Prayer

In view of the facts and circumstances stated above, the Applicant


most respectfully prays that this Hon’ble Court may be pleased to:

A) Recall/set aside/cancel the proclamation issued under Section 82 of


the Criminal Procedure Code, 1973, against the Applicant in connection
with the case registered under Sections 323 and 506 of the Indian Penal
Code, 1860, vide FIR No. 183/2019, U/s 323/341/506/34 IPC, PS:
Patparganj Industrial Area, pending before this Hon’ble Court, on the
ground that no summons, notice, or warrants were duly served upon the
Applicant prior to the issuance of the said proclamation, rendering it
illegal, arbitrary, and violative of the principles of natural justice;

B) Pass any other order or orders as this Hon’ble Court may deem fit and
proper in the interest of justice.

I, Arbind Kumar Dvivedi S/O Madan Mohan Dvivedi, R/O D-37, Gazipur
Village, Vasundhara Enclave, Preet Vihar, East Delhi-110096, presently
residing at B-15, Highway Apartments, Gazipur Village, Delhi-110096, do
hereby solemnly affirm and declare as under: -

1. That, I, the deponent, am the applicant/accused in the above-captioned


application and as such aware of the facts and circumstances of the case,
and hence competent to swear this affidavit.

2. That, the contents of the accompanying application seeking Recall/set


aside/cancel the proclamation issued under Section 82 of the Criminal
Procedure Code, 1973, against the Applicant in connection with the case
registered under Sections 323 and 506 of the Indian Penal Code, 1860,
vide FIR No. 183/2019, U/s 323/341/506/34 IPC, PS: Patparganj
Industrial Area, have been filed by my counsel under my instructions and
the same have been read over and explained to me in vernacular and I
have understood the same.
3. That, the contents of the accompanying application may kindly be read as
part and parcel of this application as the same have not been repeated
herein for the sake of brevity.
