Legal Settlement Agreement

This document is a compromise agreement between the People of the Philippines (complainant) and XXX (accused) regarding criminal case number 46571 for other forms of swindling. The accused agrees to pay the complainant PHP 493,000 by May 31, 2016 and an additional PHP 100,000 for damages and attorney's fees by June 30, 2016. In return, the complainant will execute an affidavit of desistance upon full payment, causing the dismissal of the criminal case. The agreement will also be submitted to the rehabilitation court overseeing the accused's corporation. Both parties agree this settlement fully resolves all claims between them regarding this case.

COMPROMISE AGREEMENT
UNDERSIGNED PARTIES:

X, Filipino citizen, of legal age, and residing at No. XXXX Everlasting


Circle, South Greenheights, Putatan, Muntinlupa City.

XXXX, Filipino citizen, of legal age, and residing at No. XXXX, Brgy.
Loma, Amadeo, Cavite,

HEREBY AGREE AS FOLLOWS:

For purposes of settling the claims of both parties and to put an end to
this litigation, a refund of the installment payments made by the Private
Complainant, in the total amount of FOUR HUNDRED NINETY THREE
THOUSAND (PhP 493,000.00) PESOS, for a parcel of land of the failed
subdivision project XXXX, is being offered by herein Accused.

The parties hereto have mutually agreed to settle the same under the
following terms and conditions:

1. The Accused undertakes to pay FOUR HUNDRED NINETY THREE


THOUSAND PESOS (PhP 493,000.00) on May 31, 2016 and the
amount of ONE HUNDRED THOUSAND PESOS (PhP 100,000.00)
as damages and attorney’s fees on June 30, 2016;

2. Private Complainant X will execute an AFFIDAVIT OF
DESISTANCE UPON FULL PAYMENT and will submit the said
affidavit to the Honorable Court and cause the dismissal of this
criminal case; and,

3. This compromise agreement will be submitted to the Court


hearing the Petition for Rehabilitation of the corporation owned
by herein accused for purposes of information and/or approval of
the said rehabilitation court, if necessary.

This COMPROMISE AGREEMENT constitutes full and final settlement


of the above criminal case and including all claims and counterclaims that
each party may have against each other in relation to this case.

IN WITNESS WHEREOF, the parties hereto have mutually and


voluntarily agreed to the above stipulations and hereby sign agreement this
____ day of XXXXX 2018 at City of Manila, Philippines.
