CONSTRUCTION AGREEMENT
KNOW ALL MEN BY THESE PRESENTS:
This agreement is made and entered into by and between:
____________________, a single proprietorship, registered with the DTI, with
principal office at ________________, Cebu, represented herein by its Owner,
_______________________, and referred to in this contract as CONTRACTOR;
- and -
________________________, Filipino, married and residing at and referred to
herein as the OWNER;
Witnesseth:
OWNER intends to engage the services of CONTRACTOR for the renovation
works of _______________ building located at ______________., Mandaue City;
CONTRACTOR agrees to provide the materials and labor for the renovation
works of the building subject to the terms and conditions of this contract;
Both parties hereby bound themselves to the following terms and
conditions, to wit:
1. OWNER shall provide CONTRACTOR with the specific scope/coverage/area of
any particular renovation work along with the design and quality standard
with shall be in writing through individual or combined Purchase Orders or
specific work request addressed to the CONTRACTOR;
2. Upon execution of this agreement, CONTRACTOR shall first submit a list of
materials and labor cost required for the particular undertaking;
3. CONTRACTOR shall begin the renovation work only after OWNER or its duly
authorized representative affixes his/her signature on the list of materials
and labor costs submitted for the particular work;
4. OWNER hereby agrees and stipulates that as consideration for the
engagement of CONTRACTOR, the former shall pay or cause to be paid to
the latter the amount equivalent to the actual cost of the labor, materials,
consumables and other items provided for the particular Purchase Order or
specific work request and an additional twenty five percent (25%) of the
total cost;
5. OWNER agrees and binds itself to pay CONTRACTOR the amount of any
billing submitted to it within a period of ten (10) days from receipt of such
billing;
6. OWNER agrees to the schedule of workers daily wages attached to this
contract as Annex “A”;
7. CONTRACTOR shall provide its workers with the appropriate uniforms and
identification cards;
8. CONTRACTOR shall also be responsible for the construction service vehicle it
shall provide and its activities inside and outside of the construction site;
9. CONTRACTOR shall provide for the sleeping quarters, utilities and
bunkhouse of its workers which shall be outside the construction site;
10. CONTRACTOR shall also be responsible for the pickup and delivery of
any construction material for the project and all office communications and
supervision of the renovation works;
11. OWNER shall be responsible for putting up any required construction
bond, performance bond, insurance, permits and other fees, charges or
impositions not stipulated in this contract;
12. This contract shall continue in full force and effect unless earlier
terminated by any party through a written notice at least sixty (60) days
before termination or unless OWNER shall notify CONTRACTOR in writing of
the completion of all necessary works;

This contract refers to construction contract and consists of two (2) pages,
including this page on which this acknowledgment is written, each and every page
of which has been signed by the parties and their witnesses.
