SUBJECT: AMENDMENTS TO SECTION II.A.3, SECTION II.A.4 AND SECTION
         II.C. OF MEMORANDUM CIRCULAR +2-92, "AMENDMENTS TO THE
         1974 SAFETY OF LIFD AT SEA CONVENTION (MC 2_2_52)
         CONCERNING RADIOCOMMUNICATIONS FOR THE GLOBAL
         MARITIME DISTRESS AND SAFETY SYSTEM"
Ptu'srrant to Act No. 3846, as amended, the provisions of chapter IV of the 1974 Safety of Life at
Sea Convention, as amended- concerning radio communications for the Global Maritime Distress
and Safety System, and in view of the Memorandum of Agreement between the Maritime Industry
Authority (MARINA) and the National relecommunications commission (NTC) dated 05 April
2019, Section II.A.3, Section II.A.4 and section II.c of Memorandum circular 4-2-92 are herebv
amended, as follows:
Section   II.   Issuance of Cargo Ship Safetv Radio Certificate
                A.   General Procedures
                     3.   The NTC, through its dury authorized representatives, shall conduct inspection
                          ofthe radio installation of a cargo vessel located in a philippine port for the
                          purpose of issuing a Cargo Ship Safety Radio Certificate. noi thilippine
                          registered vessels located in a foreign port, the NTC may authorize a MARiNA
                          accredited Recognized organization (classification Society) to carry out the
                          l9$to.y certification particularly on Cargo Ship Safef Radio Certificate of
                          Philippine registered vessels, on behalfofthe NTC.
                     4.    Issuance of certificate      of   Accreditation   to   Recognized organizations
                          (Classifi cation Societies)
                          4.1 rhe NTC shall no ronger issue the certificate of Accreditation to
                               Recognized Organizations (Classification Societies) and henceforth
                               acknowledge the Recognized Organizations dr y accredited bv the
                              MARINA pursuant to their authority to confer accreditation to
                                Recognized Organizations;
                          4.2 The NTC shall obtain fiom MARINA on a regurar basis the updated rist
                               of thei accredited Recognized Organizations;
                          4-3   The NTC in coordination with MARINA, shall singly or jointly conduct
                                assessment and./or audit ofRecognized organizations in order to nonitor
                                conrpliance with the provisions of the Recognized Organization Code
                                and MARINA Circular No. 20lg_01, including its                  subsequent
                                amendments, as may be deemed necessary.

Section   II.   Issuance of Careo Ship Safetv Radio Certificate
                   Issued Certificate by a Classification Society
                       A Certifrcate issued by any MARINA Recognized Organization/Classification
                       Society shall have the same force and receive the same recognition as a certificate
                       issued by the NTC.
This Circular shall take effect fifteen (15)                     publication in a newspaper of general
circulation and upon filing with the UP                       tlree (3) true copies ofthe Circular.
