Sub: Permission for access of fuel stations(Retail outlet) along east west corridor on right hand side (RHS) boundary of NH-37 (0)/27 (N) towards increasing chainage at km 233.747 at village-Duruladubi, Mouza-Uttarkhula, District-Morigaon,Assam. (I) Ref: PIU -Guwahati letter no:NHAl/PIU/GHY/PETROLPUMP/(Vol-V)/2022/335/22480 dated 20.05.2022. sir, 2. Based on the certification of the Territory Manager (Retail), M/s BPCL & Project Director, PIU-Guwahati, NHAI and after submission of necessary fees by the M/s Bharat Petroleum Co. Ltd., the proposal fulfils the conditions/norms of Ministry’s circular no. RW-NH- 33032/01/2017-S&R(R) dated 26.06.2020, therefore the “In-principle” approval is hereby accorded with the following conditions: (i) Oil company/owner shall be responsible for the construction and maintenance of declaration/acceleration lanes, drainage arrangement, drinking water and toilet facilities, signs and markings in accordance with the approved layout specifications conforming to these norms, at his own cost. (ii) The drinking water and toilet facilities shall be accessible to the public round the clock. In order to inform the public about these, a display board showing availability of such facilities shall be installed before the entry to the Fuel Station. (iii) It is to be ensured that slab culvert with iron granting of adequate strength is considered in the approach so that surface water from the fuel station/facility does not flow on the highway and led away to a natural course/outfall sewer through culvert or led away to a water-recharging system specifically constructed by the owner/management of the fuel station/facility in case lined drains of sufficient length up to a natural course/outfall sewer are not available. This may also be incorporated in the as-built drawing. (v) As per para 5(vii) of policy circular dated 26.06.2020, the pavement of the access road including acceleration, deceleration and connecting approached would have sufficient design strength for the expected traffic. Interlocking Concrete Blocks shall be as per IRC-SP- 63 i.e. minimum composition: - 250 mm Granular sub-base, 250 mm WBM/WNM Base, 30 mm sand bed and 80-100 mm Block thickness. * (vi) The access roads shall be constructed within the available ROW of the National Highways. However, in case of non availability of adequate ROW for construction of these facilities, the owner of the fuel station shall acquire the required additional land at their cost for construction of such facilities. (vii) Access permission allowed to owner of fuel stations may in some cases lead to substantial vehicular/pedestrian traffic movements on the highway/access so constructed/allowed. In such cases there may arise a need to construct a cross-over facility such as underpass/overpass/FOB/service lane etc. for ensuring road safety. The cost of such cross-over facility etc shall be borne by the owner/management of the fuel station. (viii)On completion of the construction accordance with checklist and conforming to the approvals, a Completion Certificate would be issued by the field unit of NHAI for getting approval of Highway Administration. (ix) The owner of the retail outlet should not be permitted to open the retail outlet before final approval and signing of the license deed. (x) In accordance with the Ministry’s circular, the proposal site may be video-graphed before and after completion of construction work. (xi) The Oil Company will remove /shift the trees and utilities, if existing, at its own cost on the proposed site & access road after the prior approval of Competent Authority as per prevailing rules & norms. (xii) The oil Company/Owner may construct the fuel Station along with the access as per ‘approved drawings at their own cost within 6 months of the issue of Provisional NOC. After the construction as per approved drawings and to the satisfaction of the Highway ‘Administration, the final approval may be given within 30days of the receipt of communication from the applicant about the completion of construction work and License Deed may be signed by the Competent Authority (i.e. Highway Administration). In case, the construction is not done in one. year, the provisional approval shall be deemed to be cancelled, unless renewed by Highway Administration, (xiii)In case the sitting of proposed Retail Outlet is not found in accordance with Ministry’s Circular No. dated 26.06.2020, then the NHAl shall not be responsible for any claimed/damage/loss to the Oil Company or any person. (xiv) The Project director shall be responsible for the concerned NH section to carryout inspections for determining the deviations from the prescribed norms or approved ‘aot : ee o plan any time, even after signing of license deed and in case of defaults/deviations found during inspections, each deficiency shall be immediately rectified, which in no case should exceed 60 days from the date of inspection/date of notifying such defects by the inspecting Authority. The failure to rectify the identified deficiencies within the prescribed time would lead to de-energizing the fuel station by the concerned Oil Company. The re-energizing would be done only on complete rectification and on the authorization by Highway ‘Administration. (xv) The authorised signatory of the concerned oil company shall ensure that there should not be any water logging on the highway due to this construction. The gradient of the approach road at the entry and exit and the plot should be as per the submitted drawing and submitted undertaking. In this regard, an as built layout and drainage plan may be submitted along with completion certificate.
