AN ORDINANCE ESTABLISHING A BARANGAY ECOLOGICAL SOLID WASTE
MANAGEMENT PROGRAM. REGULATING THE PROPER SEGREGATION, COLLECTION,
RECYCLING AND PROPER DISPOSAL OF GARBAGE AND THE ASSESSMENT OF
GARBAGE FEE FROM HOUSEHOLDS, COMMERCIAL, INDUSTRIAL ESTABLISHMENTS
of Barangay Bonfal West, Bayombong, Nueva Vizcaya.
EXPLANATORY NOTE
Every day, an estimated three (3) to four (4) sacks full of garbage is generated by
households and business establishments in Barangay Bonfal West. With the amount of
trash generated, it is necessary for Barangay Bonfal West to adopt a strategy to achieve
waste reduction, while ensuring the daily collection of garbage.
Republic Act No. 9003, otherwise known as the Ecological Solid Waste Management Act
of 2000, was enacted precisely to address and remedy the waste problem in the whole
country. It mandates the decentralization of waste management giving the barangay the
task of collecting solid waste. It also authorized the barangay to collect garbage fee for the
operation of its garbage collection strategies and its materials recovery facility.
In response to the challenges of Republic Act No. 0093, Barangay Bonfal West on July 7,
2014 enacted Barangay Ordinance No. 001 S-2014: “AN ORDINANCE ESTABLISHING A
BARANGAY ECOLOGICAL SOLID WASTE MANAGEMENT PROGRAM. REGULATING
THE PROPER SEGREGATION, COLLECTION, RECYCLING AND PROPER DISPOSAL OF
GARBAGE AND THE ASSESSMENT OF GARBAGE FEE FROM HOUSEHOLDS,
COMMERCIAL, INDUSTRIAL ESTABLISHMENTS of Barangay Bonfal West, Province of
Nueva Vizcaya”.
The barangay ordinance hopes to spell-out the mechanics of garbage collection,
segregation, recycling, assessment of garbage fees, and operationalization of Materials
Recovery Facility in Barangay Bonfal West.
WHEREAS, Republic Act No. 9003 otherwise known as the Ecological Solid Waste
Management Act of 2000, provides that the policy of the state is to adopt the systematic
comprehensive and ecological solid waste management program which shall ensure the
proper segregation, transport, storage, treatment and disposal of garbage and adaptation
of the best environmental practices is solid waste management.
WHEREAS, RULE XVII, SECTION 3, of the implementation rules and regulations of RA No.
9003 authorize the barangay to impose and collect garbage fees for the collections and
segregation of biodegradable, compostable and reusable waste and for the use of
Barangay Materials Recovery Facility.
WHEREAS, the Sannguniang Barangay of Bonfal West recognizes the need to have a solid
waste management program of the barangay, providing therein a systematic solid waste
management program including the collection from household, business establishment
and institutions recycling segregation and storage for the collection and final disposal to
the dumpsite.
NOW THEREFORE, BE IT ENACTTED BY THE SANGGUNIANG BARANGAY OF BONFAL
WEST, PROVINCE OF NUEVA VIZCAYA, UPON MOTION BY HONORABLE LEONARDO
M. DISAY DULY SECONDED BY THE HONORABLE REYNALDO L. CABATO, WITHOUT
OPPOSING VOTE, BY VIRTUE OF THE POWERS VESTED BY RA-7160 IN SESSION
ASSEMBLED THAT:
SECTION 1. SHORT TITLE-This ordinance shall otherwise known as the Ecological Solid
Waste Management Ordinance.
SECTION 1. DEFINITION OF TERMS- as use in the ordinance, the following terms shall
mean:
a. Agricultural waste shall refer to waste generated from planting or harvesting of
crops, trimming or pruning of plants and wastes or run- off materials farms or fields.
b. Biodegradable shall refer to anything that originate from living things, whether
anima, plant, or human which decomposes and reduced into fine particles by
microorganism or enzymes, eq. paper, wood, fruits, peels, left over, seed, fish, fowl
innards and the like.
c. Bulky wastes shall refer to waste materials which cannot be appropriately placed in
separate containers because of either its bulky size, shape, or other physical
attributes. These include large worn-out or broken household, commercial, and
industrial items such as furniture, lamps, bookcases, filing cabinets, and other
similar terms.
d. Buy- back center shall refer to a recycling center that purchases or otherwise
accepts recyclables materials from the public for the purpose of recycling such
materials.
e. Collection- shall refer to the act of removing solid waste from the source or from a
communal storage point.
f. Collection Vehicle-shall refer to an authorized vehicle used in gathering of stored
waste during the scheduled collection.
g. Collection Schedule- shall refer to the designated time given for the collection of
waste in a particular route.
h. Construction/Demolition Debris- shall refer to solid waste arising from construction
and demolition of structure, such as earth mounds, dilapidated concrete pieces of
stones, rocks, woods, metal, and plastic scraps.
i. Composting- shall refer to the controlled decomposition of organic matter by
microorganism mainly bacteria and fungi, into humus-like product.
j. Consumer Electronics- shall refer to special waste that includes worn-out, broken,
and other discarded items such as radios, stereos, and television set.
k. Disposal- shall refer to the discharge, deposit, dumping, spilling, leaking, or placing
of any solid waste into or in hand.
l. Ecological Solid Waste Management- shall refer to the systematic administration of
activities which provide segregation at source, segregated transportation storage,
transfer processing, treatment and disposal waste and all other waste management
activities which do not harm the environment.
m. Generation- shall refer to the act or process of producing solid wastes.
n. Generator- shall refer to a person, natural or judicial who last uses a material and
makes it available for disposal or recycling.
o. Hazardous Waste- shall refer to solid waste management or combination of solid
waste which because of its quantity, concentration or physical, chemical or infection
characteristics may:
a. Cause or significantly contribute to an increase in morality or an increase in
serious irreversible, or incapacitating seversible, illness, or
b. Pose a substantial present or potential hazard to a human health or the
environment when improperly treated, stored transported or disposed of
otherwise managed.
p. Leachate- shall refer to the liquid produced when waste undergo decomposition and
when water percolate through solid waste undergoing decomposition. It is
contaminated liquid that contains dissolved and suspended materials.
q. Material Recovery Facility- includes a solid waste transfer station or sorting station
drop-off center. A composting facility, and a recycling facility.
r. Recyclable Material- shall refer to any waste material retrieved from the waste
