ORDER OF DECLARATION OF DEATH
CAME THIS DAY, Mary Douthat, by and through counsel, upon the
Petitioner’s Petition for Declaration of Death; and upon evidence
presented to the Court, the Court makes the following findings;
1. Christopher Douthat was a resident of Franklin
County, Virginia.
2. Christopher Douthat has one (1) minor child, D.D.,
NAME WITHHELD.
3. Christopher Douthat has not been seen or heard from
since October 25, 2013.
4. Christopher Douthat was reported missing on October
25, 2013.
5. Multiple attempts have been made to locate
Christopher Douthat with no success. These attempts include
searches by canine and foot.
6. Multiple news agencies have ran stories and articles
attempting to locate Christopher Douthat to no avail.7. Notice was published for four (4) successive weeks
in the Franklin News Post, a newspaper of general circulation in
this jurisdiction in accordance with Virginia Code Section 64.2-
2304 for the Petition for Declaration of Death, and no evidence was
presented that Christopher Douthat is alive.
8. Christopher Douthat has not been seen or heard from
for more than ten (10) successive years.
The presumption of death pursuant to Virginia code
Section 64.2-2300 has been established.
Based on these facts and no evidence to the contrary,
ACCORDINGLY, IT Is,
ADJUDGED, ORDERED AND DECREED that Christopher Douthat
is in fact dead; and, IT Is,
ADJUDGED, ORDERED AND DECREED that Christopher Douthat
has one heir at law, his minor child, D.D. (FULL NAME WITHHELD);
and, IT Is,
ADJUDGED, ORDERED AND DECREED that Christopher Douthat
died on October 25, 2013, and, IT Is,
ADJUDGED, ORDERED AND DECREED that this Order shall be
indexed under the following name in the Circuit Court of Franklin
County Land records, namely: Christopher Douthat.
Nothing further remaining to be done at this time, it
is ORDERED this cause is ended. The Clerk of this Court is
directed to furnish a certified copy to counsel of record and tothe State Registrar of Vital Records of the Virginia Department of
Health.
