The undersigned accuses MANUELITO ALTONAGA y VILLANUEVA
alias “LITO MANIAC” of the crime of Attempted Homicide, committed as
follows:
That on or about July 1, 2006, in the City of Manila, Philippines,
the said accused, armed with a .38 caliber revolver snub nose/paltik,
with intent to kill, did then and there willfully, unlawfully and feloniously
commence the commission of the crime of homicide directly by overt
acts, to wit: by shooting one ROMY DIZON y GORRES, but said
accused did not, however, perform all the acts of execution which should
have produced the crime of homicide as a consequence by reason of
some cause or accident other than his own spontaneous desistance, that
is, the said gun malfunctioned and misfired.

The undersigned accuses VINCENT RAMOS, KENNETH TAN and
JALEN RADAM of the crime of Attempted Homicide, committed as follows:
That on or about December 4, 2010, in the City of Manila, Philippines,
the said accused, conspiring and confederating with others whose true names,
real identities and present whereabouts are still unknown and helping one
another, with intent to kill, did then and there willfully, unlawfully and
feloniously commence the commission of the crime of homicide directly by overt
acts, to wit: by boxing ROMMEL BALAO y MANGASAR on the face, mauling
him and hitting him with a piece of wood, but said accused did not, however,
perform all the acts of execution which should have produced the crime of
homicide as a consequence by reason of some cause or accident other than
their spontaneous desistance, that is, the injuries sustained by the said
ROMMEL BALAO y MANGASAR were not necessary mortal.
