This subsection (2)(6) does not apply ifthe person isn the presence of a parent or guardian or has consumed or is consuming liquor under {rcurnstances described in subsection (4), (5), o (7) ofthis section. (3) Subsections (1) and (2X) ofthis section do nat apply to liquor given or permitted tobe given to a person under the age of twenty-one years by a Parent or quardian and consumed in the presence ofthe parent or guardian. Chue, Ofc. Steinbach, Ofc. T. Thomas, Ofc. E. Thomas, and \nvestigative Aide (1A) PKK111605 DOB 11/16/2005. We conducted ali delivery compliance checks at the Radisson Hotel Gateway Seattle Tacoma Airport hotel, located at 181 18 Pacific Highway S, SeaTac, WA, ‘98188. During this operation, we communicated using our agency-issued cellphones via text message. Lt. Chue placed an online order for a 375m! bottle of El Jimador tequila (40% aleohol/volume) from Burien Liquor & Wine (Lic#409641), located at 15858 1% AVE S STE A 101, Burien WA, 98148, using agency-issued funds, and I observed the following violation (RCW 66.44,270(1)) furnishing liquor to minors, The WSLCB uses investigative aides to conduct liquor delivery compliance checks. The purpose for liquor delivery compliance checks is to ensure that retalers are compliant with the Washington State Liquor and Cannabis Board laws and regulations. Investigative aides use their own drivers license or identification card. ‘The aides are accompanied and monitored by a WSLCB Officer during the time they attempt to purchase liquor. The IA's identification (ID) card used for this liquor delivery compliance check was vertically formatted, expires on 11/16/2028 and states “Age 18 on 11/16/2023" highlighted in red bold font. The IA was 18 years old (on this date, We received notification that the delivery driver would arrive at approximately 1905 hours. Officer E. Thomas, the IA, and | loft the room a few minutes eartier and headed to the main lobby. The IA sat by himself while Officer E. Thomas and | positioned ourselves approximately 10 feet away from the IA. At approximately 1907 hours, the driver, later identified as Somaya A. NASHEED (DOB 06/01/1995) entered the lobby. | observed NASHEED contact the IA. NASHEED asked the I for ID. The IA handed his ID to NASHEED. NASHEED. examined the ID for a brief moment. | was able to hear NASHEED ask the IA if he was underage. NASHEED continued to examine the ID for a few seconds. NASHEED handed a black plastic bag to the IA. NASHEED left the building and was contacted by Ofc. T. Thomas and Ofe. Steinbach. At approximately 1910, Ofc. E. Thomas, the IA and I were back a the hotel room, The black plastic bag contained a 375ml bottle of El Jimador tequila. The bag did not display any warnings regarding alcohol content, ‘At approximately 1913 hours, | photographed the 375ml bottle of El Jimador tequila, and destroyed it by ,ouring its contents down the drain at the hotel roam in the presence of Officer E.
