLOYEE may be assigned to drive a COMPANY vehicle to carry out his duties,
whereby he will be accompanied by his crew members where and when required to
comply with his job.
‘The EMPLOYEE who is professional driver shall, in addition to his regular driving
duties, assist other trades employees as and when instructed to do so by the concemed
Foreman.
10. Overtime will be paid only after FORTY EIGHT (48) hours per week, if so required by
the COMPANY, and in such instances where there is payment, it shall be as per Kuwait
Labour Law (Private Sector).
11, The EMPLOYEE shall be entitled to annual paid leave as per Kuwait Labor Law
(Private Sector). The COMPANY reserves the right to decide the date of this leave and
to postpone any scheduled leaves at any time without prior notice,
12. The EMPLOYEE taking an approved entitled annual paid leave after serving One years
will be provided a return leave air ticket, economy class, sector Kuwait / MUMBAI /
Kuwait, provided the COMPANY foresees continuation of work for another one year
after the leave. Such ticket is only provided for EMPLOYEE going on approved entitled
paid leave, with COMPANY’s option to select Airline carrier.

Any EMPLOYEE proceeding on approved emergency leave shall arrange and produce
his return air ticket and report back for duty within the stipulated period. COMPANY
has the right to terminate the EMPLOYEE, who overstays his leave and will not be
entitled to any compensation and benefits.
13. All expenses related to visa, residence, civil ID and passport renewals are to COMPANY
Account,
14, All income and other taxes whatsoever by the State of Kuwait are to EMPLOYEE
Account,
15. The COMPANY shall be entitled to deduct from the EMPLOYEE against any salary or
any other monies payable by the COMPANY for the goods or property lent to the
EMPLOYEE for performance of duties for which the EMPLOYEE shall be accountable
for and which he has not returned in good order to the COMPANY upon the termination
of his Contract or on being asked by the COMPANY to do so.
16, Under this Agreement the EMPLOYEE is under a probation period of one hundred (100)
days. During the probation period the COMPANY reserves the right to terminate the
services of the EMPLOYEE without serving any notice.
17. In the event of the death of the EMPLOYEE, the COMPANY shall immediately notify
the INDIAN Embassy and shoulder the expenses in the shipment of EMPLOYEE’s
remains and personal belongings to Home Country. In case the shipment of remains are
not possible, burial will be done in Kuwait upon prior approval of next of kin of the
deceased and/ or the INDIAN Embassy.
18. Statutory Public Holidays will be determined by Kuwait Labour Law (Private Sector),
19. During the term of this agreement, the EMPLOYEE undertakes
a) To carry out his duties diligently and faithfully to the best interests of the
COMPANY.
b) To follow all instructions given by his supervisors.
c) To abstain from working full time or part time for any other occupation or business
with a third party.
4) To abstain from disclosing in any way information relating to the COMPANY or its
operations.
©) Tosstrictly observe the Laws and Regulations of the Country in which he is working
in.
20. That in addition to the COMPANY’s powers under the provision of its disciplinary code
and Laws of Kuwait the COMPANY shall have the right to terminate this Contract
summarily without notice or money in lieu thereof if the EMPLOYEE becomes
incapacitated for duties through illness or accident due to his own fault or improper
conduct.

21. This Contract supersedes and cancels all previous agreements between COMPANY and
EMPLOYEE whether written or oral
22. In the event of any dispute arising from the interpretation of this Contract the ARABIC
Version shall prevail.
