RE : NOTICE OF CHARGE
Discourtesy in the Course of Official Duities/
Simple Misconduct

Acting on the Preliminary Investigation Report by the Municipal Administrative Investigation


Committee (MAIC), and upon evaluation of the undersigned on the available evidence on records , the
undersigned concurs with the MAIC’s finding that a prima facie case is established against you for Simple
Discourtesy in the Course of Official Duties/Simple Misconduct punishable by suspension of one (1)
month and one(1) day to six ()6) months for the first offense under the 2017 Revised Rules on
Administrative Cases in the Civil Service (RRACCS).

You are hereby , directed to file your answer to the aforesaid charge within three (3) days but
not later than 10 days from the receipt thereof. Please be guided that under the rules, failure to file your
answer within the prescribed period shall be deemed to have waived your right to submit the same and
the case may be decided based on available records. Further, indicate in your answer whether or not
you elect a formal investigation and to be assisted by counsel of your own choice.

Attached are the following pertinent documents relevant to the herein Notice of Charge in order for you
to properly prepare your responsive pleading , to wit:

1. Complaint affidavit of the complainant ;


2. Attachments to complaint affidavit;
3. Affidavits of complainant’s witnesses;
4. Letter to explain;
5. Answer to letter to explain;
6. Counter-affidavit of the respondent;
7. Attachments to counter-affidavit;
8. Affidavits of respondent’s witnesses;
