That the plaintiff is single, Filipino citizen and residing at # ! That plaintiff is the o%ner of a land o&er %hich an apart#ent had been constructed, located at Ba0a0eng 'orte, Baguio City. 1. That by &irtue of a contract of lease, plaintiff leased unto the defendant the aforesaid apart#ent for a consideration of Php2,333 per #onth as rental to be paid %ithin the first ten days of each #onth starting 4ece#ber 13, /311. !. That the defendant failed to pay the agreed rental for se&eral #onths starting fro# $pril /31/ up to the present. 5. That on 'o&e#ber 13, /31/, plaintiff sent a letter of de#and to &acate the apart#ent %hich %as recei&ed by the defendant as sho%n in the registry return receipt hereto attached. 6+ection 1, "ule12, par. 78 2. That despite said letter of de#and %hich %as repeated by oral de#ands defendants failed and still refused to pay the agreed a#ount of rentals and refused to &acate the apart#ent. . That by reason of the failure of the defendant to &acate the pre#ises and to pay the unpaid rentals, plaintiff %as co#pelled to file this co#plaint engaging the ser&ices of a counsel in the a#ount of Php15,333. PRAYER /1ERE+ORE it is respectfully prayed that 9udge#ent be rendered ordering the defendant to &acate the pre#ises, to pay the rentals in the a#ount of Php23,333.33 and further rentals until the said defendant fully &acates the pre#ises and to pay the costs of the suit.
