This petition came before me on this day for final hearing in the
presence of Sri G.Ratnam Reddy, counsel for petitioner and Sri P.Vijaya
Bhaskar Reddy, advocate holding for Sri Emmanuel, counsel for 2 nd
respondent, upon hearing both sides and on perusing the material on
record and the matter having stood over for consideration till date, this
Court passed the following:
ORDER

1. This is an application under Section 24 of Code of Civil Procedure,

1908.

2. The case of the petitioner is that, the petitioner filed MVOP

No.18/2024 on the file of III Additional District Judge, Ranga Reddy

District at L.B.Nagar against the respondents seeking compensation for

the injuries caused to him in a motor vehicle accident. That the petitioner

is residing in the jurisdiction of the courts at L.B.Nagar, Ranga Reddy

District. Therefore, he filed the claim petition before the III Additional

District Judge, Ranga Reddy District at L.B.Nagar. That the said claim was

transferred to the file of XVI Additional District Judge, Ranga Reddy

District at Shadnagar without noticing the address of the petitioner.

Therefore, the case may be transferred to the III Additional District Court,

Ranga Reddy District at L.B.Nagar.

3. Sri P.Vijaya Bhaskar Reddy, advocate appeared and represented that

he is holding for Sri Emmanuel, advocate appearing for the 2 nd

respondent before the trial court and they have no objection for allowing

the petition.

4. Heard learned counsel for petitioner.

5. Upon considering the material on record, point for consideration is:

“Whether the claim petition has to be transferred?”

6. POINT: It is the contention of the petitioner that the petitioner is

residing in the jurisdiction of the courts at L.B.Nagar and he filed the

claim petition before the court at L.B.Nagar and it was transferred to the

District Court at Shadnagar on point of jurisdiction, though the court at

L.B.Nagar has jurisdiction. As seen from the record, the petitioner is

residing at Vikas Nagar, Saroornagar, L.B.Nagar and therefore, he is

residing in the jurisdiction of the court at L.B.Nagar and consequently, he

is entitled to maintain the claim before the court at L.B.Nagar and had, in

fact, filed the claim before the said court. In the circumstances, the claim

petition can be transferred.

7. In the result, the petition is allowed directing that MVOP

No.18/2024 pending on the file of the XVI Additional District Judge, Ranga

Reddy District at Shadnagar be transferred to the file of the III Additional

District Judge, Ranga Reddy District at L.B.Nagar. The transferor court

shall transmit the entire case records in MVOP No.18/2024 forthwith, duly

indexed, to the transferee court, after giving information to both parties

and also fixing the date of appearance of the parties before the transferee

court with due intimation to this court.
