1. Submitted herewith are three (3) sachets of transparent heat-sealed cellophane
containing of white crystalline substance suspected as Shabu, confiscated during buy
bust operation for confirmation and weighing purposes.

One (1) sachet of transparent heat-sealed cellophane containing of white crystalline
substance suspected as shabu marked with BB-GBA with name of the suspect, time,
date, place of commission, name and signature of apprehending officer written on the
attached paper tape Weighing 0.3875 grams. GBR
One (1) small sachet of transparent heat-sealed cellophane containing of white
crystalline substance suspected as shabu marked with P1-GBA with name of the
suspect, time, date, place of commission, name and signature of apprehending officer

b. FACT OF THE CASE:
On or about 9:30 in the evening of January 25, 2022 elements of this station led
by PSI John P Bernales, CAIDSOT officer of this station under the supervision of
PSUPT. JOVEL BATOLAYAN, Chief of Police, with PDEA pre-operation number ROXI
No. 30004-022016-0135 conducted buy bust operation at Prk. 6, Brgy. San Francisco,
Panabo City.
Said operation resulted to the apprehension of one ELRIC LIM DELOS SANTOS,
27 years old, male, with live-in partner, mechanic and resident of Purok Gabi, Barangay
Gredu, Panabo City. Recovered from the suspect during buy bust was one (1) sachet of
transparent heat sealed cellophane containing of white crystalline substance suspected
as shabu marked with BB-GBR, also confiscated were one (1) sachet of transparent
heat sealed cellophane containing of white crystalline substance suspected as shabu
marked with P1-GBR, one (1) sachet of transparent heat sealed cellophane containing
of white crystalline substance suspected as shabu marked with P2-GBR with name of
the suspect, time, date, place of commission, name and signature of apprehending
officer written on the attached paper tape and one (1) php 100 bill with serial no.
FW121414 with initials GBR of PO2 MIKO L DAMON on top of 100 number left side
portion of the bill during body searched. With estimated street value total of PHP9,000
on three recovered items. Suspect now held this station for proper disposition and filing
of the case.

1. Respectfully request for drug test on ELRIC LIM DELOS SANTOS, 27 years old,
male, with live-in partner, mechanic and resident of Purok Gabi, Barangay Gredu,
Panabo City. Who was arrested by PO2 MIKO L DAMON as the subject during buy bust
operatio.
b. FACTS OF THE CASE:
On or about 9:30 in the evening of January 25, 2022 elements of this station led
by PSI Maricar P Bornea, CAIDSOT officer of this station under the supervision of
PSUPT. JOVEL BATOLAYAN, Chief of Police, with PDEA pre-operation number ROXI

JUDICIAL AFFIDAVIT OF ARRESTING OFFICER
PO2 MIKO DAMON
I, PO2 MIKO LABOG DAMON, 32-year-old, married, Filipino, and a resident of
blk. 6 lot 8, Sampaguita St. Northern Plains Subd., Brgy. Gredu, Panabo City and PNP
member assigned at Panabo City Police Station as PNP Mobile# 1, team leader, after
having been sworn in according to law, hereby depose and say that;
PRELIMINARY JUDICIAL STATEMENT
I am answering the questions asked by PO2 MIKO L DAMON, Investigator of
Panabo City Police Station, said statement was conducted in the same police station,
fully conscious and aware that I do so under oath and that I may face criminal liability for
perjury and false testimony:
Q-1 : PO2 Gary Aripuddin, where were you at around 8:30 pm of January 25, 2022?
A-1 : I was at PNP outpost no.1 located at Crossing Gamao, Brgy. San Francisco,
Panabo City rendering my tour of duty of duty as PNP Mobile Patrol no.1 team leader;
Q-2 : Did anything particular happen? If there was any, what was it?
A-2 : Yes, I received a text message from the duty radio operator informing me to
change in civilian attire and proceed at Panabo City Police Station for some instructions as per
advice by Lour Intel Officer PSI Maricar Bornea;
Q-3 : What happened next?
A-3 : I immediately proceeded at the office of Intel section, from there a buy bust
operation was planned. PSI Maricar Bornea, Intel officer conducted a briefing for the arrest of
the reported suspect alias "Dodong" and I was assigned as poseur buyer to the said operation;
Q-4 : What did you do after the briefing?
A-4 : After the briefing and PDEA coordination with pre-operation number 30004-
545986-3053 was given. I together with the confidential agent and other PNP members left the
station at about 9:05 PM and proceeded to Purok 6, Barangay San Francisco, Panabo City as
per revealation by the informant;
Q-5 : What happened when you arrived in the said place?
A-5 : Upon reaching thereat, we arrived first at the place they agreed by the informant.
Not long a male person riding in a single raider motorcycle arrived and disembarked at his
driven motorcycle. They had a short conversation with the confidential agent after which our
agent introduced me as one who wanted to buy the item from him; after which, I ask if he
brought to me a sachet of shabu and He (Elric I identified later) replied, yes! And He showed to
me a sachet of suspected shabu and I received the same. Later, I asked him the price of the
said drugs, he answered P100.00 only. Immediately, I gave him the marked money a P100.00-
peso bill bearing serial No. FW121414 with marked GBR on top of 100 number left side portion;
Q-6 : What happened next?
A-6 : After our transaction, our confidential agent immediately fled away as our pre-
arrange signal and I immediately introduce myself as member of Philippine National Police of
Panabo City Police station and arrest the I explained to him the nature of the arrest and
informed his constitutional rights in a dialect understood by him, and for our SOP I did bodily
search on the suspect while the rest PNP members serves as back-up. There I recovered from
his front right pocket two (2) sachets of transparent heat-sealed cellophane containing of white
crystalline substance suspected as shabu placed inside a paper envelop with markings True
Vision with the marked money;
Q-7 : After the arrest, what did you do next?
A-7 : After the arrest, I immediately called the presence of our Intel officer PSI Bornea
and thereafter, she called Elected Barangay Official Brgy. Captain of Brgy. San Francisco
Condring Theodore Pascual, DOJ representative Ian Patrecio and Media representative Rafael
Montilla to witness the conduct of markings and tagging of the seized items;
Q-8 : What happened next?
A-8 : After the arrival of the witnesses at about 10:15 in the evening of the same date,
we conducted markings and tagging of the seized item in the area accompanied with taking of
pictures by PO3 Joefer Careñosa. I placed mark at the buy bust item as BB-GBR while the two
(2) sachets recovered in his possession as P1-GBR and P2-GBR. After which we immediately
brought the suspect to Panabo City Police Station for proper disposition and documentation and
presented to the duty desk officer the recovered items. There he identifies himself as ELRIC L
DELOS SANTOS, 27 years old, male, with live-in paertner, mechanic, a resident of Prk. Gabi,
Brgy. Gredu, Panabo City;
Q-9 : What happened at the station?
A-9 : That during the preparation of the documents, the seized items was in my custody
secure inside my black sling bag hanged crossed in my body. After documentation, at about
4:50 in the morning of January 27, 2022, we brought the suspect to Provincial Crime Laboratory
Office, Tagum City including the seized items for examination, confirmation and for drug test;

National Police assigned at Panabo City Police station, Panabo City designated as Investigator,
hereby certify/attest that;
I conducted the examination of the apprehending officer PO2 MIKO LABOG DAMON,
and the same was conducted in our office at the Panabo City Police Station on January 25,
2022;
I faithfully recorded or cause to be recorded the question I asked of PO2 MIKO LABOG
DAMON and the corresponding answer he gave;

regarding his answer
