DEED OF REAL ESTAGE MORTGAGE
KNOW ALL MEN BY THESE PRESENTS:
This contract of REAL ESTATE MORTGAGE made and
executed by ALLAN PEREZ, Filipino, of legal age, married to
___________, with residence and postal address at _________,
hereinafter called and referred to as MORTGAGOR, in favor of
ABC BANK, a banking institution duly organized and existing
under Philippine laws, with principal office at ______________,
represented herein by its authorized officer,______________,
hereinafter referred to as the MORTGAGEE.
WITNESSETH:
THAT the mortgagor is the true, lawful and registered
owner of a parcel of land together with all the improvements
therein, covered by and registered under Transfer Certificate
Title No, TCT No. T-998877 of the Register of Deeds of the
residential property, and which property is particularly
described as follows:
A residential property with an area of FIVE HUNDRED
SQUARE METERS (500 sq.m.), more or less, covered by
Transfer Certificate of Title (TCT) No. T-998877, situated in
Province of Laguna, to secure the payment of the said loan and
all other obligations of the MORTGAGOR to the MORTGAGEE.
TERMS AND CONDITIONS:
1. Loan Amount: The MORTGAGEE extends a loan to the
MORTGAGOR in the amount of Php1,000,000.00.
2. Purpose: The loan is for business purposes.
3. Interest: The loan shall bear interest at the rate of [insert
interest rate] per annum, payable as agreed by the parties.
4. Term: The loan shall be payable within a period of [insert
term, e.g., 5 years], with monthly installments as agreed.
5. Payment: The MORTGAGOR shall make payments in
accordance with the terms set forth in the promissory note
or loan agreement.
6. Default: In case of default in the payment of any
installment or any other obligation herein, the
MORTGAGEE shall have the right to foreclose this
mortgage in accordance with law.
7. Insurance: The MORTGAGOR shall insure the property
against fire and other risks, with the MORTGAGEE as
beneficiary, for the duration of the mortgage.
8. Taxes and Expenses: The MORTGAGOR shall pay all
taxes, assessments, and other charges on the property
during the term of this mortgage.
9. Redemption: Upon full payment of the loan and all
obligations, the MORTGAGEE shall execute a deed of
release of mortgage.
