Rule 74

1. The heirs of a deceased person who dies without debts are not required to submit the estate to judicial administration or appoint an administrator if they can partition the property amongst themselves extra-judicially. However, the heirs still have the option to institute judicial administration proceedings if they desire. 2. A contract of partition between heirs does not need to be in writing and can be proven by oral evidence. While Rule 74 Section 1 prefers a public instrument, it does not expressly mandate one. 3. Heirs may institute judicial administration proceedings for an estate even if there are no debts, if they have good reasons for doing so. Rule 74 Section 1 is permissive, not mandatory.
