MEMORANDUM

In view of bye-elections to House of People from 40-Asansol Parliamentary Constituency


and to West Bengal Legislative Assembly from 161-Ballygunge Assembly Constituency to be held
on 12" April, 2022 (Tuesday), vide Notification No.ECI/PN/32/2022 dated 12.03.2022 of the Election
Commission of India, the said day of poll i.e. 12" April, 2022 (Tuesday) is hereby declared as a public holiday
under section 25 of the Negotiable Instruments Act, 1881 for the Government offices, Organizations,
Undertakings, Corporations, Boards, Statutory and Local Bodies, Educational institutions situated within the
extent of 40-Asansol Parliamentary Constituency and 161-Ballygunge Assembly Constituency.

2. For the Educational Institutions / Government offices etc. which will be used as Polling Station /
Sector Office I Distribution-cum-Reception Centre, local holiday may be declared for the said institutions /
establishment by the Competent Authority on the date of dispatch i.e. 11" April, 2022 (Monday).

3. Labour Department will issue suitable instructions to shops, commercial and industrial establishments
requiring them to declare the said date of poll as paid holiday for the workers of the concerned Parliamentary /
Assembly Constituency to enable them to exercise their franchise in the election.

4. In case of an employee working outside his Parliamentary / Assembly Constituency and where the
date of Poll has not been declared as holiday in his place of work, he / she shall be permitted to cast his / her
vote by way of allowing special leave on that date.

5. In case of re-poll, the employees I workers shall be allowed to cast their votes on the date of re-poll
also in the manner as stated in Para - 3) and 4) above.

6. If the poll process continues up to the late hours on 12" April, 2022 (Tuesday) resulting in the late
release of Polling Personnel from Reception Centres rendering it difficult for them to attend office in time on
13" April, 2022 (Wednesday), special leave may be allowed to such employees for that day in consideration
of the situation stated above.
