📘 DepEd Order No. 40, s. 2012 – Child Protection Policy (CPP)

Issued by the Department of Education (DepEd) to ensure a safe, positive, and child-
friendly environment in all schools.

🔍 Purpose

To protect children from all forms of violence, abuse, neglect, exploitation, bullying, and
other acts that endanger their safety and well-being within the school system.

⚖️Legal Basis

 1987 Philippine Constitution


 RA 7610 – Special Protection of Children Against Abuse, Exploitation, and
Discrimination Act
 RA 9344 – Juvenile Justice and Welfare Act
 RA 10627 – Anti-Bullying Act (later issued in 2013)
 UN Convention on the Rights of the Child

🧒 Who are Protected?

All learners in public and private basic education institutions (elementary and secondary),
including ALS and SPED learners.

✅ Key Provisions

1. Acts of Abuse and Violence Prohibited

 Physical violence (hitting, slapping, corporal punishment)


 Verbal and emotional abuse
 Sexual abuse or harassment
 Bullying and cyberbullying
 Neglect or denial of basic needs
2. Duties of Schools and Personnel

 Establish and activate a Child Protection Committee (CPC)


 Develop and implement a school-based child protection policy
 Provide trainings on positive discipline, child rights, and reporting procedures
 Act immediately and appropriately on complaints of abuse or violence

3. Reporting and Referral Mechanism

 Any learner, parent, or staff may report an incident.


 The school head/CPC must act within 48 hours.
 Serious cases must be referred to proper authorities (PNP, DSWD, etc.)

4. Positive Discipline

 Promotes non-violent, child-centered, and rights-based discipline strategies


 Discourages any form of corporal punishment or humiliating treatment

5. Child Protection Committee (CPC)

 Headed by the School Head


 Composed of teachers, parents, students (in secondary), and community members
 Handles prevention programs, child protection training, and case management

📝 Important Duties of Stakeholders

 Teachers – Must model respectful behavior, ensure classroom safety


 Parents – Expected to cooperate with school rules and support child-friendly discipline
 Learners – Encouraged to report abuse and participate in awareness programs

Patakaran sa Proteksyon ng Bata ng DepEd

🎯 Layunin

 Siguraduhin ang ligtas, mapayapa, at makataong kapaligiran para sa mga mag-aaral.


 Protektahan ang bata mula sa anumang uri ng pang-aabuso, karahasan, pananakot
(bullying), pagpapabaya, at diskriminasyon.

 RA 9344 – Batas para sa Kabataang Nagkasala

🧒 Sino ang Saklaw?

Lahat ng mag-aaral sa pampubliko at pribadong paaralan, kabilang ang SPED at ALS


learners.

🚫 Mga Ipinagbabawal na Gawa

1. Pisikal na pananakit – sampal, palo, pagpalo ng ruler, at iba pa


2. Berbal o emosyonal na pang-aabuso – pang-iinsulto, pananakot
3. Seksuwal na pang-aabuso o panliligalig
4. Bullying at cyberbullying
5. Pagpapabaya o hindi pagbibigay ng pangunahing pangangailangan

🛠️Tungkulin ng Paaralan at mga Guro


 Bumuo ng Child Protection Committee (CPC)
 Magpatupad ng school-based child protection policy
 Isagawa ang orientation sa mga guro, magulang, at mag-aaral
 Tumulong at agad tumugon sa mga reklamo o kaso (dapat kumilos sa loob ng 48 oras)

✅ Positibong Disiplina

 Hinihikayat ang hindi marahas at makataong paraan ng pagdisiplina


 Bawal ang pamamahiya, pananakit, at pananakot bilang disiplina

🧑‍🤝‍🧑 Komposisyon ng Child Protection Committee (CPC)

 Punong-guro – Tagapangulo
 Guro, magulang, mag-aaral (HS), at kinatawan ng barangay o NGO
 Tungkulin: magplano, mag-monitor, mag-imbestiga, at magsagawa ng awareness
campaigns

📌 Paraan ng Pag-uulat

 Maaring magsumbong ang bata, magulang, guro, o sinuman


 Gamitin ang mga complaint forms at isubmit sa CPC
 Kung mabigat ang kaso, i-refer agad sa DSWD, PNP, o barangay
