PREAMBLE

Recognizing that it is no longer sufficient to dream good dreams about a great


Nigeria without taking concrete steps to stimulate action towards moving the nation
forward:

Conscious of the need to actively promote attitudinal reorientation towards the


preservation of the unity of this nation and the restoration of self-esteem, patriotism
and a sense of national purpose among the people of Nigeria;

Committed to the process of institutionalizing a democratic culture that guarantees


the rule of law, good governance, public accountability and the legitimacy of
dissent as a pre-requisite for national development;

Realizing the need to confront internal and external security challenges by pursuing
policies that address issues of Deprivation, Unemployment and Social frustration of
the people of Nigeria; and

Resolved to maintain, protect and preserve the unity, indivisibility and dissolubility
of Nigeria as well as to evolve a civic culture that believes in the dignity of the
human person and the defence of individual rights; a civic culture that promotes
trust, tolerance, equity, social justice, peace and service.

WE, MEMBERS OF THE PEOPLES DEMOCRATIC MOVEMENT


(PDM) do hereby adopt this Constitution for the effective management and
organization of the Party throughout the Federal Republic of Nigeria.
ARTICLE 1: SUPREMACY OF THE CONSTITUTION
1. The provisions of this Constitution shall take precedence over any other Rules
and Regulations of the Party
2. This Constitution shall be binding on all members on all matters relating to the
Party.
3. The distribution of the offices of the Party and the nominations of members of
the Party to elective and appointive posts shall reflect the Federal Character of
the federation.

ARTICLE 2: NAME
The name of this Political Party shall be Peoples Democratic Movement (PDM),
hereinafter referred to as “The Party”.

ARTICLE 3: MOTTO
The motto of the party shall be from darkness to light

ARTICLE 4: SLOGAN
The slogan of the party shall be PDM-from darkness to light.

ARTICLE 5: THE SYMBOLIEMBLEM


The symbol of the party shall be a light-emitting torch light against a National green
background with PDM written in white underneath the torch light.

ARTICLE 6: AIMS AND OBJECTIVES


The central aim of the Party is to promote unity social justice and good governance
among all peoples of Nigeria as well as consensus on fundamental national issues
with a view to preserving the unity of the nation and the restoration of self- esteem,
patriotism and a sense of national purpose among the peoples of the country.

This is premised on the belief that it is people that constitute the wealth of the
nation and that it is through the application of the creative talents and labour of the
citizens under a government founded on Peoples genuine mandate that our abundant
natural resources can be harnessed to build a modern nation in which all citizens
will have the opportunity to lead useful and happy lives.

The objectives of PDM shall be:


6.1 to mobilize all the people of Nigeria towards the attainment of a sustainable
democratic culture based on equality, freedom, individual liberty and social
justice;
6.2 to secure, through democratic means, political power in order to enthrone good
governance, promote justice, unity, peace and progress of all Nigerians;

6.3 to harness our national resources mobilize the labour power and promote the
creative talents of all Nigerians towards building a modern and productive
economy;

6.4 to promote a new socio-political order which will punish corruption and
nepotism as well as compel the leadership to balance power and authority with
service and accountability;

6.5 to promote national integration of our diverse peoples and communities and
work towards the total elimination of any discrimination on the grounds of
place of origin, sex, religion, status, ethnic or linguistic ties and associations;

6.6 to ensure that the policies and programs of the Party are in conformity with the
provisions of the Constitution of the Federal Republic of Nigeria, particularly
with respect to the Fundamental Objectives and Directive Principles of State
Policy;

6.7 to strive towards the provision of the welfare of all Nigerians through the
provision of affordable healthcare and education, employment and eradication
of all forms of poverty;

6.8 to promote, sustain and defend the sovereignty and corporate existence of
Nigeria as one indivisible and indissoluble Nation;

6.9 to protect and defend the rights of Nigerian citizens anywhere and everywhere
in accordance with the provisions of the Constitution of the Federal Republic
of Nigeria and international law and conventions;

6.10 to promote public accountability, good governance, uphold the rule of law and
the legitimacy of dissent;

6.11 to develop the Nigerian Youth and strive towards the restoration of self —
esteem, patriotism and a sense of national purpose among the peoples of
Nigeria;
6.12 to work for equal opportunity for women to participate in every aspect of
national life and to promote the rapid empowerment of the Nigerian woman as
well as ensure political, social, bureaucratic and economic equity in Nigeria;

6.13 to maintain the security of the Nigerian Nation, and promote mutual
understanding of the religions, cultures, traditions and heritage of the various
communities in Nigeria;
6.14 to develop and maintain a highly professional, equipped and people-friendly
Armed Forces, Police and other Security Agencies capable of maintaining law
and order in all parts of the country and commanding the respect of citizens
and the international community;

6.15 to eradicate illiteracy and strive towards the provision of free and high quality
education at all levels and improve health services for Nigerians;

6.16 to foster and defend the freedom of the press and protect the liberty of all
citizens of Nigeria;

6.17 to promote peace and understanding in the world at large and to pursue a
dynamic foreign policy, anchored on Nigeria’s national interest;

6.18 to promote and support the advance of science, technology and creativity and
enhance productivity in the commercial, industrial, agriculture and
technological fields;

6.19 to develop and implement policies and programmes that will ensure the
preservation of the environmental integrity and ascertain the regeneration of
our natural resources;

6.20 to undertake other activities which in the opinion of the Party are ancillary,
incidental of conductive to the attainment of the afore-mentioned aims, values
and objectives.

ARTICLE 7: MEMBERSHIP
7.1 Membership of the Party is open to all Nigerian Citizens provided that such
citizen:
a. shall not have been disqualified by the Constitution of the Federal Republic
of Nigeria and any other electoral law in force;
b. is not below eighteen (18) years of age;
c. does not hold the membership of any other Political Party;
d. accepts to be bound by this Constitution and any other rules and regulations
derived therefrom;
e. Fulfills their membership obligations as contained in this Constitution.

7.2 to be a member, a person has to register and obtain a Membership Card at the
branch of the Party in a Ward at the Local Government Area where he
ordinarily resides

ARTICLE 8: MODE OF REGISTRATION FOR MEMBERSHIP


8.1 Membership of the Party is open to all citizens of Nigeria as contained in
Article 7.1;

8.2 the Ward Executive, Local or State Chairman or Secretary of any other
authorized person/body on behalf of the National Secretariat shall satisfy
themselves with the facts supplied by each applicant, before admitting him of
her;

8.3 No person shall be deprived of membership on grounds of Sex, Ethnic


background, Religious persuasion, belief, or affiliation;

8.4 a member shall be provided with a copy of the Party’s Constitution on


admission on a fee to be determined by the National Executive Committee;

8.5 The Ward Executive shall keep and maintain a register of members. Such
register shall, on request, be at the disposal of any registered member, and
made available for inspection by the National Executive Committee or any
other Committee assigned for that purpose.

ARTICLE 9: RIGHTS AND OBLIGATIONS OF MEMBERS


9.1 Every member of the Party shall have the right to vote and to be voted for
into any party office provided that such member has fulfilled the conditions
prescribed in the Constitution of the Federal Republic of Nigeria, any other
law in force, the Constitution and electoral guidelines of this Party;
9.2 Every member shall have the right to active participation in the deliberations
and activities of any organ of the Party of which he/she is a member. Such
rights include participation in the nomination of candidates to and being
nominated to elective offices of the Party and the Legislative and Executive
arms of Government at any level;

9.3 Every member shall have the right to demand for accountability from elected
officials of the Party;

9.4 It shall be the obligation of every member to register as a voter in general


elections and obtain a voter’s card;

9.5 Every member on registration as a member of the Party shall:


a. pay a membership fee and obtain a membership card;
b. pay an annual subscription fee which shall be specified from time to time;
c. accept to abide by the provisions of this Constitution as well as the
policies, programmes and ideals of the Party;
d. refrain from pursuing any course of action that may be inconsistent with
or inimical to the interest of the Party;
e. be entitled to Party rights and privileges;
f. have the right to have his or her grievances looked into.

ARTICLE 10: SECRETARIAT


The registered National office of the Party shall be located in the Federal Capital
Territory, Abuja.

Other offices of the Party may be established as may be decided by the National
Executive of the Party.

ARTICLE 11: ORGANIZATIONAL STRUCTU RE


There shall be Four Tier organizational levels of the Party; namely the Ward, the
Local Government Area, the State, and National. For the purposes of the Party’s
administration, the Federal Capital Territory, Abuja shall be treated as if it were a
State, the Area Council as Local Government Area and its Ward like any Ward in a
Local Government Area.

ARTICLE 12: THE WARD STRUCTURE


12.1 The organs of the Party at the Ward level shall be:
a. The Ward Congress (WC)
b. The Ward Executive Committee (WEC)
c. The Ward Standing Sub-Committees which shall be on:
i. Finance
ii. Publicity and Mobilization
iii. Election matters
iv. Membership rights and discipline.
v. The Elders Council.

12.2. The Ward Congress


There shall be established a Ward Congress of the Party in each Ward of the
Federation.

12.2.1 Composition
The Ward Congress shall consist of all registered card-carrying members of the
Party in the Ward who is also registered to vote in the General elections.

12.2.2 Powers and Functions


The Ward Congress shall be the highest decision making organ of the Party in the
Ward. It shall be responsible to the LGA Congress and shall have powers to:
a. Elect the Ward Executive Committee and Chairman of the Sub-Committees
from among Congress members resident in the Ward;
b. Election of delegates to LGA Congresses;
c. Receive, hear, debate and examine report from Ward Officials of the Party;
d. Elect, adopt and propose candidates for nomination for elective offices of
Councilors of the Local Government Council in accordance with this
Constitution and other electoral guidelines as may be directed from time to time
by the National Executives;
e. ratify or revoke disciplinary sanctions imposed by the Ward Executive
Committee;
f. Perform all other functions as may be delegated to it from time to time by the
LGA Organs of the Party.

12.2.3 Meetings
The Ward Secretary shall on the orders of the Chairman, convene the scheduled
meetings of the Ward Congress at least once in a year. An emergency meeting of
the Congress may be called at the request of the Chairman or 1/3 of the members of
the Executive Committee or 1/5 of the Congress members. Proponents of
emergency Congress meeting shall indicate the agenda in writing to the Ward
Chairman 7 days before convening the Congress.

The quorum for the Congress in all cases shall be one-fifth of all registered
members of the Party in the Ward.

12.3 The Ward Executive Committee


12.3.1 Composition
1. Chairman
2. Deputy Chairman
3. Secretary
4. Deputy Secretary
5. Women Leader
6. Youth Leader
7. Treasurer
8. Financial Secretary
9. Publicity Secretary
10. Organizing Secretary
11. Chairmen of the Ward Sub-Committees
12. The Councilor and Council Chairman from that Ward if they are members of
Party
13. Four members co-opted by the Ward Executive Committee. In co-opting these
persons the Ward Executive Committee shall ensure that consideration is given
to leaders of affiliate grass-root organizations (Women, Youth, and
Professional), local leaders of opinion whose influence will promote the interest
of the Party and to the leaders of non-indigenous ethnic residents in the Ward.
Such co-opted members shall have voting rights.
14. Members of Local Government, State, Zonal and National Executive
Committee who are from the Ward

12.3.2 Powers and Functions


The Ward Executive Committee shall be the Executive of the Party in the Ward and
shall be responsible to the Ward Congress in all matters.
a. The Chairman of the Executive Committee shall be the Chairman of the Party in
that Ward and shall preside over the Congress after his/her election.
b. The Ward Executive Committee shall be responsible for the administration of
the Party in the Ward, exercise the powers and functions of the Ward Congress
in- between meetings of the Congress and, in addition, shall carry out the
following functions:
i. mobilize support for the Party in the Ward and maintain the Membership
Register;
ii. collect membership registration fees and annual dues and issue membership
cards;
iii. convene the Ward Congress and prepare its agenda;
iv. determine the compositions and elect the members of the standing sub-
committees;
v. identify the main issues (political, economical or social) of concern in the
Ward and notify the LGA Congress or its designated organ;
vi. organize election primaries for the nomination of candidates for council
elections;
vii. organize Ward programmes so that they are in accord with the directives and
guideline laid down by the various organs of the Party
viii.deal with all matters delegated or referred to it by other superior organs of
the Party;
ix. consider and deal with the reports of the Standing Sub-Committees;
x. investigate and take disciplinary action in respect of any erring members or
official of the Party in that Ward;
xi. Employ and determine the remuneration of tiny supporting staff.

12.3.3 Meetings
The Ward Secretary on the orders of the Chairman shall convene the meeting of the
Ward Executive Committee as at when necessary but not less than once every three
months at the usual place. An emergency meeting of the Ward Executive
Committee may be summoned at the request of the Chairman or 1/3 of its members.
All members shall be notified of such meetings in the usual manner.

The quorum for all meetings shall be 1/3 of the members of the Ward Executive
Committee.

12.4 The Ward Sub-Committees


12.4.1 The Compositions of the Ward Standing Sub-Committees shall be
determined by the Ward Executive Committees.
12.4.2 The Committees shall be responsible to the Ward Executive Committee and
shall have powers and functions stipulated in the general Rules and Regulations
(Schedule

ARTICLE 13: THE LOCAL GOVERNMENT STRUCTURE


13.1 The official organs of the Party at the Local Government
Area shall be:
a. The Local Government Congress
b. The Local Government Executive
c. The Local Government Working Committee
d. The Local Government Standing Sub-Committee which shall be on:
i. Finance
ii. Publicity and Mobilization
iii. Election Matters
iv. Membership Rights and Discipline.
v. The Elders Council.

13.2 Local Government Congress


There shall be established in each Local Government Area a Local Government
Area Congress of the Party.

13.2.1 Composition
The LGA Congress shall be composed as follows:
a. All members of the LGA executive of the Party
b. All elected officials of the party at all levels who are from the Local
Government.
c. All Government officials elected on the platform of the party who are from the
Local government;
d. All former Presidents and Vice- Presidents, all former party Chairmen, all
former Governors and Deputy Governors, all former Principal Officers of the
State and National Assembly who are members of the Party.

13.2.2 Powers and Functions


The Local Government Area Congress shall be highest decision making organ of
the Party in the Local Government Area and shall be responsible for running the
Party in accordance with the provisions of this Constitution under the general
guidelines and directions of the State Congress. Specifically, it shall:
a. Elect LGA officers, the Chairmen of the LGA Sub-Committees and LGA
representatives to the State Congress and the National Convention.
b. Elect candidates for nomination for all elective offices in the relevant
constituencies.
c. Elect the Candidate for the Office of Chairman of the Local Government
Area Council
d. It shall receive reports from the Ward Congresses and take appropriate
actions.
e. Ratify or revoke disciplinary sanctions imposed by the Ward Congresses.
f. Participate in the nomination of candidates as stipulated in this Constitution
and other electoral guidelines as may be directed from time to time by the
National Executives.
g. Perform such other duties and take such other steps whether of the kind
herein before referred to or otherwise as it may think expedient or deemed
desirable for dealing with local circumstances that may arise or for the
protection or furtherance of the interest of the Party or its members and may
determine any matter, question or issue that may arise locally pending the
approval of the State Congress.

13.2.3 Meetings
The Local Government Area Secretary shall convene the scheduled meetings of the
LGA Congress at least once a year. An emergency meeting of the LGA Congress
may be called at the request of the Chairman or 1/3 of the members of the LGA
Executive or 1/5 of the members of the Congress. Proponents of an emergency
Congress meeting shall indicate the agenda in writing to the LGA Chairman at least
7 days before convening such Congress.

The quorum shall be 1/3 of the membership provided that at least two-thirds of the
Wards in the LGA are represented by at least a quarter of the representatives.

13.3 Local Government Executive


13.3.1 Composition
There shall be a Local Executive of the Party which shall consist of:
a. All members LGA Working Committee
b. All members of the LGA Sub-Committees
c. All Chairmen, Secretaries, Women Leader, Youth Leader and Treasurers of the
Wards in the LGA
d. One representative of the State Chairman who may or may not be from the LGA
e. Chairman, Vice Chairman of Local Government Area Councils and all the
Councilors who are members of the Party
f. All National Zonal and State officers of the Party who are from the Local
Government Area
g. All members of the State and National Assemblies from the LGA who are
members of the Party.

13.3.2 Powers and Functions


The Local Government Area Executive Committee shall be responsible for all
policy, decisions in its area of jurisdictions subject to the general guidelines and
directives of the Local Government Area Congress, the State and the National
Executives.

The LGA Executive shall in addition:


a. Implement the decisions of the LGA Congress and such other directives that
may come from the State and National Executives of the Party.
b. Make recommendations on policies and programmes to the [GA Congress
c. Receive reports from the [GA Wards
d. Determine the compositions and elect the members of the Local Government
Area Sub-Committees.
e. Organize election primaries for the nomination of candidates for elections within
the LGA.
f. Consider and deal with reports of the Sub-Committees.
g. Harmonize reports and distribute them to all Wards and ensure their
implementation.
h. Summon or convene the Local Government Area Congress and prepare its
agenda.
i. Assist the Ward Branches in their organization and campaign efforts.
j. identify main issues (political, Social and economic) of concern in the LGA
k. Raise funds for the Party.
l. Investigate and take disciplinary action in respect of any member or official of
the Party in the LGA
m. Employ and determine the conditions of service including discipline of all paid
officials.
n. Perform such other duties and take such other steps whether of the kind herein
before referred to or otherwise as it may think expedient or deemed desirable for
dealing with any local circumstances that may arise or for the protection or
furtherance of the interest of the Party or its members and may determine any
matter, question or issue that may arise locally pending the approval of the State
Congress.

13.3.3 Meetings
The Local Government Area Secretary on the orders of the Chairman, shall convene
the scheduled meetings of the LGA Executive Committee at least once every three
months. The meetings shall be chaired by the Chairman of Local Government Area
Working Committee. An emergency meeting of the LGA Executive may be called
at the request of the Chairman or 1/3 of the members of the LGA Executive.
Proponents of an emergency Executive meeting shall indicate the agenda in writing
to the LGA Chairman at least 7 days before convening such meeting.

Quorum at its meetings shall be 1/3 of its membership provided 2/3 of the Wards in
the LGA are represented.

13.4 Local Government Area Working Committee


13.4.1 Composition
The Local Government Area Working Committee of the Party shall consist of:
a. Chairman
b. Deputy Chairman
c. Secretary
d. Deputy Secretary
e. Women Leader
f. Youth Leader
g. Treasurer
h. Assistant Treasurer
i. Organizing Secretary
j. Assistant Organizing Secretary
k. Publicity Secretary
l. Assistant Publicity Secretary
m. m. Financial Secretary
n. Assistant Financial Secretary
o. n. Legal Adviser who shall be a Legal Practitioner
p. Auditor
q. Six members co-opted by the Working Committee. In co-opting such members,
consideration shall be given to their possible contributions to the advancement
of the objectives of the Party. Such co-opted members shall have no voting
rights.

13.4.2 Powers and Functions


The Local Government Working Committee shall be responsible for the day to day
administration of the Party in the LGA and in addition exercise all the powers and
functions of the LGA Executive in-between meetings of the Executive and shall be
responsible to the Executive in all matters.

13.4.3 Meetings
The Local Government Working Committee shall meet at least once every three
months.

The quorum shall be 1/3 of its members

13.5 The LGA Sub-Committee


13.5.1 The Compositions of the Local Government Area Standing Sub-Committees
shall be determined by the LGA Executive Committee

13.5.2 The Committees shall be responsible to the LGA Executive Committee and
shall have powers and functions stipulated in the general Rules and Regulations
(Schedule 1).

14. Senatorial District Consultative Forum


14.1 Composition
1. There shall be a Senatorial District Consultative Forum which shall consist of:
a. the State Vice Chairman from the Senatorial District, who shall be the
Chairman;
b. the State Governor or Deputy Governor, who are members of the Party from the
Senatorial District;
c. members of the Board of Trustees from the Senatorial District;
d. members of the National and State Executive Committees of the Party from the
Senatorial District;
e. Local Government Party Chairmen, Secretaries, Women Leader, Youth Leader
and Treasurer from the Senatorial District;
f. elected Local Government Council Chairmen and Vice Chairmen from the
Senatorial District, who are members of the Party;
g. five ex-officio members elected by the Senatorial District Forum, at least two of
whom shall be women;
h. members of the National and State House of Assembly from the Senatorial
District, who are members of the Party;
i. elected Local Government Council Councilors from the Senatorial District who
are members of the Party; and
j. Former members of the National and State Executive Committee who are still
members of the Party.

14.2 Functions
The functions of the Senatorial District Forum shall be to:
a. identify and resolve conflict within the party in the Senatorial District;
b. Nominate members of Standing Committee at the state and state Elders Council.

14.3 Meetings
14.3.1. The Senatorial District Forum shall meet at least once a year or as the need
arises and report to the State Working Committee.

14.3.2. The forum shall elect a Chairman and a Secretary from among its members.
14.3.3. The quorum for the Senatorial District Executive Committee meeting shall
be one-third of the members of the Committee drawn from at least two-third of the
Local Government Areas in the Senatorial District and a simple majority shall pass
any motion.

ARTICLE 15 THE STATE STRUCTURE


15.1 The official organs of the Party at the State shall be on:-
a. The State Congress
b. The State Elders Council
c. The State Executive
d. The State Working Committee
e. The State Sub-Committee which shall be on:
i. Finance
ii. ii. Publicity and Mobilization
iii. Elections Matters
iv. Membership Rights and Discipline
v. Strategy, Planning and Organization.
15.2 State Congress
There shall be established in each State a State Congress of the Party.

15.2.1 Composition
The State Congress shall be composed as follows:
a. All members of the State Executive Committee of the Party
b. All elected officials of the party at all levels who are from the State.
c. All Government officials elected on the platform of the party who are from the
State;

15.2.2 Federal Capital Territory (FCT)


There shall be for the Federal Capital Territory, Abuja a FCT Congress, which
shall consist of:
a. all members of the FCT Executive Committee of the Party;
b. all elected officials of the Party in the FCT
c. all government officials elected on the platform of the Party in the FCT;
d. The FCT Minister and Minister of State, if members of the Party;
e. Members of the National Executive Committee of the Party who are from FCT

15.2.3 Powers and Functions of the State Congress


The Powers and Functions of the State Congress shall apply ‘mutatis mutandis’ to
the FCT Congress.

The Congress (State and FCT) shall be the supreme policy making organs of the
Party in their respective jurisdictions and shall be responsible for the running of the
Party in accordance with the provisions of this Constitution under the general
guidelines of the National Convention.

The State and FCT Congresses shall:


a. Elect State Officers of the Party
b. Elect Gubernatorial Candidates of the Party;
c. Elect Members of the Board of Trustees from the State
d. It shall receive reports from the LGA Congresses and take appropriate actions;
e. Ratify or revoke disciplinary sanctions imposed by the LGA Congresses;
f. Participate in the nomination of candidates as stipulated in this Constitution and
other electoral guidelines as may be directed from time to time by the National
Executives; and
g. Perform such other duties and take such steps whether of the kind herein before
referred to or otherwise as it may think expedient or deemed desirable for
dealing with any local circumstances that may arise or for the protection or
furtherance of the interest of the Party or its members and may determine any
matter, question or issue that may arise locally pending the approval of the
National Convention.

15.2.4 Meetings
The State Secretary shall convene the scheduled meetings of the State Congress at
least once a year. An emergency meeting of the State Congress may be call at the
request of the Chairman of 1/3 of the members of the State Executive or 1/5 of the
members of the Congress. Proponents of an emergency Congress meeting shall
indicate the agenda in writing to the/state Chairman at least 7 days before
convening such Congress.

The quorum shall be 1/3 of the membership provided that at least two-thirds of the
LGA in the State or Territory as the case may be are represented by at least a
quarter of the expected representatives.

15.3 State Elders Council


15.3.1 Composition
There shall be the State Elders Council which shall consist of:
a) 5 elders of the Party from each Senatorial District appointed at the State
Congress on the recommendation of the State Executive in consultation with the
Senatorial Elders Forum
b) Person(s) not exceeding six who have contributed to the growth of the Party,
found suitable and co-opted by the Elders Council.
c) A person nominated shall have the right to reject his/her nomination in writing
to the State Executive within 14 days.

15.3.2 The State Elders Council shall:


a) Elect a Chairman and a Secretary from among its members;
b) Regulate its own proceedings;
15.3.3 Qualification for Membership
a. A person shall qualify for membership of State Elders Council if he or she is
qualified to be a member of Board of Trustee.
b. Without prejudice to the constitution of Nigeria, persons who agree to serve on
the State Elders Council shall be deemed to have renounced their right to contest
for any elective position in the party.

15.3.4 Functions
The State Elders Council shall, subject to the provision of this
Constitution:
a) ensure high standard of morality in all activities of the Party in the State;
b) mediate in dispute between the Executive and legislature arms of government in
the State, and between members of the Party, and
c) Undertake such other function and activities as may be referred to it by the State
Working Committee or the State Executive.

15.3.5 A member of the State Elders Council shall:


a) be removed from office by a resolution of the State Executive on grounds of
infirmity or misconduct;
b) resign his membership of the Council by tendering a letter to that effect to the
State Chairman of the Party;
c) and shall lose his/her membership of the Council if he/she resigns or is expelled
from the Party.

15.3.6 Meetings
The Elders Council shall meet at the instance of the Chairman or at the request of
the members of the Council or following a resolution of the State Executive
requesting for such a meeting.

The quorum of the State Elders Council shall be 2/3 of its m

15.4 The State Executive


15.4.1 Composition
There shall be a State Executive of the Party which shall consist of:
a. All Members of the State Working Committee.
b. Members of the State Sub-Committee
c. All Chairmen, Secretaries and Treasurer, Women Leader and Youth Leader of
each LGA in the State.
d. All Chairmen of Local Government Councils who are members of the Party.
e. All National Officers of the Party who are from the State
f. Members of Board of Trustees from the State
g. One Representative of the National Chairman.
h. President and Vice President of the Federal Republic of Nigeria produced by the
Party. Governor and Deputy Governor in case of a State, Minister or Minister of
State of the FCT if members of the Party.
i. All Commissioners and Special Advisers in the State who are Members of the
Party.
j. All National and State Assembly members from the State who are members of
the Party.

15.4.2 Powers and Function


The State Executive shall be responsible for all policy decisions in the State subject
to the general guidelines and directions of the State Congress, the National
Executive and the National Convention.
The State Executive shall in addition:
a. Implement the decisions of the State Congress and such other directives that
may come from the National Executive of the Party.
b. Make recommendations on policies and programmes to the State Congress.
c. Receive reports from LGA Executives
d. Determine the compositions and elect the members of the State Standing Sub-
Committees.
e. Organize election primaries for the nomination of candidates for elections within
the State,
f. Consider and deal with reports of the Standing Sub-Committees.
g. Harmonize reports and distribute them to all Local Government Areas and ensue
their implementation.
h. Summon or convene the State Congress and prepare its agenda.
i. Assist the LGA and Ward Branches in their organization and campaign efforts.
j. Identify main issues (political, social and economic) of concern in the State.
k. Raise funds for the Party.
l. Investigate and take disciplinary action in respect of any member or official of
the Party in the State and deal with any appeal from members who have been
sanctioned by lower Organs of the Party.
m. Employ and determine the conditions of service including discipline of all paid
officials.
n. Perform such other duties and take such other steps whether of the kind herein
before referred to or otherwise as it may think expedient or deemed desirable for
dealing with any local circumstances that may arise or for the protection or
furtherance of the interest of the Party or its members and may determine any
matter, question or issue that may arise locally pending the approval of the
National Executive and the National Convention.

15.4.3 Meetings
The State Secretary shall convene the scheduled meetings of the State Executive at
least once every three months. The meetings shall be chaired by the Chairman of
State Working Committee. An emergency meeting of the State Executive may be
called at the request of the Chairman or 1/3 of the members of the State Executive.
Proponents of an emergency Executive meeting shall indicated the agenda in
writing to the State Chairman at least 14 days before convening such meeting.

Quorum at its meetings shall be 1/3 of its membership provided 2/3 of the LGAs in
the State are represented.

15.5 The State Working Committee


15.5.1(A) Composition of State Working Committee
The State Working Committee of the Party shall consist of:
a. State Chairman
b. State Deputy Chairman
c. Three Vice Chairmen, one from each of the Senatorial District in the State.
d. State Secretary
e. Deputy Secretary
f. Women Leader
g. Youth Leader
h. State Treasurer
i. Assistant Treasurer
j. State Financial Secretary
k. Assistant Financial Secretary
l. State Organizing Secretary
m. State Assistant Organizing Secretary
n. State Legal Adviser who shall be a Legal Practitioner.
o. State Publicity Secretary
p. Assistant Publicity Secretary
q. State Internal Auditor.
r. 6 members co-opted by the State Working Committee. In co-opting such
members, consideration shall be given to their possible contributions to the
advancement of the objectives of the Party. Cooped members shall have no
voting rights.

15.5.1(B) Composition of FCT Working Committee


The FCT Working Committee of the Party shall consist of:
a. Chairman of the Party in the FCT
b. Deputy Chairman
c. Secretary in the FCT
d. Deputy Secretary
e. Women Leader
f. Youth Leader
g. Treasurer
h. Assistant Treasurer
i. Financial Secretary
j. Assistant Financial Secretary
k. Organizing Secretary
l. Assistant Organizing Secretary
m. Legal Adviser who shall be a Legal Practitioner
n. Publicity Secretary
o. Assistant Publicity Secretary
p. Internal Auditor
q. 6 members co-opted by the FCT Working Committee. In co-opting such
members, consideration shall be given to their possible contributions to the
advancement of the objectives of the Party. Cooped members shall have no
voting rights.

15.5.2 The powers and Functions


The Powers and Functions of the State Working Committee shall apply ‘mutatis
mutandis’ to the FCT.

The State Working Committee shall be responsible for the day to day
administration of the Party in the State and in addition exercise all the powers and
functions of the State Executive in-between meetings of the Executive and shall be
responsible to the Executive in all matters.

15.5.3 Meetings
The State Working Committee shall meet as at when necessary but not less than
once a month. The quorum shall be 1/3 of its members.

15.6 The State and FCT Sub-Committees

15.6.1 The Compositions of the Sub-Committees shall be determined by the


respective Executives

15.6.2 The Committees shall be responsible to the Executive Committees and shall
have powers and functions stipulated in the general Rules and Regulations
(Schedule 1).

ARTICLE 16 THE ZONAL STRUCTURE


16.1 The official organ of the party at the zone shall be the Zonal Congress

16.2. Composition
The Zonal Congress shall be composed as follows:
a. State Executive Committee from the zone
b. All elected officials of the party at all levels who are from the zone.
c. All Government officials elected on the platform of the party who are from the
zone;
d. All former Presidents and Vice- Presidents, all former party Chairmen, all
former Governors and Deputy Governors, all former Principal Officers of the
State and National Assembly who are members of the Party from the zone.
e. All delegates to the National Convention from all the States in the zone
16.2.2 Functions
The functions of the Zonal Congress shall be to:
a) elect the national Vice chairman from the zone
b) receive the reports of officers of the Party in the Zone
c) Identify and resolve conflicts in the Party in the zone

16.2.3 Meetings
The Zonal Congress shall meet at least once a year at the instance of the National
Vice Chairman from the Zone.
16.2.4 An extra-ordinary meeting of the Zonal Congress shall be held if requested
for by at least two-third of the members of the State Executive Committee

16.2.5 The quorum for the Zonal Congress meeting shall be two- third of the
members of the States in the Zone and a simple majority shall pass any motion

ARTICLE 17 THE NATIONAL STRUCTURE


The official organs of the Party at the National level shall
a. The National Convention
b. Board of Trustees
c. The National Executive Committee
d. National Caucus
e. The National Working Committee
f. The National Standing Sub- Committees which shall be on:
i. Finance
ii. Publicity and Mobilization
iii. Election Matters
iv. Membership Rights and Discipline
v. Strategy, Planning and Organization
vi. Establishment and Welfare
vii. Contact and Conflict Resolution

17.2 National Convention


17.2.1 Composition
a. All members of the National Executive Committee of the Party
b. All elected officials of the party
c. All Government officials elected on the platform of the party;

17.2.2 Functions and Powers of the National Convention


The National Convention shall be the highest decision making organ of the Party
and its decisions shall be final and binding on all members and Organs of the Party.
The National Convention shall:
a. elect the National Officers of the Party and Chairmen of the Sub- Committees;
b. elect the Presidential Candidate of the Party;
c. receive, debate and examine reports from the National Executive Committee of
the Party;
d. receive and examine the audited account of the Party;
e. remove from office any member of the Party;
f. have power to expel or suspend any member from the Party, and to deliberate on
any appeals from members or State branches on any such expulsion or
suspension on the recommendation of the National Executive Committee;
g. have power to impose levies;
h. have the power to create, elect and appoint any Committee(s) it may deem
necessary, desirable or expedient, and delegate such powers and functions to
those committees as it deems fit and proper;
i. have power to examine policies and programmes and the actions taken by any
government and determine what actions, if any, the party may take;
j. exercise any other powers and authority as it may find conducive to the
promotion of the aims and objectives of the party as laid down in this
Constitution;
k. have power to amend this Constitution.

17.2.3 Meetings
The National Secretary shall on the orders of the Chairman convene the scheduled
meetings of the National Convention at least once a year. The meetings shall be
chaired by a Chairman elected at the Convention for that purpose. An emergency
meeting of the National Convention may be called at the request of the National
Chairman or 1/3 of the members of the National Executive or 1/5 of the members of
the Convention. Proponents of an emergency Convention meeting shall indicate the
agenda in writing to the National Chairman at least 60 days before convening such
Convention.

The Quorum shall be 113 of the membership provided that at least two thirds of the
State that are represented.

17.3 Board of Trustees


17.3.1 Composition
They shall be a Board of Trustees consisting of members of unquestionable
integrity drawn from all the States of the Federation in whom all the movable and
immovable properties of the Party shall be vested. The Board shall also include the
following:
a) all past and present Presidents and Vice Presidents of the Federal Republic of
Nigeria who are members of the Party;
b) all past and serving National Chairmen, and National Secretaries of the Party,
who are still members of the Party;
c) serving Presidents of the Senate and Speakers of the House of
Representatives, who are members of the Party;
d) one member per State nominated by the State Congress
e) Person(s) not exceeding nine, at least three of which must be women who
have contributed immensely to the growth of the Party and found suitable by
the Board. Provided that membership of the Board of Trustee shall reflect the
Federal Character of Nigeria.

17.3.2 Election and Tenure of Officers and Members


The Board of Trustees shall:
a. elect a Chairman and Secretary from its members
b. without prejudice to the provision of this Constitution, ensure that the person
elected to be Chairman and Secretary respectively are of proven integrity and are
committed to the growth of the Party;
c. ensure that the Chairman and Secretary of the Board of Trustees shall, subject to
Subsection (5) and (6) of this Section, serve a term of five years and no more.

17.3.3 Qualification for Membership


a. Without prejudice to the provisions of this Constitution in Article 9
Subsection I and 2, a member of the Board of Trustees shall not be qualified
to seek nomination for any other party office or position. A person shall
qualify for membership into the Board of Trustees if he or she:
b. is a registered card carrying member of the Party; and
c. is a person of integrity
d. is qualified to be elected Senator of the Federal Republic

Functions
17.3.4 The Board of Trustees shall, subject to the provision of this Constitution:
a. ensure highest ethical and moral standards in all the activities of the Party by
acting as the conscience of the Party, with power to call to order any officer of
the Party whose conduct falls below acceptable standards;
b. ensure high morale of members of the Party and that the Party enjoys a good
image before the Nigerian populace and is in good political health;
c. review and advise on policies, programmes and activities of the Party at
a. the national level;
d. Supervise the sourcing of Party funds;
e. be vested with the assets of the Party and shall serve as custodians of such
assets;
f. mediate in disputes between the Executive and Legislative arms of Government
or between Government and the Party;
g. offer advice on Party matters to the National Executive Committee of the Party;
h. undertake any another functions and activities as may be referred to it by the
National Working Committee, the National Executive Committee or the
National Convention.

17.3.5 The Board of Trustees shall regulate its own proceedings and shall draw up a
code of onduGtf0r its members.

17.3.6 Removal and Resignation


A member of the Board of Trustees shall lose his membership if he/she is:
a. removed by a resolution of the National Convention on the recommendations of
the National Executive Committee on grounds of infirmity of body or mind or
misconduct; or
b. if he/she resigns his membership of the Board of Trustees or the party by tending
a letter to that effect to the Secretary of the Board.
c. if he is expelled from the Party.

17.3.8 Fresh replacement shall be made to fill any vacancy in the Board of Trustees
where applicable.

17.3.9 The Board of Trustees shall meet at the instance of the Chairman or at the
request of half of the members of the Board or following a resolution of the Board
or the National Executive Committee requesting for such a meeting.
The quorum for the Board of Trustees meeting shall be two-third of its members
drawn from at least two-third of the States in the Federation, and a simple majority
shall pass any motion.

17.4 The National Executive Committee


17.4.1 Composition
The National Executive Committee shall consist of:
a. The members of the National Working Committee of the Party.
b. Members of the Board of Trustees
c. Six National Vice Chairmen (from the six zones)
d. The Chairmen of the State Executive Committees
e. Six Senators nominated from six geo- political zones of the Country.
f. The President, Vice President of the Federal Republic of Nigeria if members of
the Party.
g. The President of the Senate, Deputy President, Speaker, Deputy Speaker,
Majority/Minority leaders of both Houses of National Assembly if members of
the Party.
h. Six registered members of the Party one from each zone co-opted by the
National Executive Committee. In co-opting such members, considerations shall
be given to Women, Resource persons and nominees of interest groups whose
contribution will promote the interest of the Party. Cooped members shall have
no voting rights.
i. Deputy National Woman Leader, Deputy National Youth Leader, Deputy
National Organizing Secretary, Deputy National Internal Auditor, Deputy
National Legal Adviser, Deputy National Treasurer, Deputy National Financial
Secretaries, Deputy National Publicity Secretary
j. The National Chairman of the Party shall have both voting and casting rights. He
shall also have the power to invite any person to the National Executive
Committee meeting to speak on any matter for that purpose alone. Such persons
shall have no voting right.
k. The heads of the bureaucratic units of the Party who shall have the right to
contribute to the debate but shall have no voting rights.

17.4.2 Power of National


a. It shall implement and carry out decisions of the National Convention of the
party.
b. It shall organize and conduct the National Convention of the Party and prepare a
report on each Convention.
c. It shall formulate broad electoral and policy proposals for deliberation at the
National Convention.
d. It shall issue all electoral guidelines at all levels of the party
e. It shall determine the comPOSit10’S and elect the members of the National Sub
-Committees.
f. It shall have power to suspend or expel any member or suspend or dissolve any
organ found guilty of gross Indiscipline, gross breach of this Constitution,
Sabotaging the interests and activities of the Party, or other gross anti-party
activities, subject to the right of the individual, branch or organ to appeal to the
National Convention.
g. It shall perform all such other duties or functions, or take such step whether
referred to in the above section or not, as it deem necessary in the Interest of the
Party, subject to the approval of the National Convention.
h. The National executive shall appoint a reputable firm of auditors or an auditor to
audit the accounts of the Party.
i. It shall have the power to deal with appeals against a decision of any branch
executive.
j. Shall have the power to employ and determine the remunerations and conditions
of service of all paid officials of the Party.

17.4.3 Meetings
The National Executive shall meet at least once every three months. The National
Secretary shall with due notice summon scheduled meetings of the National
Executive. He shall summon extra ordinary meetings upon receipt of a signed
request from the National Chairman or 1/3 of the members of the Executive with
voting rights.

The Quorum shall be 1/3 of the members.


17.5 NATIONAL CAUCUS
17.5.1 Composition
There shall be a National Caucus of the Party which shall consist
a. The National Chairman, who shall be the Chairman;
b. The President and Vice President of the Federal Republic of Nigeria, who are
members of the Party.
c. the Senate President and Deputy Senate President, the Leader and Deputy
Leader, the Chief Whip and Deputy Chief Whip of Party in the Senates who are
members of the Party;
d. the Speaker and Deputy Speaker the Leader and Deputy Leader, the Chief Whip
and Deputy Chief Whip of the Party in the House of Representatives, who are
members of the Party
e. One Governor who is a members of the Party nominated by the governors from
his/her zone who are members of the P arty;
f. The Chairman and secretary of the Board of Trustees and six members, one from
each of the six geoP0lital Zones.
g. The Deputy National Chairman;
h. The National Secretary of the Party, who shall be the Secretary of the National
Caucus; the National Legal Adviser and the National Treasurer the National
Women Leader and the National Youth Leader;
i. three Federal Ministers who are members of the Party nominated by the
president of the Federal Republic of Nigeria one of whom shall be the Attorney
General of the Federation.
j. the Secretary to the Government of the Federation, if a member of the Party and

17.5.2 Functions
The National Caucus shall:-
a. Consider, review and advise on policies and programmes of government.

17.5.3 An extra-ordinary meeting of the National Caucus shall be held if requested


for by two-third of the members of the Caucus and a simple majority shall pass any
motion.

17.5.4 The quorum for the National Caucus meeting shall be two- third of its
membership.

17.6 The National Working Committee


17.6.1 Composition
The National Working Committee of the Party shall consist of:
a. The National Chairman
b. Deputy National Chairman
c. Six National Vice Chairmen (One from each zone)
d. The National Secretary
e. Deputy National Secretary
f. National Woman Leader
g. Deputy National Woman Leader
h. National Youth Leader
i. Deputy National youth Leader
j. The National Treasurer
k. Deputy National treasurer
l. National Organizing Secretary
m. Deputy National Organizing Secretary
n. National Publicity Secretary
o. Deputy National Publicity Secretary
p. National Financial Secretary
q. Deputy National Financial Secretary
r. National Legal Adviser
s. Deputy 8ioflallegad
t. National Internal Auditor
u. Deputy National Internal Auditor

17.6.2 Powers and Functions


a. The National Working Committee shall be responsible for the day- to- day
administration of the Party and shall be responsible to the National Executive
Committee of the Party.
b. It shall carry out directives of the National Executive Committee and propose
matter for its consideration and approval.
c. It shall have power to set up ad-hoc Committees as it may be considered
necessary for the implementation of the activities of the Party.
d. It shall act on behalf of the National Executive Committee during intervals
between the meetings

17.6.3 Meeting
The National working Committee shall meet necessary but not less than once a
month. The Quorum shall be 1/3 of its members.

ARTICLE 18: TENURE OF OFFICERS AND ELECTIONS


18.1 All Officers of the Party shall remain in Office for a period of - four years
unless re-elected for an extra one term only by their respective Congresses or
Convention as the case maybe.

18.2 No member of the Party shall hold the office of the Party and government
executive position at the same time

18.3 The Ward, Local Government Area, State and National Officers of the Party
shall be elected every four years in a democratic, free and fair election.

ARTICLE 19: DISCIPLINE


19.1 Discipline of members shall be exercised by the Executive Committees of the
appropriate level through its Standing Committee on Membership Rights and
Discipline after due process and fair hearing.
19.2 The Executive Committees at all levels shall have power to suspend from
membership, suspend or remove from office, impose a fine, debar from holding an
office, but the power to expel from the Party is exclusively reserved for the National
Executive Committee subject to ratification by the National Convention.

19.3 Decisions of any Organ of the Party in respect of disciplinary matters are
subject to the right of appeal to a higher or superior organ of the Party. Members
affected by the decisions shall be deemed to have been dully notified if such
decision is displayed in the recognized office of the Party at the level concerned.

19.4 Any member aggrieved by decisions of any Organ of the Party in respect of
disciplinary matters shall have the right to appeal within 30 days of the decisions to
the immediate higher Organ of the Party, and in a successive order, up to the
National Convention, whose decision shall be final.

19.5 The decision of any organ in respect of disciplinary matters shall remain valid
and binding unless revoked by way of appeal by a higher Organ of the Party.

19.6 Acts of Indiscipline


The following shall constitute acts of indiscipline in the context of the Party:
a. A breach of any provision(s) of this Constitution. Anti Party activities or
conduct likely to embarrass the Party, or bring into disrepute, contempt or
ridicule
b. Disobedience or negligence in carrying out lawful directives of the Party or of
the Officers of the Party. Disloyalty, sabotage, disorderly behavior at meetings;
c. engaging in dishonest practices defrauding the Party, theft, sedition, immoral
conduct, conviction in a regular Court of law for a criminal offence;
d. carrying out anti- party propaganda or other activities which would tend to
disrupt the peaceful lawful and efficient organization of the Party;
e. failure to fulfill financial obligations to the Party;
f. f giving false information to any organ of the Party;
g. unauthorized publicity of Party dispute;
h. sitting at a meeting of the party of which he is not an accredited member without
the permission of the Chairman of such meeting;
i. using rude or provocative language during a meeting of the Party, or failing to
treat other members with due courtesy;
j. failing to abide by the ruling of the Chairman during a meeting or disrupting the
meeting of the Party;
k. using the funds of the Party for things other than that for which the funds have
been earmarked;
l. refusing to appear before the disciplinary organs of the party;
m. instituting Court actions against the Party or any of its Organs or Officers
without exhausting all avenues for internal redress as stipulated in Article 19.4

Punishment
If after due process the disciplinary organs of the Party find a member guilty of n
act of indiscipline, punishment to be imposed may take the form of:
a. Expulsion: Only the National Executive Committee can expel a member.
Recommendations to the National Executive Committee for expulsion of a
member should be sent by the appropriate State Executive Committee, while the
affected member shall remain suspended pending the decision of the National
Executive Committee. The decision of the National Convention shall be final.
b. Suspension for a specific period.
c. Suspension and removal from office.
d. Debarring from holding an Office.
e. Fine.
f. Censure.
g. Caution and discharge.

ARTICLE 20: PARTY FUNDS


20.1 Sources
The funds of the Party shall be derived from:
a. Fees, sub5CiPtiOn5 and other levies imposed on members;
b. statutory allocations (if any) made by the Federal Government in accordance
with the Constitution and Laws of the Federation;
c. donations, public collection and other means of fund raising for the party;
d. gifts and grants from Individual Nigerian Citizens in accordance with the
provisions of the Constitution
e. proceeds from Investments.

20.2 Accountability
The National Executive shall at such time and in such manner as required by the
National Convention and Independent National Electoral Commission (INEC)
submit to the Commission and the Convention published statement of its assets and
liabilities.

ARTICLE 21: NOMINATION OF CANDIDATES FOR ELECTIONS


21.1 Guidelines for the conduct of the primaries for the nomination of candidates of
the party for all elections shall be prepared by the National Working Committee and
ratified by the National Executive Committee at least 90 d7S before they fall due.

21.2. In preparing the Electoral Guidelines, the National Working Committee shall
take due cognizance of all relevant stipulations in the Constitution of the Federal
Republic of Nigeria, any other electoral laws for the time- being in force, the
properly issued directives of the relevant agencies of Government in charge of
elections and electoral processes as well as the Constitution of the Party.

21.3 Only the National Chairman, the National Secretary and the National Legal
Adviser collectively may submit the list of candidates contesting on the platform of
the Party to the designated government Agency as stipulated in the Constitution of
the Federal Republic of Nigeria.

ARTICLE 22: PARTYADMINISTRATION


22.1 The day- to- day administration of the Party shall be vested in the Working
Committees at all levels. The Chairmen of these Committees shall be the Chief
Executive at that level. The Working Committees at all levels shall determine the
administrative structures and establishment of its bureaucracy.

22.2 The salaries and other conditions of service of the employed staff shall be
determined by the National Executive Committee.

ARTICLE 23: BANK ACCOUNT


23.1 The Party shall maintain Bank Accounts in the Federal Capital Territory, and
the Headquarters of States and Local Government

23.2 The Executive Committee at each level will determine the Banks to use.

23.3 Only the following shall be signatories to the account of the


Party at each level, namely;
a. The Chairman
b. The Treasurer
c. The Secretary

In exceptional circumstances such as emergencies or the physical unavailability of


one of the other signatories any two signatories may suffice provided the Chairman
is one of the two.

ARTICLE 24: COMMON SEAL


The Common Seal of the Party shall be a design approved by the National
Executive Committee and shall be in the custody of the National secretary of the
party.

ARTICLE 25: AMENDMENTS


This Constitution or any provisions or sections of it may be amended by the
National Convention of the Party provided:
a. A notice of the motion for amendment IS filed with the National Secretariat at
least 30 days before the date of the meeting of the National Convention;
b. that the motion for amendment is circulated to each State branch at least 14 days
from the date of the National Convention or advertised prominently in at least
three national newspapers;
c. that the motion is supported by at least one third of the representatives present
and voting at the National Convention.
d. Any Amendment passed is to be published in at least one national daily for the
information of party members and the general public

ARTICLE 26 TRANSITIONAL CLAUSE


The Inaugural Congregation and Natural Convention of the party shall be conducted
within six calendar months of the issuance of the certificate of registration of the
party.

ARTICLE 27: OATH OF OFFICE


Any person elected or appointed into any office of the Party shall subscribe to the
Oath of Office as provided in Schedule IV of this Constitution, in the language that
he or she understands and before a Commissioner for Oaths or Notary Public.

ARTICLE 28: INTERPRETATION


28.1 Any question as to the meaning of any section of this Constitution shall be
referred to the National Executive Committee whose ruling shall be final.
28.2 In this Constitution;
a. “Members” mean any duly registered member of the party.
b. “Funds” include valuable properties;
c. “He” or “His” shall include the female gender;
d. “The Party” means Peoples Democratic Movement;
e. “Month” means calendar month;
f. “Constitution” means COflSttUti0fl of the Peoples Democratic Movement;
g. where the computation of any feature or any election in this Constitution
result in a fraction, the figure obtained shall be rounded up to the nearest
higher whole number;
h. “Youth” means a member between the ages of 18 and 40 Years;
i. “Congress” a large formal meeting or series of meetings where
representatives from different Party levels discuss ideas, make decisions, pass
resolutions and conduct election;
j. “National Convention” The largest meeting of PDM at National level which
is the highest authority of the Party where decisions are ratified and
Presidential candidate and National Officers are elected
k. “elegate5” are elected or nominated repreSeflt5tes of the Party at any level of
the structure of the party;
l. “National” This refers to Federal level 85 contained in the Constitution of the
Federal Republic of Nigeria 1999;
m. “Zonal” This refers to each of the geo political entities viz North East, North
Central, North West, South East, South West, South South’
n. “State” This refers to geographical entity as defined in the Constitution of the
Federal Republic of Nigeria 199;
o. “Local Government Area” This refers to the Local Government Area as
defined by S.7 and particularly schedule 2 of the Constitution of Federal
Republic of Nigeria 1999;
p. “Ward” this refers to the area delineation of the Local Government Area by
the Independent National Electoral Commission.

SCHEDULE I
TERMS OF REFERENCE FOR SUB-COMMITTEES
1. Finance Committee
This Committee will:
i. Secure ways and means of funding the Party activities at all levels;
ii. Monitor the disbursement of funds of the Party.
2. Publicity and Mobilization Committee
i. Package policies and party positions for publicity purposes;
ii. Supervise press relation activities;
iii. Supervise the presentation and placement of publicity materials for
optimum cost effectiveness;
iv. Organize Party presentation by appropriate persons on public debates and
dialogues;
v. Plan and organize rallies.

3. Election Matters
This Committee will consider all matters pertaining to a successful outing of the
Party in the elections; organize and implement decided strategies as directed by the
Strategy, Planning and Organization Committee.

Specifically, the Committee shall;


i. Coordinate the recruitment, training and deployment of Party Agents;
ii. administer election monitoring logistics and oversees effective deployment of
election personnel;
iii. direct and coordinate the activities of the State Election Committee;
iv. compile and circulate all information for field officers;
v. liaise with the agencies connected with the
vi. conduct of elections;
vii. prepare a post election report; and
viii. do such things as may be directed by the Strategy, Planning and Organization
Committee.

4. Membership Rights and Discipline


This Committee shall look into the grievances of members, provide a forum for fair
hearing and determine matters of discipline and rights of members through
conciliation as sanctions as may deem appropriate.

5. Strategy, Planning and organization


The Committee shall have the following specific responsibilities:
i. Seek and analyze relevant information in respect of:
a. Political Environment
b. National Issues
c. The opposition’s disposition and strategy
d. All Agencies concerned with the conduct of election;
ii. Harmonize all information and advice appropriate strategies for winning
elections;
iii. Coordinate the activities of and formulate operational directives for other
Committees at the National and State levels in a manner consistent with the
overall objectives and in the context of available findings;
iv. Empower Task Forces for operational assignments;
v. Preparation of problem appraisals and identification of possible courses of
action to address the problems.

6. Establishment and Welfare Committee


This Committee shall determine the establishment and conditions of service of full-
time staff of the Party at all levels.

SCHEDULE II
FUNCTIONS OF THE OFFICERS OF THE PARTY
All Officers of State, Local Government Area or Ward levels shall have the same
powers and functions at their respective levels as prescribed in Schedule II provided
that as far as practicable legal officers should be legal practitioners within the
contemplation of the Legal practitioners Act of 1975.
1. The Chairman
The Chairman at each respective level shall:
a. Serve for a period of four years and shall be the Chief executive of the Party;
b. Preside over all the meetings of the Executive Committee, Working Committee,
the Congress or the National Convention as the case may be;
c. Be responsible for the proper conduct of business at all meetings of the various
organs of the Party and with the Secretary, sign all minutes of such Organs.
d. Have the powers to direct the Secretary to summon meetings of th relevant
Organs of the Party and shall decide the business to be transacted at such
meetings;
e. In conjunction with the Secretary and the Treasurer sign all vouchers and
cheques of the Party;
f. Have a casting vote whenever there is a tie in division of any of the Organs of
the Party.

2. The Deputy Chairman


The Deputy/Vice Chairmen at the respective level shall:
a. Assist the Chairman at all meetings and may act for and on behalf of the
Chairman on any occasion when the Chairman shall be absent;
b. Serve for a period of four years;
c. The National Vice Chairman from each zone shall preside over the Zone as
the Chairman.

3. The Secretary
At each level, the Secretary shall;
a. Serve for a period of Four years;
b. Record and keep the minutes of the meetings of all Organs of the Party;
c. Keep custody of and preserve all books, property, and documents of the Party
relating to the Secretariats;
d. Be responsible for such correspondence of the Party as related to the Secretariat;
e. Prepare and present Annual Report to be read at the various Congresses and
National Convention of the Party as the case may be;
f. With direction and approval of the Chairman, prepare the order of business and
the venue for meetings of all organs of the Party;
g. Ensure that inventory of the assets of the Party is kept, and shall compile a
register showing the names and addresses of officers of the Party;
h. Together with the Chairman, and Treasurer sign all the vouchers and Cheques of
the Party;
i. The Ward Secretary shall keep the Register of members of the Ward;
j. Participate in the deliberations of the Committee on Membership Rights and
Discipline.

4. Deputy Secretary
a. He/She shall deputize for the Secretary and in his absence act for him.
a. He/She may perform such other functions as may be
b. Delegated to him/her by the Secretary.
c. He/She shall be the Secretary of the Zonal Forum of his/her zone.

5. The Treasurer
a. Shall be responsible for keeping the monies, funds and securities of the Party;
b. Shall receive and pay within 48 hours into a Bank Account of the Party all
monies received for and on behalf of the Party, and shall issue official receipts
for all monies so received;
c. Shall together with the Chairman and Secretary, sign all vouchers and Cheques
of the Party;
d. Shall issue receipts for all monies received and shall keep a register of Nominal
Roll of all financial members of the Party;
e. Shall ensure proper records and books of accounts are being kept at the
Secretariat, and may cause such books to be produced for inspection;
f. Shall hold office for four years;
g. Shall participate in the deliberations of the Committee on Finance.

6. Deputy National Treasurer


Shall assist the National Treasurer in the performance of his duties and in his/her
absence.

7. Organizing Secretary
a. Shall organize and coordinate all field activities of the Party;
b. Shall be free to participate in the deliberations of the Standing Committees.
c. Liaise with the National Woman Leader, Youth Leader for the harmonization of
the programmes for the attainment of Party success at all elections.
d. Organize seminars, workshops, rallies and campaign programmes for the
attainment of Party success at all elections

8. Financial Secretary
a. Shall collect monies and funds due to the Party and shall pay such monies to the
Treasurer not later than four working days after collection;
b. Shall prepare and submit proposals for raising funds for the Party for
consideration by Executive Committee;
c. Shall ensure that proper accounts and records are kept and may cause such books
to be produced for inspection at periodic auditing;
d. Shall hold office for four years;
e. Shall participate in the deliberations of the Committee on Finance.

9. Deputy Financial Secretary


Shall assist the Financial Secretary in the performance of his duties and in his/her
absence act on his/her behalf.

10. Publicity Secretary


a. Shall be responsible for public relations and publicity activities of the Party;
b. Shall be the Principal image of the Party and advice the Party on all mass media
matters;
c. Shall publicize the policies and programmes of the Party;
d. Shall participate in the deliberations of the Committee on Mobilization and
publicity.

11. Deputy Publicity Secretary


Shall assist the Publicity Secretary and act for him/her during his/her absence.

12. Legal Adviser


a. Shall advice the Party on all matters and arrange for the legal defence of the
Party and its members when necessary and in the Party’s interest;
b. Shall deal effectively with all correspondence pertaining to the legal matters
affecting the Party, its Organs or its members;
c. Shall participate in the deliberations of the Committee on Membership Rights
and Discipline.

13. The Deputy Legal Adviser


Shall assist the Legal Adviser and act for html her during his absence.

14. Internal Auditor


a. Shall audit the books of the Party quarterly and submit written audit reports to
the relevant Executive Committee of the Party;
b. Shall conduct other checks on the finances and assets of the Party as may be
directed from time to time by the Executive Committee of the Party at each
level.

15. Deputy National Internal Auditor


Shall assist the National Internal Auditor and act for him/her during his absence.

16. Deputy National Organizing Secretary


Shall assist the National Organizing Secretary and act for him/her during his
absence.

17. The National Vice-chairman


The National Vice Chairman shall assist the National Chairman and act on his/her
behalf in their respective zones.
18. The National Woman Leader
The National Woman Leader shall coordinate the women mobilization efforts of the
party and work with the National Organizing Secretary for all field activities of the
party.

19. The Deputy National Woman Leader


The Deputy National Woman Leader shall assist the National Woman Leader and
act on her behalf in her absence

20. The National Youth Leader


The National Youth Leader shall lead the youth mobilization efforts of the party
and shall work with National Organizing Secretary for coordinating the field
activities of the party

21. The Deputy National Youth Leader


The Deputy Youth Leader shall assist the National Youth Leader and deputize for
him in his absence.
SCHEDULE III
OATH OF ALLEGIANCE

and the Federal Republic of Nigeria and that I will preserve, protect and defend the
Constitution of the Peoples Democratic Movement and of the Federal Republic of
Nigeria. So help me God.

SCHEDULE IV

OATH OF OFFICE

I ……………………………………………………………solemnly swear/affirm
that I shall be faithful and bear true allegiance to the PEOPLES DEMOCRATIC
MOVEMENT. I shall discharge my duties to the best of my ability, faithfully and in
accordance with the Constitution of the Party and always in the interest of the
integrity, solidarity, advancement, well-being and prosperity of the party and the
Federal Republic of Nigeria; that I will strive to pursue, enhance and achieve the
aims and objectives of the Party as contained inn its Constitution and Manifesto;
that I shall not allow my personal interest to influence my official decision; that in
all circumstances I shall do right to all the members of the Party and to all manner
of people, according to law without fear or favour, affection or ill-will; that I shall
not directly or indirectly communicate or reveal to any person any matter, which
shall be brought to my attention or, which shall become known to me as an officer
of the Party, except as may be required for the due discharge of my duties and that I
shall devote myself to the service and well-being of the people of Nigeria. So help
me God.
