Supreme Court Nominating Commission Chief Justice Michael L. Bender, Ex Officio Chair 101 West Colfax Avenue, Suite 800 Denver, Co. 80202

Re: Judge Brian Boatright

Dear Chief Justice Bender and Members of the Commission: It is a distinct honor to write in support of Judge Brian Boatrights application for the Supreme Court of Colorado. I have known Brian, both professionally and personally, for over twenty-five years. I can state without hesitation or equivocation that Brian is one of the finest judges and lawyers that I have ever known. Brians legal ability is only exceeded by his exceptional character and integrity. I was Brians supervisor and co-worker for a number of years in the Office of the District Attorney for the First Judicial District. I tried numerous cases with Brian, ranging from sexual assault on a child to murder. I also observed his interaction with victims, defendants, law enforcement, the defense bar and his fellow prosecutors. Brian has a superb sense of justice. As a prosecutor, Brian was adept at recognizing cases that merited leniency while vigorously prosecuting those individuals who pose the greatest threat to the safety of the community. He has outstanding trial skills and a great capacity for understanding, explaining, and applying complex legal issues. Brian was also viewed as a mentor for less-experienced attorneys and embraced the opportunities to use his considerable teaching skills to assist all of the prosecutors of Colorado. I was also privileged to serve as a colleague of Brians as a district court judge in the First Judicial District. Brians sense of justice is unparalleled. Often when difficult decisions needed to be made, my fellow judges and I would seek Brians advice and counsel. He has an extraordinary talent to distill a case to its essence and focus on the most salient points. Brian assiduously adheres to the rule of law and controlling precedent. Brian sets the standards for competence, professionalism and decorum to which all district court judges should aspire.

The past several years, Brian has been the presiding juvenile judge for the First Judicial District. Although Brian excelled as a district court judge with a mixed criminal, civil and domestic docket, he reached new heights as the juvenile judge. Brian was challenged, often on a daily basis, to apply the law and make some of the most important, and difficult, decisions confronting a judge; namely, deciding placement and parental responsibilities for children. Brian would be a tremendous asset for the Supreme Court. His intellectual prowess when combined with his understanding and appreciation of the implications of Supreme Court decisions on trial courts and litigants would contribute significantly to the Courts thoughtful, important opinions. In addition, Brians character, ethics, and compassion embody the qualities expected of a justice of the Colorado Supreme Court. Please accept my strongest endorsement of Judge Brian Boatright. Thank you for your consideration of my thoughts on this very important matter.

Respectfully yours,

Peter A. Weir Senior Chief Deputy District Attorney First Judicial District
