9. SCOPE OF WORK
The role and functions of the consultant shall include but not limited to the following:
a. Review of Execution D.P.R, including Structural Drawings, Architectural
Drawings and Documents.
b. TPQA Organization shall ensure that the site is equipped with necessary
documents like copy of agreement, approved design, execution D.P.R &
working drawings, BIS Code, CPWD specifications, list of approved
manufactures, tools for checking quality of work & testing facilities.
c. Review Inspection and monitoring of Construction Work;
d. Construction Test during construction and issuing Specification Compliance
Certificate.
e. Determining, as required under the Agreement, the cost of any work or
services and/or their reasonableness;
f. Support and help the UKAVP with the day-to-day management of all project
activities.
g. Co-ordinate Planning, Control and Management of the work as a multi-
disciplinary team.
h. Identify the need for standardization of system equipment's and materials.
i. Check and review the design build contractor’s proposals, reports and
drawings submitted by contractor and Consultant shall submit their
observations with measures for rectifications.
j. Inspection of material onsite and laboratory testing of material.
k. Entire construction work shall be supervised and assure that project to be
completed within the indicated time frame.
l. Construction supervision, quality assurance and commissioning of all the
construction work.
m. To review the contractor's implementation schedules and resource
requirements.
n. Monitor progress, evaluate results and identify & resolve constraints.
o. Monitoring implementation of quality assurance program for all works and
ensures the quality outputs.
p. Supervise day-to-day construction management.
q. Establish a contract tracking systems including implementation schedules and
milestone achievable.
r. Record and Check all Quantity measurements, as per milestone set for
payment physical verification & calculations etc., recorded for payment
purpose, submit physical progress of work, component wise (i.e. earthwork,
RCC brick work, etc.) with cost on monthly basis or as and when decided by
UKAVP.
s. To ensure that the desired quality of construction as well as the structural
safety standards are achieved.
t. Completion of work within specified deadline.
u. Ensuring that the Contractor fulfil all the contractual and financial requirements
of the contracting Parishad.
v. In addition, to the objectives of quality, cost and time Consultant should
ensure for healthy environment of work site as well as safety of works,
property, personals and general public.
w. TPQA Organization shall ensure implementation of environmental safeguards
for all construction activities by providing/ deputing requisite supervisory staff.
x. Ensure that the work shall be executed through contractor as per technical
specifications or/and as per B.I.S/I.S code/CPWD/N.B.C.C codes or standard
applicable for specific item of work.
y. TPQA Organization shall discharge its duties in a fair, impartial and efficient
manner, consistent with highest standards of professional integrity and good
industrial practice.
z. TPQA Organization shall be responsible for co-ordination with Contractors,
Site Supervision, follow up of work, and maintenance of all Electrical,
Mechanical, Plumbing related job.
aa. All the records shall be maintained with regard to quality and measurement,
etc. and shall be provided to UKAVP as and when required.
bb. Determining, as required under the Agreement, the period or any extension
thereof, for performing any duty or obligation;
cc. Undertaking all other duties and functions in accordance with the agreement.
dd. During the Development Period, the Consultant shall undertake a detailed
review of the Drawings to be furnished by the Implementing agency
along with supporting data, including the investigations, characteristics
of materials from borrow areas and sites and topographical surveys. The
project management consultant shall complete such review and send its
comments/observations to UKAVP and the Implementing agency within 15
(fifteen) days of receipt of such Drawings. In particular, such comments shall
specify the conformity or otherwise of such Drawings with the Scope of the
Project and Specifications and Standards.
ee. TPQA Organization shall review any modified Drawings or supporting
Documents sent to it by the Implementing agency and furnish its comments
within 7 (seven) days of receiving such Drawings or Documents.
ff. TPQA Organization shall review the detailed design, construction
methodology, quality assurance procedures and the procurement,
engineering and construction time schedule sent to it by the Implementing
agency and furnish it with comments within 15 (fifteen) days of receipt thereof.
gg. TPQA Organization shall inspect the Construction Works and the Project on
daily basis, and make out a report of such inspection (the "Inspection Report")
setting forth an overview of the status, progress, quality and safety of
construction, including the work methodology adopted, the materials used and
their sources, and conformity of Construction Works with the Scope of the
Project and the Standards and Specifications. In a separate section of the
Inspection Report. TPQA Organization shall describe in reasonable detail the
lapses, defects or deficiencies observed by it in the construction of the Project
Facilities. Consultant shall send a copy of its Inspection Report to UKAVP and
the Implementing agency within 7 (seven) days of the inspection.
hh. TPQA Organization shall inspect the Project, if any lapses, defects or
deficiencies require such inspections or as directed by the UKAVP.
ii. For determining that the Construction Works conform to Standards and
Specifications, TPQA Organization shall carry out, or cause to be carried out,
tests on a sample basis in accordance with Good Industry Practice for quality
assurance.
jj. In the event that the Implementing Agency/Construction Agency carries out
any remedial works for removal or rectification of any defects or deficiencies,
Consultant shall carry out, or cause to be carried out, tests to determine that
such remedial works have brought the Construction Works into conformity with
the Standards and Specifications, and the provisions requisite shall apply to
such tests.
kk. If at any time during the Construction Period, Consultant determines that the
Implementing agency has not made adequate arrangements for the
safety of workers in the zone of construction or that any work is being
carried out in a manner that threatens the safety of the workers, it shall make
a recommendation to the UKAVP forthwith, identifying the whole or part
of the Construction Works that should be suspended for ensuring safety in
respect thereof.
ll. In the event that the Implementing Agency/ Construction Agency carries
out any remedial measures to secure the safety of suspended works for
workers and Users, it may, by notice in writing, require the Consultant
to inspect such works, and within 3 (three) days of receiving such notice, the
Consultant shall inspect the suspended works and make a report to the
UKAVP forthwith, recommending whether or not such suspension may be
revoked by UKAVP.
mm. If suspension of Construction Works is for reasons not attributable to the
Implementing agency, TPQA Organization shall determine the extension of
dates set forth in the Project Completion Schedule, to which the Implementing
agency is reasonably entitled, and shall notify UKAVP and the Implementing
agency of the same.
nn. Consultant shall carry out, or cause to be carried out, necessary tests to
determine that the Construction Works conform to Standards and
Specifications and issue a Specification Compliance Certificate (“Specification
Compliance Certificate”).
oo. Consultant shall aid and advise the Implementing agency in preparing the
Maintenance Manual.
pp. Consultant shall submit the monthly progress report to UKAVP in the format
as decided by UKAVP.
qq. The scope shall not be limited to above points and can be changed or added
on at a later stage as per the requirement of the assignment/project as the
need may be.
rr. Testing Plans for Major E&M Services
The testing plan for quality control for major E&M services will be as per
latest CPWD guideline.
1. Lot size sample test and methods etc. prescribed in quality plan are only
suggestive in nature. This shall be modified to suit the specific requirement of
their work and prescribed in the agreement accordingly.
2. To eliminate the possibility of receiving outdated/ old material/ refurbished
equipment at site, it shall be ensured that the material supply against the
contract shall be not older more than 12 months from date of receipt at site.
3. To procure the genuine material from suppliers/ authorized dealer etc shall be
the responsibility of contractor who shall preserve copies of invoice/ proof of
dispatch. The TPQA Organization shall examine/ scrutinize/ verify the same.
4. All routine tests as prescribed in IS code/ CPWD specifications shall be carried
at manufacture works/ third party labs & as per the contract agreement.
5. All items to be used and workmanship shall be thoroughly checked physically
and for their performance as per The CPWD guideline.
The TPQA will be responsible for making all arrangements for transport,
accommodation etc, for their site visits and the Department or the Administrative
Department or the Implementing Agencies will not be responsible for making any
such arrangement. TPQA shall be responsible for holding Quality control testing
independently at site in Irrigation Research Institute Roorkee (I.R.I) or any
N.A.B.L. approved lab and payment for testing, if any will be made by the TPQA.
The TPQA shall conduct testing of samples not less than 10% of numbers of test
provided as per the relevant IS codes.
To provide a clear feedback in respect of quality of project execution in the
context of specifications mentioned in the estimate. The project will be
evaluated in terms of attainments of its objectives, correctness of estimate,
correctness of measurements and quality control of construction materials and
important items of work. In case of any defects, the TPQA shall also clearly
suggest remedial measures and penalties to be levied by the implementing
agencies against the contractor as per the contact between Implementing
Agency and Contractor.
The TPQA shall also report whether the work is being implemented as per
sanctioned estimate and Drawing or not. In case of glaring gaps the matter
should be brought to the notice of the Department.
The Technical examination report including test reports (as applicable) for each
visit shall be submitted by the TPQA as required as per direction of the First
Party within time frame.
All record in the TPQA process shall be the property of UKAVP and nothing shall
be shared with any other person(s) / organization(s) / except with authorized
persons of UKAVP.
10. Manpower Deployment/visits:
The Successful Bidder will provide list and details of personnel to be deputed on site
with their current updated resume reflecting necessary and relevant work experience
as required for the project and shall make sure that the Parishad has conducted an
interview before the personnel has been deputed on site.
For proper functioning of TPQA Organization and daily routine test, the TPQA
Organization will deploy following manpower;
i. The key expert (on requirement basis) with minimum 10 years of academic/field
experience shall make one site visit each month aligning the visit with critical/ important
stages of work. In between also the experts may be required to visit depending on
exigency at site/ as per the directions/ requirements of the UKAVP, for which no extra
amount shall be payable.
ii. One Technical person having B.TECH/ BE or equivalent degree in Civil Engineering
with minimum 05 (five) years field experience of which minimum 3 years experience is
in quality assurance, will be stationed at the site for daily site supervision. For E&M
works, the engineers with requisite experience should visit / remain at site during
execution of E&M works.
iii. In case of any critical observations during site visit of expert, the same shall be
reported immediately to UKAVP/ authorized representative along with suggestions/
remedial measures.
iv. The manpower deployed at site can be allotted more than one project with the
Thesil/City area. If required he should be ready to Transit to other site or location .
11. DELIVERABLES
1. The payment will become due on approval of the Weekly & Monthly reports and on
raising of bills/invoice by the consultant after the approval of the stage report. The
processing time of the payment will be 60 days for final payment and 30 days for all
other payments.
2. Quarterly Payment shall be released on approval of Monthly Progress Report
submitted by Consultant.
3. The Consultant shall submit reports in all respect to site work, inspection reports,
material reports, quality reports and also reports as required in Scope of Works.
4. The reports shall be submitted daily, weekly, monthly basis or if the nature of work
requires a report preparation and submission.
12. PAYMENTS TO THE CONSULTANT
1. Total Cost of the Services
(a) The total cost of the Services payable is set forth in Financial
Proposal as per the consultant’s proposal to the Parishad and as
negotiated thereafter.
(b) The payments under this Contract shall not exceed the amount
specified in Financial Proposal.
1.1 Currency of Payment: All payments shall be made in Indian Rupees. [In
case the payment is to be made in the currency other that Indian
Rupees, the same shall be mentioned instead of Indian Rupees]
1.2 90% amount of the scrutinized amount of the bill will be paid by the First
Party on the receipt of the bill on prorate basis.
1.3 The payment shall be made in equal instalment on quarterly basis on
receipt of reports as per scope of works and deliverables.
1.4 The cumulative payment made in pursuance of the assignment for
Quality Monitoring of EWS housing Project, to the appointed third Party,
shall be always limited to the proportion, similar to the proportion of
cumulative construction cost actually incurred towards to the tentative
total construction cost.
1.5 Balance payment if any from one quarter shall be carried on to next but
shall be in accordance to 1.4 clause above.
1.6 The total period for completion for the assignment is 36 months per
project.
1.7 Balance 10% of the scrutinized amount of the bill will be paid if the
clarification is acceptable by the First Party whose decision shall be
final & binding on the Agency.
1.8 Bank Guarantee of 10 % of the contract value performance security
deposited by the consultant shall be released after completion of
contract period.
1.9 As per matrix the tentative cost for Category A and B resources will be
as per the finance disclosed in FORM-1. At the time of the payment it
may be treated as benchmark but the payment shall be considered only
after complete compliances for the supervision the project.
2 Final Payment: The final payment as specified in 1.7 above shall be made only
after the final report and a final statement, identified as such, shall have been
submitted by the Consultant and approved as satisfactory by the Parishad. The
Services shall be deemed completed and finally accepted by the Parishad and
the final report and final statement shall be deemed approved by the Parishad
as satisfactory ninety (90) calendar days after receipt of the final report and
final statement by the Parishad unless the Parishad, within such ninety (90)
day period, gives written notice to the Consultant specifying in detail
deficiencies in the Services, the final report or final statement. The Consultant
shall thereupon promptly make any necessary corrections, and there after the
foregoing process shall be repeated. Any amount, which the Parishad has paid
or caused to be paid in accordance with this Clause in excess of the amounts
actually payable in accordance with the provisions of this Contract, shall be
reimbursed by the Consultant to the Parishad within thirty (30) days after
receipt by the Consultant of notice thereof. Any such claim by the Parishad for
reimbursement must be made within twelve (12) calendar months after receipt
by the Parishad of a final report and a final statement approved by the
Parishad in accordance with the above.
3 In case of early termination of the contract, the payment shall be made to the
consultant as mentioned here with:
(i) Assessment should be made about work done from the previous
milestone, for which the payment is made or to be made till the date of
the termination. The consultant shall provide the details of persons
reasonably worked during this period with supporting documents. Based
on such details, the remuneration shall be calculated based on the man
month rate as specified.
(ii) (ii) A reasonable assessment of the reimbursable and miscellaneous
expenses shall be made based on details furnished by the consultant in
this regard with supporting documents and based on the assessment of
the work done and the respective rates as provided. Wherever such an
assessment is difficult, the rates should be arrived at by calculating the
amount on pro-rata basis. The total amount payable shall be the amount
calculated as per (i) and (ii) above plus any applicable tax.
Note -
1. Above payments are inclusive of GST.
2. No price escalation due to any reason (including any change in the applicable
taxes, duties, surcharge etc.) shall be considered by employer during the validity/
extended validity of the contract.

14 INDEMNIFICATION
Consultant shall keep UKAVP totally indemnification and harmless against all claims,
dues, payments, fines, penalties, compensation, liabilities and other losses etc.
Which may incur on account of non-compliance or violation of any statutory
provisions or any direct/indirect loss or damage that is caused due to any deficiency
in services.
15 PERFORMANCE GUARANTEE
Consultant shall have to deposit Performance Guarantee which shall be 10% of the
contract value,
1. The Performance Guarantee shall be in the form of a Bank Guarantee/DD/FDR in
the name of Uppar Awas Ayukt, Uttarakhand Awas Evam Vikas Parishad,
payable at Dehradun.
2. Bank Guarantee of 10 % of the contract value performance security deposited by
the consultant shall be released after completion of contract period.
3. Failure of the Consultant to comply with the requirements shall constitute
sufficient ground for the annulment of the award and forfeiture of the deposited
amount.
