1. ‘Z’ Ltd set up an unauthorized electric fence around his form to protect his crops from wild animals. An elephant came into contact with the fence and
died. Examine ‘Z’s liability.
2. A famous municipal corporation failed to provide effective drainage system in some areas of its jurisdiction, as a result of which waste water
accumulated on the streets and provided place for mosquito breeding, suggest approximate constitutional remedy to solve this problem.
3. Mr.Prakash had a baking oven with defective chimney which was emitting smoke and fume causing health hazard to the neighbourhood. One Ms.
Pooja by application u/s 133 of Cr.P.C pleaded for demolition f chimney and permanent ban on his business. Will Ms. Pooja succeed?
4. A person has built a brick grinding machine in front of the consulting chamber of a doctor. The machine is

injury to the surrounding residents, wild life stock and caused health injury to the surrounding residents, wildlife stock and caused damage to the
agricultural crops and other vegetation. Find out the constitutional provisions under which aggrieved residents can seek appropriate remedy.
14. ‘A’ multinational fertilizer company has a fertilizer manufacturing unit which stored poisonous gases. One day due to an unknown accident, the
poisonous gas leaks causing the death and injury of many people. Discuss the liability of the company.

public interest litigation against Span Motels. Advise.
23. Dharwad Sugar factory used to store molasses, a by-product in manufacturing sugar, in a mud tank located close to Mr.John’s land. Due to burrowing
activity of rodents the said tank containing 8000 tons of molasses collapsed and emptied-themselves on Mr.John’s land damaging standing crop of
paddy and sugarcane. Mr.John claims compensation by filing a petition before competent court. Will he succeed? Give reasons.
24. Karnataka Government leased a piece of land on the bank of river Bhadra, to build a resort, which happens to be protected forest. The resort
proprietor to save his leased property from water current, constructed a concrete wall along river bank, which made the river flow to swing to the
other bank of the river washing away substantial part of the land where horticultural crops grown. Now farmers filed a PIL questioning the validity of
lease granted in favour of hotelier. What shall be the ground for petition?
25. A rubber industry was situated in the industrial estate and was given licence under panchayaths and department of industry. The industry using carbon
black in huge quantities, polluted the atmosphere and failed to apply the preventive measures resulted in discomforts, injury and nuisance to the
resident of the locality. Suggest remedies available under tort law.
