The Terms and Conditions of Appointment
1. We have pleasure in appointing you as a Trainee with effect from Date of joining
mentioned in your Appointment Letter. You will be liable to be posted at any other office/
branch/department/ division of the company within India. In your current assignment, you
will be reporting to Mr. Ravinder Reddy Maktha, Director-Sales, MyRank Education Pvt Ltd.
2. You will perform such duties as are assigned to you by the company from time to time
relating to the position to which you are now appointed and to which you may be
transferred/deputed/seconded/promoted in future. You shall comply will al reasonable orders
of your superiors and attend to your duties punctually at such place/places, as may be
required at the relevant time. Please note that should you be entrusted with the handling of
cash, any shortfall will be recoverable from you personally. This does not preclude the
company from recovering the same from any dues to you, or from taking legal action. You
shall use your best endeavors to promote the interests of the company and your conduct at
other times shall be such as not to damage the interests of the company. You shall not engage
yourself directly or indirectly in any trade, business, vocation or occupation or in advisory
capacity.
3. You will faithfully observe and be governed by the companys rules and regulations on
matters such as working hours, festival/public holidays, weekly offs and any other
facilities/amenities, mode of recording your attendance, safety and security requirements,
medical fitness, personal identification, etc and operate with due regard to the highest
professional standards/ethics, in all your transactions. You may be required to work on
staggered timings/ shifts, the timings for which may be altered from time to time. The
company may refix/modify your designation, grade and distribution of your remuneration
into different components as per designation/grade/compensation structures implemented by
the company from time to time at their sole discretion. Please note that if you absent yourself
from the services of the company without prior written permission or overstay sanctioned
leave for three consecutive days, you will be deemed to have abandoned service voluntarily
without giving due notice and you shall lose lien on appointment.
4. Your acceptance into the companys rolls and your induction will be on the assumption of
your medical fitness. If you are at anytime prevented by accident, ill health or any other
urgent necessity from attending office or from performing you duties, you shall bring this to
the notice of the Management as soon as you possible can and furnish the management with
all the information relating thereto as it may reasonably require. You will be required to
produce appropriate records of your medical contingency and also a certificate of medical
fitness before you resume work. In addition, if called upon, you shall submit yourself to a
medical examination from time to time by a qualified registered medical practitioner
appointed or agreed to by the Management. Absence from work or disability in performing
your duties beyond the period of leave to which you are entitled under the rules shall, at the
discretion of the Management, be without any compensation.
5. Your appointment shall be for the tenure of 3Months on probation and then on full-time
basis from your date of joining the company after completing 3 Months and achieving the
targets of the company. As a part of this association, you will be required to undergo
appropriate training which may consist of classroom training and on-the-job training, as per
training schedules and other requirements of the company. All payments will be as per the
Companys procedures/ schedules in force from time to time and will be subject to deduction
of appropriate taxes at source and any statutory liabilities arising on your account, such as
contribution to Provident Fund. All current and future liabilities relating to your remuneration
(whether statutory or otherwise) shall be adjusted against the overall amount of Gross
Compensation (plus provision indicated towards payment of gratuity). Details of the
compensation package are strictly confidential between you and the Company. The details are
not liable for disclosure by you to any third party, without the Companys formal prior
consent.
6. Since the nature of your work requires you to handle confidential information, you shall
not at any time during your employment or after its termination, without the consent of the
Company in writing, divulge, directly or indirectly, any knowledge, information or
documents whether relating to Companys processes, operations, procedures, transactions or
not, acquired by you in the course of your employment concerning the business or affairs of
the company or its associates or clients and which are in the nature of a trade secret or secret
in other respects the disclosure of which will cause harm to the company, its associates or
clients. Breach of this condition on your part shall render your services liable for immediate
termination and you shall be liable for any other/ additional legal action as the Company may
deem fit.
7. You will not without prior consent of the Company in writing, which will not be
unreasonably withheld, publish any book or brochure or article concerning any matter, which
relates to any area of activity of the Company. Companys decision regarding the consent
shall be final and binding on you. You will not accept directly or indirectly any commission,
share in profit, presents or gratuities from any party dealing with, or seeking to deal with the
Company or its affiliates. You will inform the company without delay of any act of
dishonesty, fraud or cheating or any damage to the companys property that you may come to
know of whether the same is under contemplation or is taking place or has already taken
place.
8. Your appointment (vide this letter) and your continuation on the Companys rolls are in
good faith and shall be based on the data, information or any other under provided by you
during the course of your selection process, including the verbal information provided by you
during the interviews/ personal discussions. Any data that is not in consonance with the
information provided by you shall result in for any losses suffered by the company. Company
reserves the right to make suitable formal and informal checks with your educational
institutions, former employers and any other third parties, as the Company may deem
appropriate.
9. This arrangement can be terminated by the Company, without any notice or payment of
any kind in lieu of notice, in the following cases:
a. Any incorrect information furnished by you or on suppression of any material information.
b. Any act, which in the opinion of the management is an act of dishonesty, disobedience,
insubordination, incivility, intemperance, irregularity in attendance or other misconduct or
neglect of duty or incompetence in the discharge of duty on your part or the breach on your
part of any of the terms, conditions or stipulations contained in this agreement or a violation
on your part of any of the companys rules.
c. Your being adjudged an insolvent or applying to be adjudged an insolvent or making a
composition or arrangement with your creditors or being held guilty by a competent court of
any offence involving moral turpitude.
d. In case you remain absent from work without authorization or reasonable explanation, for
more than 4 consecutive days, it will be presumed that you are no longer interested in
working for the Company and have abandoned its services.
10. This appointment will be subject to your securing highest qualification in the first
attempt from a recognized Institute/ University. Your acceptance into the Companys
rolls will be subject to submission of a certificate in proof of your passing the
qualification examination in the first attempt. In case such certificate is not readily
available, the same shall be submitted to the company within one month from the date
of commencement of your training. In such an event, you will be required to submit a
Provisional Certificate or a Marks Memorandum issued by your institute/
University in proof of passing the relevant qualification, at the time of reporting for
training. This appointment as well as the terms and conditions of the appointment
shall be treated as provisional till you complete all formalities connected with you
induction(Such as submission of all necessary documents, pre-employment medical
fitness etc.) in all respects.
11. 11. Your performance and conduct will be assessed and appraised from time to time,
as per the performance appraisal/ evaluation process or any other appropriate
mechanism, as per schedules implemented by the Company from time to time.
Company reserves the option to either extend the tenure of your training, or terminate
the training or in any other manner modify the terms of your appointment without any
compensation in lieu, in case your progress during the training does not meet the
Companys expectations.
12. This appointment being purely on training basis, this offer of appointment is not intended
to create any relationship of permanent employment for you on the companys rolls beyond
the tenure specified hereinabove, in any manner whatsoever. However, in case your progress,
performance record, conduct and potential meet the Companys requirements consistently
during and till the end of your training period and subject to your suitability for any specific
role or position available in the Company at the relevant time, you may be considered for
association with the Company beyond the specified tenure or for absorption into the
Companys permanent rolls. Should you be considered for any such modification in the
nature of your association in any form whatsoever or for absorption into the Companys
permanent rolls, the terms and conditions stipulated in this letter of appointment shall have no
bearing whatsoever on the said association/ employment in future. Suitable terms and
conditions applicable to your modified employment status (including, if applicable, details of
any probation period) will be separately communicated to you formally, for your formal
acceptance, at the relevant time.
13. Subject to the Companys right to terminate this training in accordance with the
provisions specified herein or in accordance with the relevant rules in force at the time of the
event, the training may be terminated by either party, by providing a formal notice of
minimum one month to the other party. Neither party has to provide any notice(to the other
party) nor any compensation in lieu of the notice in case the termination is implemented on
completion of the tenure of training
14. At the time of your separation from the Companys employment in any manner
whatsoever (including retirement), you will comply with all procedures and requirements
connected with the separation including the formalities concerning handing over of all
papers, documents, floppies, CDs and any other valuables, property and assets, etc. which
belong to the Company. Final settlement of your dues and issuance of a certificate of
employment shall be completed by the Company after you have completed all the separation
requirements in full.
15. Company is not liable to pay any damage caused to the employee vehicle, laptop, phone
etc and all personal itineraries under any circumstances.
16. At the time of traveling, you should wear Helmet in case of two wheeler and seat belt incase of four wheeler for safety precaution. You should have a valid driving license and
vehicle documents along with you while you travel on duty.
17. At non fulfillment of the targets set by the company, company can take a call and the
employee can be asked to leave from the services prior 15 days notice by the company.
18. If an employee wants to leave the company, he should give one month prior written notice
to the company.
19. This letter constitutes the entire understanding between you and the company relating to
your employment by the company and superseded and cancels all prior written and verbal
agreements and understandings with respect to the subject matter of this appointment. This
appointment letter may be amended by a subsequent written agreement between you and the
Company. Any disputes relation to your terms of employment with the Company shall be
settled through amicable solution.
You are requested to send us a copy that is signed and dated by way of acceptance of the
terms and conditions contained therein.
