AFFIDAVIT

I, Priyanka D/o Hiralal Damre Age: 33 years, Occu.- Service,


R/o House No. 168, Mhada Colony, Murtijapur, CIDCO,
Aurangabad.431001 for myself and on behalf of petitioners No.2 do
hereby state on oath as under:-

1. I say and submit that, I am residing at above mentioned


address. The petitioner No. 2 she is not able to come to court so I have
given all authority to my real younger Sister to do court office work
so I have full confidence that he will work on my behalf.

2. I say and submits that the petitioner No.1 is a legally wedded


wife, petitioner No.2 is Married Daughter, Petitioners No. 3 to 5 are
daughters of the deceased Hiralal Maryya Damre, who died on
01/02/2022 due to heart attack and old age at Seth Nandlal Dhoot
Hospital Jalna Road Aurangabad.431001.
The copy of death certificate issued by the Aurangabad Municipal
Corporation Office Aurangabad is filed herewith for the kind perusal
of this Hon’ble Court.

3. I say and submits that The deceased's mother Shivkanta


Maryya Damre and his father Maryya Ramanna Damre have passed
away many years ago, so the applicant cannot file the death certificate
of the deceased Hiralal Damre's father and mother in the Hon'ble Civil
Judge Senior division Court today as the applicant does not have any
documents.

4. I say and submits that the petitioners submit that, during the
life time of the deceased Hiralal Maryya Damre, purchased the
House/ Tenement No.15/04. Sector MIG- D, Situated at Gut/Survey
No. 17, of Village Wadgaon (K) Waluj-Mahanagar Tq. And dist.
Aurangabad. The said house was given to the deceased person on the
basis of allotment Letter from the CIDCO Office, According to which
the registered lease deed was given to the deceased Hiralal Maryya
Damre lease deed bearing no. AGG-5/8188/2014 on 19/11/2014.
The copy of lease deed are filed herewith for the kind perusal of this
Hon’ble Court.

5. I say and submits that the petitioners submit that, after


issuance of Allotment Letter and Lease deed, the Waluj- Mahanagar
CIDCO Authority Aurangabad and thereby handed over the peaceful
possession of the said House/Tenement in favour of the deceased and
thus, the deceased Hiralal Maryya Damre became the lawful
possessor and lessee of the said House/Tenement.

6. I say and submits that the petitioners submit that, the


petitioners are the only legal heirs and successors of the deceased
Hiralal Maryya Damre and hence the petitioners are legally entitled
to transfer the said House/ Tenement in the name of petitioners.

7. I say and further submits that after the death of the deceased
Hiralal Maryya Damre , the petitioners had applied in the office of
CIDCO waluj Mahanagar Aurangabad to transfer the said House/
Tenement in the name of the petitioners, lastly on 26/09/2022, the
Administrator, CIDCO Waluj-Mahanagar Aurangabad issued a letter
cum valuation certificate to the petitioner No.1 thereby directed to
obtain the Letter of Administration from the Court of Law, so also the
valuation of the said House/Tenement has been mentioned to the
tune of Rs.1,98,000/- as actual price at the time of Agreement.

8. The petitioners submit that, the present petition is filed for


issuance of Letter of Administration in respect of the House/
Tenement No.15/04. Sector MIG- D, Situated at Gut/Survey No. 17,
of Village Wadgaon (K) Waluj-Mahanagar Tq. And dist. Aurangabad
Which is valued to the tune of Rs. 1,98,000/- as per the Lease deed,
which is leasehold property and hence the fixed and proper court fees
will be paid later on as per the order of this Hon’ble Court.
Hence this affidavit.
