In the matter of :-

Tufail Khan versus Sita Devi

COMPLAINT U/S 138 OF NI ACT.

APPLICATION U/S 315 CR.P.C

MOST RESPECTFULLY SHOWETH:-

1 That the above noted complaint/case is pending before this

Hon’ble Court and is fixed for today.

2 The case is at the defense side evidence stage. The

applicant/accused intends to examine some witnesses on her

side to rebut the evidence of the prosecution to arrive just

decision of the case.

3 The applicant/accused submits that as a defense witness she

intends to examine herself before this Hon’ble Court.

4 The applicant/accused submits that in the interest of justice

and to arrive just decision of the case it is essential for him to

depose oral & document evidence before this Hon’ble Court.


5 The applicant/accused further submits that if the petition is

allowed no prejudice would be caused the

respondent/complainant. Whereas if the application is not

allowed great prejudice would be caused to the applicant.

6 That the applicant/accused is a poor widow lady which is being

falsely implicated in the present matter.

7 That in case, If the present application is not allowed, it will

cause great injustice to her which cannot be compensated in

any manner.

Prayer

In view of the above, it is therefore prayed that this Hon’ble

Court may be pleased to permit the applicant/accused to

adduce oral and document evidence on the defense side in the

interest of justice.

Any other/further order which deem fit and proper may also

be passed in favour of the applicant.
