JUDICIAL AFFIDAVIT

I, MARICAR D. CRUZ , 40 years of age, married and a resident of

Barangay Labangon, Cebu City, Philippines, after having been duly sworn to in
accordance with law, hereby depose and say:

1. That I am testifying as a private complainant in the above-entitled case;

2. That this Judicial affidavit is taken upon examination of ATTY. MARIA

ERICSANDA L. PENETRANTE at his law office at Catalyst Legal Solutions,
Second Floor, Legacy Justice Bldg., Ramos Avenue, Cebu City, Philippines, where
my statements were taken;

3. That I am answering the questions asked of me, fully conscious that I am

doing this under oath and that I may face criminal liability for false testimony or
perjury if I state a falsehood in my testimony. The whole process has been done in
Visayan which language is understood by me, and translated into English and
explained to me;

4. That the following are the questions asked of me and my corresponding

A3: I was in Plaza independencia together with my husband but during that
time I was following him.]

asa baligyaanan sa pagkaon,ge sundan nako siya kay nakalimot ko og sulti niya sa

[Q4: Where exactly was your husband going when you followed him?
A4: He went to the other side of the park in plaza independencia where the
food stall was, I followed him since I forgot to tell him what food I wanted
him to buy for me.]

Pangutana 5: Unsay sunod nahitabo?

Tubag 5: Sa ngitngit nga dapit sa plaza independencia kung asa hinay ang suga
naay lalaki nga ni kalit og gawas likod sa tanom og ni duol kini sa akoang bana og
gepusil kini sa likod.
[Q5: What happened next?
A5: I was shocked that in a dark area of plaza independencia where the light
was dim a man suddenly went out behind the tree and approached my
husband and shot him at the back.]

man kaha didto dapita?

[Q6: How sure are you that your husband was being shot at the back?,
A6: Because there was a little light in that area and I was following my
husband, so I saw exactly where he was shot and how many shot he got.]

[Q7: How many times did your husband get shot and how did you know
how many times he got shot?
A7: Five times, because I heard it since I was near the incident.]

A9: I didn't, since the accused wore a black jacket and black mask.]
