Ref: 1. Hon'ble Supreme Court's Judgment in Civil Appeal Nos. 17869 - 17870/2017, Dated: 3.11.2017. 2.Letter by the Member Secretary - F.No. 13-60/P&AP/SC-Legal/Dist. Edu/2019, Dated:26.04.2019. 3.Letter by the Director of Technical Education, Chennai — No. 16288/H5/2019, Dated: 07.06.2019. Permission is being given by the Board for Employees to undergo higher studies including Degree in Engineering without affecting office works. As per that many employees throughout the State had applied and obtained study permission for studying Bachelor's Degree in Engineering at Vinayaga Missions Research Foundation (VMRF) Salem, JRN, IASE, and AAl Deemed Universities through distance education mode and passed out few years ago. When these passed out individuals applied for Assistant Engineer promotions through internal selection their applications were rejected out rightly at the circle level itself as Board didn’t entertain application from candidates who had completed Degree through distance mode of education, as per the conditions laid therein Praying justice some of the individuals had approached the Hon'ble High Court, where too, their prayer was rejected. Hence the individuals had knocked the doors of Hon'ble Supreme Court for justice in this matter.Continuation Sheet Tamil Nadu Electricity Board Engineers' Sangam The Hon'ble Supreme Court, along with similar cases from various states had given a relief for these individuals vide its judgment cited under reference - 1. The judgment directed the AICTE and UGC to conduct examinations of both theoretical and practical nature for these students who had acquired Degree through distance education mode for validation of their degree obtained. It clearly stated that the students should clear this exam within 2 attempts and for whoever crosses this hurdle the advantages and benefits shall be restored. This applies to all candidates ‘who were admitted during the academic sessions 2001 - 2005. Based on the orders of the Hon'ble Supreme Court, AICTE & UGC conducted exams during June and December ~ 2018. Many candidates who appeared in these exams have passed out and received Validation certificates of their Degree from AICTE and UGC. After that Member Secretary of AICTE had written a letter to all the states regarding these exams conducted as per the direction of the Hon'ble Supreme Court and subsequent validation to be accorded to the individuals in this regard vide reference - 2 cited. This matter has been substantiated further by The Director of Technical Education, Chennai by his letter cited under reference — 3. All the matters narrated above have been carried out as per the orders of the Hon'ble Supreme Court. It is totally legal and the passed out individuals working in the Board and who had obtained proper permission from the Board to undergo this BE Degree studies have now applied for Promotions and Re-Designation which is natural and within the rules. Board ought to consider their case after verifying their records.
