RE: Correction of Entries in the Certificate of Live Birth


of “DFM”

Sir/Madam:

We write your good office in behalf of our client FCC, with regard
to the correction of entry in the Certificate of Live Birth of his daughter
DFC.

In this regard, our client relayed to us that he approached your


good office regarding the certificate of live birth of his child namely,
Dannah Flor C. Milana, to have the same corrected from Dannah Flor C.
Milana to Dannah Flor M. Colis by virtue of the Acknowledgement
executed by him on August 2002 which was accepted and acted upon
by your good office and consequently annotated the result in the
certificate of live birth to the effect that the surname of the child is
hereby changed from “MILANA” to “COLIS” on September 7, 2005
pursuant to R.A. 9255. However, you denied his request and just said to
him to disregard the same.

We are attaching a copy of the Certificate of live birth with the


corresponding annotation for easy reference.

In this connection, we cite a provision in your “Manual of


Instructions on Revised Implementing Rules and Regulations of Republic
Act No. 9255 specifically, “However, for COLBs of illegitimate children
born on 3 August 1988 to 18 March 2004 which were processed based
on AO No. 1 Series of 2004 of RA 9255 prior to the issuance of this
revised IRR, are considered valid.”

The revised implementing rules and regulations of RA 9255 took


effect on 9 April 2016. The acknowledgment was made on August 2002
and was acted upon by your good office on September 2005. All these
transpired before April 9, 2016 or the implementation of the Revised
IRR. Therefore, it is clear that the acknowledgement and subsequent
correction of the last name in the birth certificate of Dannah Flor is
valid, binding and effective as can be gleaned from the above-cited
provision.

I now write you in behalf of our client, to acknowledge that the


name of Dannah Flor has been validly changed from “DANNAH FLOR C.
MILANA” to “DANNAH FLOR M. COLIS” and implore that you forward the
same to the Philippine Statistics Authority for proper action.

We are very optimistic that our request be taken cognizance by


your good office. Rest assured that this correspondence is made for the
sole purpose as above-stated and is not done for other illegal or
illegitimate reasons.
