After review of cation for disability retirement,
Social Security Administration Awards
An application for Social Security Disability benefits must be submitted and confirmation must be
provided to the Office of Personnel Management (OPM) before annuity payments can begin. Individual
who have not already done so should apply as soon as possible. Individuals who have applied and sent =
copy of the receipt do not need to take further action,
If an individual is awarded a monthly benefit from Social Security Administration, they are
required to notify the Office of Personnel Management immediately regarding the amount and
effective date of the benefit. This can be done by sending a photocopy of the award notice or statem
showing the monthly benefit amount with the effective date eligibility began. Periodic verification
Social Security Administration records will be conducted to determine unreported awards. Plea:

Interim Payments
The Office of Personne] Management will notify the corresponding agency regarding
disability retirement application. The employing agency will then separate the employee from servic.

FERS disability benefits usually begin before the claim for Social Security benefits is fully processed.
Because the FERS disability benefit must be reduced by 100 pereent of any Social Security benefit
payable for 12 months, Social Security checks should not be negotiated until the FERS benefit has
been reduced. Checks received from Social Security wil be needed to pay OPM for the reduction

After age 62, annuity payments will be recomputed using an amount which represents the annuity which
‘would have been received had the individual continued working until the day before tuning 62 and retiring
FERS cost-of-living increases paid during the time a disability annuity was received. ‘The FERS basic
‘annuity formula (I percent ofthe high-3 average salary multiplied by the total years and months of service
‘multiplied by any part time proration factor) is then applied, using the adjusted time base and average
salary. If actual service time combined with time receiving disability annuitant equals 20 or more years,
1.1 percent would be used rather than | percent. The recompited monthly annuity rate an annuitant receives
‘tage 62 may be lower than the monthly annuity rate received prior to age 62.
US, Dept. of Labor's Office of Workers’ Compensation Program (OWCP) Benefits
Individuals may not receive annuity payments from both OPM and OWCP for the same period of time.
However, an annuitant who is eligible o receive a civil service annuity and an OWCP Non-Scheduled
‘Total or Partial Award for the sume period of time, may elect which benefit they want to receive.
Payments from both OPM and OWCP for the same period of time are authorized only if, (1) OWCP
payments are reeeived for a Scheduled (loss of limb or function) Award, (2) OWCP payments are received
‘due to the death of another person and the annuitant is eligible for receiving an annuity on the basis of
their own Federal service, or (3) in place of receiving an OWCP Non-Scheduled Total or Partial Award,
‘an individual is receiving a Third Party Seitlement from the party directly responsible for their injury. An
individual who is receiving OWCP payments but not for one of the three reasons stated above and are
also receiving payments from OPM, should contact OPM at 1(888) 767-6738, or by writing to

Recovery Situations
For annuitants under the age of 60, a periodic review of current medical documentation may be required
to verify the status of the claimed condition. Recovery is determined if the medical evidence shows the
condition has improved and the essential duties ofthe position of record can be performed, With such a
finding, annuity payments will stop on the first day of the month beginning one year after the date ofthe
‘medical examination showing recovery. Furthermore, the Office of Personnel Management will honot &
written and signed statement of medical recovery voluntarily submitted by an annuitant (provided the

Restoration of Earning Capacity
‘Annuitants under the age of 60 who are working in a non-federal position are limited on the amount they

of record from which the annuitant retired. Disability annuity payments will stop six months from the
‘end of the calendar year in which the earning capacity i restored.
Medicare
‘An annuitant who believes they may qualify for Medicare should contact the Social Security
‘Administration promptly at 1-800-772-1213 to make arrangements for filing an application. A delay in
filing could result in a delay in the date in which Medicare entitlement begins.
Reporting Responsibilities
It is important to notify the Office of Personnel Management of any changes to status such as becoming
re-employed with the Federal Government, changes to marital status, or changes to address. This
information can be reported and questions can be answered at the contact information below. Please
