stations of Izatnagar Division.

The Competent Authority has accepted your offered rates in

connection with the subject work. The total cost of the work at the
accepted rates works out to Rs. 1192252 (Rupees Eleven Lakh Ninety-
Two Thousand Two Hundred And Fifty-Two Rupees Only)

A sum of Rs.28000 deposited as Earnest Money vide IREPS

reference ID PE697222818585 has been retained towards initial
Security Money for due and faithful fulfillment of the contract, and the
balance Security Money will be recovered from the progressive bills @
6 % of the bill amount till it reaches 5 % of the contract value in terms
of clause 16(1) of General Conditions of Contract, April 2022..

You are requested to submit Performance Guarantee in the form as

given in Clause 16 (4) of General Conditions of Contract, April 2022.
equivalent to 5 % of the contract value amounting to Rs. 59612.6
(Rupees Fifty-Nine Thousand Six Hundred And Twelve Rupees And
Sixty Paise Only) within 21 days from the date of issue of Letter of
Acceptance, valid up to stipulated date of completion plus 60 days so
that contract agreement can be executed. Extension of time for
submission of PG beyond 21 (Twenty one) days and upto 60 days from
the date of issue of LOA may be given by the Authority who is
competent to sign the contract agreement. However, a penal interest of
12% per annum shall be charged for the delay beyond 21(Twenty one)
days, i.e. from 22nd day after the date of issue of LOA. Further, if the
60th day happens to be a declared holiday in the concerned office of
the Railway, submission of PG can be accepted on the next working
day. In all other cases, if the Contractor fails to submit the requisite PG
even after 60 days from the date of issue of LOA, the contract is liable
to be terminated. In case contract is terminated railway shall be entitled
to forfeit Earnest Money Deposit and other dues payable against that
contract. In case a tenderer has not submitted Earnest Money Deposit
on the strength of their registration as a Startup recognized by
Department of Industrial Policy and Promotion (DIPP) under Ministry
of Commerce and Industry, DIPP shall be informed to this effect. The
failed Contractor shall be debarred from participating in re-tender for
that work. Performance Bank Guarantee should be pledged in favour
of F.A & C.A.O. North Eastern Railway, Gorakhpur.

The entire work shall be completed within 4 month from the date
of issue of Letter of Acceptance. Work shall be governed by the
General Conditions of Contract, April 2022 with latest version &
correction slip.

Commencement of work :: The contractor shall commence the work

within 7 days after the receipt of Letter of acceptance.

Income Tax: Deduction of income tax shall be done as per prevailing

rule.

Stamp Duty: You are here by requested to submit non judicial stamp
paper of value Rs.70 per thousand of security money as per the above
and Rs.125 per thousand of the remaining security money of the
amount recovered on account bill. It is entire responsibility of the
contractor the ensure genuineness of stamp paper to be purchased from
the state government treasury. There is another option that, you
produce the non judicial stamp paper of Rs.100.00 and an affidavit
regarding payment of Balance stamp paper after the decision of
petition in favour of Railways.

Legal Binding: Until formal contract agreement is prepared &

executed, this letter shall constitute legal binding on both parties.

Registration: You are also advised to register your letter of acceptance

on Railways Shramikkalyan portal
(www.shramikkalyan.indianrailways.gov.in) immediately. During
execution of contract you have to fulfil the provisions of General
Condition of Contract for works mandatorily.

Declaration: On production of On Account bill/final bill, contractor

shall submit a certificate that (I have uploaded the correct details of
contract labours engaged in connection with his contract and payment
made to them during the wage period in Railway's Shramikkalyan
portal at www.shramikkalyan.indianrailways.gov.in. till .... month,
year)

Payment: On account payments will be made as per Para 46 of General

Conditions of Contract, April 2022

Variation: Do not do any work beyond the sanctioned cost of the work
without written order of the competent authority. Railway
administration shall not be responsible for the work done without
proper order.

Document: If any document of tenderer is found wrong, false/forge in

future, then appropriate action will be taken against the successful
tenderer.

Compliance: Since this work is involve a significant labour

component, therefore the provision of minimum wages act must be
complied strictly.

Execution of work: Please contact the Sr. Section

Engineer/Elect/west/Izzatnagar for further instruction and
commencement for this work.
 Inspection of material:: All APFC Panel shall be inspected by the
RITES as per specification at the manufacture premises and inspection
cost shall be borne by the contractor.

Site Engineer: ADEE/Coaching/IZN is nominated as Site Engineer for

this work.

All Other terms and conditions, as stipulated in the tender

documents shall be applicable.
