a. To sell, transfer and assign the Scheduled Property mentioned herein
below, without intervention of any court of law at its own discretion for
adjustment of loan outstanding and to do all acts and sign all documents
and papers in my/our name which may be required to sell, transfer and
assign the Scheduled Property or any part thereof and all proceeds
received under this authority shall be treated as true and valid receipt on
my/our behalf.

b. To seal, sign and execute any documents of sale, transfer and/or


assignment or to do any act on my behalf relating to the aforesaid
transfer of the Scheduled Property or any part thereof and to receive the
proceeds thereof on my/our behalf.

c. To execute the necessary sale deeds, or any other deed(s), present those
for registration and get the same registered and to vest the Scheduled
Property or any part thereof in the transferee, together with all rights of
the owner in, upon, or to the Scheduled Property or any part thereof as
if the same had been sold to the transferee by me/us as the owner(s).

d. To present and/or submit such other deed(s) to the office of the


Registrar, Joint Registrar or Sub-Registrar or any other offices for
registration of the same and to do all other acts required to register such
documents including swearing affidavit on my/our behalf.

e. To appoint, from time to time, any substitute or substitutes and to
delegate to other all or any of the powers/authorities or discretion vested
in the Attorney under or by virtue of these presents (other than the
power of sub delegation) and to remove any such substitute or
substitutes at its pleasure and appoint another or others in his or their
place to do all such other acts, deeds, matters and things as may be
necessary, usual, proper or expedient for the purposes hereof.

f. IN GENERAL to do, execute and perform all such further and other acts,
deeds, matters and things whatsoever which though not specifically
mentioned herein the Attorney shall or may think necessary or proper to
be done in and about or concerning the Scheduled Property, affairs or

effectuating of any of the powers and authorities herein contained.

POWER OF ATTORNEY WITHOUT THE CONSENT OF THE ATTORNEY

on the Ground/Basement Floor, total space (including car parking space,
common space etc.) measuring 1654 (One Thousand Six Hundred Fifty Four)
square feet of a 16 (Sixteenth) storied building, under the name & Style of
Building No. 11-I, Building Name: “Shurma-2” along with undivided and un-
demarcated share of land measuring 0.327597222 katha equivalent to 228.67
square feet equivalent to 00.5240 decimal or 52.40 Ajutangsho, together with
right to the use and enjoyment of adjuncts within the flat and stairs of common
corridor, lift, wall, sewers, general walking road, electricity, water, gas line,
generator, open roof adjunct to the building along with all other common &
connecting facilities attached thereto, situated within District- Dhaka, Police
Station- Turag, Sub-Registry Office- Uttara, Mouza- Baunia, under Uttara
Apartment Project at being layout Block-A, Road:2/C/4, Sector No. 18 of Uttara
Residential Area under layout Plan of Rajdhani Unnayan Kartripakkha
(RAJUK), Dhaka; and Mutation Khatian No. 00, vide Mutation & Separation
Case No. 8837(IX-I)/2022-23 dated 16.04.2023, under Jot No. 99/105, as per
RAJUK Plot; which is butted and bounded by:-

On the North: Corridor of the apartment then flat#605;


On the South: Open Spaces.

7. THE CHRONOLOGICAL CHAIN OF OWNERSHIP OVER THE


RESPECTIVE LAND AS MENTIONED ABOVE NOT LESS THAN 25
YEARS ALREADY MORTGAGED WITH THE ATTORNEY.

It appears from the submitted deeds and documents that the scheduled land
along with other lands was acquired by Rajdhani Unnayan Kartripakkha
(RAJUK) for Uttara Residential Area Project under Uttara Apartment Project.

Thereafter, Rajdhani Unnayan Kartripakkha (RAJUK) constructed a 16


(Sixteenth) storied residential building under the name & Style of Building No.
11-I, Building Name: “Shurma-2”.

Later on, Mr. Md. Abdul Wadud applied to Rajdhani Unnayan Kartripakkha
(RAJUK) for the lease of the scheduled property being 01 (One) Flat/Apartment
being No. 606 (Southern East Side), on the 6th Floor space measuring 1276 (One
Thousand Two Hundred Seventy Six) square feet, along with 01 (One) Car
Parking Space being No. I-31 on the Ground/Basement Floor, total space
(including car parking space, common space etc.) measuring 1654 (One
Thousand Six Hundred Fifty Four) square feet of a 16 (Sixteenth) storied
building, under the name & Style of Building No. 11-I, Building Name:
“Shurma-2” along with undivided and un-demarcated share of land measuring
0.327597222 katha equivalent to 228.67 square feet equivalent to 00.5240
decimal or 52.40 Ajutangsho. Afterwards, Rajdhani Unnayan Kartripakkha
(RAJUK) granted the lease of the scheduled property to Mr. Md. Abdul Wadud
through temporary allotment, vide its Memo No.
RAJUK/Estate/U:A:Pro/04/2012/3479 dated 07.03.2013 and final allotment, vide
its Memo No. 25.39.0000.155.04.2012-(Angsha-2)-295 dated 22.10.2017.

Finally, Rajdhani Unnayan Kartripakkha (RAJUK) represented by its Chairman
Abul Kalam executed Deed of Lease being No. 1129 dated 29.01.2023, registered
with the Uttara Sub-Registry Office of Dhaka, in favour of Mr. Md. Abdul
Wadud, in respect of the scheduled property being 01 (One) Flat/Apartment
being No. 606 (Southern East Side), on the 6th Floor space measuring 1276 (One
Thousand Two Hundred Seventy Six) square feet, along with 01 (One) Car
Parking Space being No. I-31 on the Ground/Basement Floor, total space
(including car parking space, common space etc.) measuring 1654 (One
Thousand Six Hundred Fifty Four) square feet of a 16 (Sixteenth) storied
building, under the name & Style of Building No. 11-I, Building Name:
“Shurma-2” along with undivided and un-demarcated share of land measuring
0.327597222 katha equivalent to 228.67 square feet equivalent to 00.5240
decimal or 52.40 Ajutangsho.

In the abovementioned manner & style, the said Mr. Md. Abdul Wadud has
become the present leasehold owner of the scheduled property being 01 (One)
Flat/Apartment being No. 606 (Southern East Side), on the 6th Floor space
measuring 1276 (One Thousand Two Hundred Seventy Six) square feet, along
with 01 (One) Car Parking Space being No. I-31 on the Ground/Basement Floor,
total space (including car parking space, common space etc.) measuring 1654
(One Thousand Six Hundred Fifty Four) square feet of a 16 (Sixteenth) storied
building, under the name & Style of Building No. 11-I, Building Name:
“Shurma-2” along with undivided and un-demarcated share of land measuring
0.327597222 katha equivalent to 228.67 square feet equivalent to 00.5240
decimal or 52.40 Ajutangsho by way of lease and got duly mutated the land
measuring 0.327597222 katha equivalent to 228.67 square feet equivalent to
00.5240 decimal or 52.40 Ajutangsho in his own name with the Govt. Revenue
Record through Mutation Khatian No. 00, vide Mutation & Separation Case No.

8837(IX-I)/2022-23 dated 16.04.2023, under Jot No. 99/105, as per RAJUK Plot
and accordingly has been paying the ground rent thereof.
8. POWER IMPOSED TO THE ATTORNEY-HOLDER FOR THE
DEVELOPMENT OF THE LAND, UPON CONSTRUCTION OF THE
LAND, THE DESCRIPTION OF THE ENTIRE PROJECT OWNED BY THE
ATTORNEY HOLDER PROPORTIONATELY EMPOWERED BY THE
PRINCIPAL UNDER THE SAID POWER OF ATTORNEY TO SELL THE

as the BORROWER) has availed HPSM Staff House Building for
Tk.50,07,833 (Taka Fifty Lac Seven Thousand Eight Hundred and Thirty
Three) Only; (Hereinafter referred to as the “Investment Facility”) favoring
to the MORTGAGOR-INVESTMENT CLIENT vide its Branch Sanction
Letter No. SBL/GUL/INV/2023/900 dated 04.07.2023 complying with its
Head Office Sanction Letter No. SBL/HO/INV/2023/542/1283 dated
03.07.2023; (hereinafter jointly referred to as the “Sanction Letter”) from the
ATTORNEY.

If the MORTGAGOR-INVESTMENT CLIENT fails to repay the Investment

Property mentioned herein above, without intervention of any court of law
for adjustment of the said Credit Facility availed by the MORTGAGOR-
INVESTMENT CLIENT from the ATTORNEY.

has been correctly described and has not been undervalued and we have a
good and transferable right in such property.

AGAIN I/WE DECLARE ON OATH THAT:


I/We am/are the absolute owner(s) over the immovable property under transfer
referred to here-above and no agreement for sale has been executed with any
third parties, or has not been sold elsewhere or has not been mortgaged or
encumbered otherwise to any third parties on the said Property. This property
is not the government’s khas/vested, or abandoned property or is not incumbent
upon the government in any manner whatsoever. It is also solemnly affirmed
that I/we shall be solely liable for misrepresentation of any information in the
Deed and for that any civil and/or criminal suit can be filed against me/us. If any
wrong, false or misleading information is made in the Deed. I/We shall be
bound to execute and register new Deed at my/our own cost. Mentionable that
