LEGAL NOTICE
To,

Sir,
On behalf of my client Mrs Madhu Aggarwal and Mrs
Payal Saraf Aggarwal owner of Amit Hights, opp. Don Bosco school,
Paruwa, P.O & P.S: TEZPUR, DIST: SONITPUR, ASSAM, on her
instructions, I serve you a notice with the followings :-
1. That, my clients are the SOLE PROPRIETOR and owner of Amit
Hights, Opp Don Bosco High School, Paruwa , P.O and P.S: Tezpur,
DIST: Sonitpur, Assam.
2. That, in accordance with the “Lease Deed” executed on 22-09-21, it
was mandatory for the lesses i.e. you to pay the monthly rent of Rs.
33,000/-(Rs Thirty three thousand ) only by 7 th day of every month
but you have defaulted in making the rent/payment as agreed.
3. That, in violation to the said lease deed you have an outstanding
amount of Rs. 1,65,000/- ( one lakh sixtyfive thousand) only as
monthly rent till today i.e 7 th November. Whereas you are continuing
to occupy the said property inspite of being defaulter.
4. That, the amount of rent was to be increased by 5% annually as
mentioned in the lease deed. But, you failed to pay the increased
rent amount despite of repeated lawful reminders by my clients Mrs
Madhu Aggarwal and Mrs Payal Saraf Aggarwal.
5. That, as clearly mentioned in the lease deed, you were expected not
to use the leased premises for any illegal, unlawful use which may in
any manner cause damage to the building or cause nuisance.
Whereas, you unlawfully/without consent of the owner i.e. my
clients parked your four wheeler within the leased premises for a
longer period causing inconvenience to my clients and their men.
Similarly, improper installation and improper handling of heavy gym
equipments causing damage to the building. Moreover, you
intimidated, misbehaved and try to damage my client’s property
(CCTV Camera) when they lawfully objected for such illegal act of
yours.
6. That the said acts of yours is not in accordance with the terms and
conditions of the Lease Deed.
7. That in the backdrop of the above, my clients asks you to vacate the
Lease Premises and also to pay the outstanding dues along with 5%
annual increment w.e.f. 22.09.22, within 15 (fifteen) days from the
date of receipt of this notice, else my client will be compelled to
institute legal action against you.
