1 INTRODUCTION
This ANNEXURE 3 is an AGREEMENT DOCUMENT forming part of the
AGREEMENT and shall be read with and into the AGREEMENT.
The PARTIES agree and acknowledge that, notwithstanding anything to the contrary
set out in this ANNEXURE or any other, this ANNEXURE shall be read and applied in
accordance with the order of precedence set out at Clause 1.6 of the FORM OF
AGREEMENT.
For the avoidance of doubt, the governing law and dispute resolution provisions of
Article [44] of ANNEXURE 2 (GENERAL TERMS AND CONDITIONS) apply to this
ANNEXURE 3.
In this ANNEXURE 3, unless otherwise defined, capitalised words and expressions
shall have the same meanings as are respectively assigned to them in the GENERAL
TERMS AND CONDITIONS.
2 SCOPE OF WORK – CONTENTS
The Engineering, Procurement, Construction, Pre-COMMISSIONING,
COMMISSIONING, START-UP and PERFORMANCE TEST SCOPE OF WORK is
specified in the Annexure and Sub-annexure as listed in the below table for ease of
reference only.

3E-1 Rely Upon Information
3 ORDER OF PRIORITY
The documents within ANNEXURE 3 shall be read and applied in the following order
of priority.
The latest versions and amendments of all applicable UAE legislation and
environmental regulations, applicable international laws and regulations, ADNOC
Guidelines, Project specifications, COMPANY specifications and standards,
regulations, GOOD INDUSTRY PRACTICE, Guidance and Practice Documents and
all relevant codes and standards on the EFFECTIVE DATE of the AGREEMENT shall
be used by CONTRACTOR. In any event, CONTRACTOR shall comply with Article
1.3 ANNEXURE 2.
Accordingly, FEED documents shall be upgraded by CONTRACTOR during the
detailed engineering stage as necessary as per the below order of precedence:

• UAE Federal Laws and National Local Regulations
• ADNOC HSE Standards and ADNOC OFFSHORE Procedures
• PROJECT Philosophies
• Design basis
• P&ID's
• Plot Plans
• PROJECT Specifications
• Datasheets
• COMPANY Specifications
• all remaining PROJECT Deliverables
• COMPANY Standard specifications and Procedures
• Applicable International Design Codes, Standards and Regulations
If there is any conflict among the documents included in the AGREEMENT, the most
stringent requirement among them will prevail. CONTRACTOR shall promptly bring
to the notice of COMPANY any such conflicts, and COMPANY shall determine the
prevailing requirement and advise CONTRACTOR accordingly.
