1. Introduction
This Privacy Policy explains how Get Werk, Inc. ("Get Werk," "Werk," "we," "us," or "our") collects, uses, discloses, and safeguards personal information when you access or use our website, mobile applications, and related online services (collectively, the "Service"), or when you otherwise interact with us.
By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree, you should not use the Service.
2. Information We Collect
We collect personal information that you provide directly to us, information we collect automatically when you use the Service, and information we receive from third parties.
2.1 Information You Provide to Us
We collect information you voluntarily provide, including:
- Identifiers and contact information, such as your name, email address, phone number, and account credentials.
- Profile information, such as your biography, preferences, interests, location you choose to share, and other profile details.
- User content, such as images, videos, reviews, comments, messages, and other content you upload or submit through the Service.
- Communications, such as messages and correspondence you send to us (including support requests), feedback, survey responses, and other interactions.
- Host and payout information, such as business name, payout details, tax information, and identity verification information needed to enable bookings and payouts. This information may be collected and processed by our payment and identity verification partners on our behalf.
- Membership application information, such as the answers you provide when applying for the Pro Plan (including a description of what you do, where you teach, and the styles or activities you offer), along with any supporting information you choose to share.
- Werkspace sign-in information, such as the name and contact details recorded when you or your guests sign in to use the Werkspace. You are responsible for ensuring that any guest whose information you provide has consented to your doing so.
You may choose not to provide certain information, but this may limit your ability to use certain features of the Service or to be considered for the Pro Plan.
Certain waivers and releases (such as liability waivers and media release forms used in connection with a Listing or the Werkspace) may be collected through third-party tools outside the Service. Information you provide through those tools is handled in accordance with the applicable third party's terms and privacy policy.
2.2 Payment and Membership Information
We use third-party payment processors (currently Stripe) to process payments securely. We do not collect or store full payment card numbers or bank account numbers entered on the payment page. We receive limited information related to your transactions (for example, the last four digits of your card, card type, approximate billing address, transaction date and time, and payment status) for recordkeeping, fraud prevention, and customer support purposes.
In connection with your membership, we also generate and store records about your relationship with the Service, including:
- Your membership status (for example, applied, approved, active, cancelled, or comped) and tier (Free or Pro).
- Identifiers issued by our payment processor for billing purposes, such as your Stripe Customer ID and, if applicable, Stripe Subscription ID. These identifiers reference your billing relationship with the processor and are not card numbers or bank account numbers.
- Timestamps and audit information related to your membership lifecycle, such as the dates of application, approval, activation, and cancellation.
- Transaction and billing records, including records of bookings, Payment Plans and their installment schedules and status, Coupons or promotional codes applied to a transaction, and related payment history.
Your use of third-party payment processors is subject to their privacy policies and terms.
2.3 Information Collected Automatically
When you access or use the Service, we automatically collect certain information, including:
- Device and usage information, such as your IP address, device identifiers, browser type, operating system, language settings, referring and exit pages, the pages or features you view, links you click, time spent on pages, and other actions you take on the Service.
- Approximate location information, derived from your IP address or device settings, where permitted by your device or browser.
- Information collected through cookies and similar technologies, including cookies, pixels, SDKs, and local storage, which may be used to remember your preferences, keep you signed in, understand how you use the Service, and measure performance and campaigns.

2.4 Information from Third Parties
We may receive information about you from third parties, such as:
- Payment and identity verification partners, who may provide information related to your transactions, payouts, or verification status. For example, Stripe sends us status updates and event notifications (such as successful charges, failed charges, and subscription state changes) for your Account.
- Analytics and advertising partners, who may provide information about your interactions with our Service or other sites and apps.
- Social media or single sign-on providers, if you choose to register for or log in to the Service using those services.
We use this information consistent with this Privacy Policy and any additional restrictions imposed by the source of the information.
3. How We Use Information
We use the information we collect for the following purposes:
- Providing and maintaining the Service, including creating and managing accounts, enabling bookings, processing payments and payouts, and providing customer support.
- Facilitating interactions and transactions between users, including hosts and guests, and sending related transactional messages such as confirmations, updates, and reminders.
- Reviewing and acting on Pro Plan applications, including evaluating eligibility, approving or declining applications, granting or revoking complimentary memberships, and communicating decisions to applicants.
- Managing memberships and billing, including creating and managing Stripe Customer and Subscription records, charging applicable Subscription Fees, processing bookings and Payment Plan installments, applying Coupons and promotional codes, gating features based on your active Plan, and applying Platform Fee rates that correspond to your active Plan.
- Managing access to and use of the Werkspace, including verifying eligibility, recording sign-ins by members and their guests, and administering waivers and safety requirements.
- Operating internal administrative tools used by Werk staff to review applications, manage memberships, and handle support requests, on an authenticated basis.
- Personalizing and improving the Service, including recommending classes, studios, events, and other content, and customizing your experience.
- Developing, training, and improving machine-learning or AI-based features, such as recommendation algorithms, search ranking, and content moderation, using de-identified or aggregated information where possible.
- Conducting analytics, research, and monitoring usage to understand how the Service is used, improve performance and functionality, and develop new products and services.
- Detecting, investigating, and preventing fraudulent transactions, spam, abuse of the Service, security incidents, and other harmful or illegal activity.
- Communicating with you about our products, services, offers, and events, and providing news and information we believe may be of interest to you, in accordance with your communication preferences and applicable law.
- Complying with legal obligations, enforcing our Terms of Service and other agreements, and protecting the rights, property, and safety of Werk, our users, and others.
If required by applicable law (for example, in certain jurisdictions), we will rely on appropriate legal bases for processing, such as performance of a contract, legitimate interests, consent, and compliance with legal obligations.
The foregoing does not apply to Google API user data, which is governed exclusively by Section 11.2.
5. Cookies and Similar Technologies
We use cookies, pixels, tags, SDKs, and similar technologies to operate and improve the Service. These technologies help us:
- Remember your preferences and settings.
- Keep you signed in.
- Understand how you use the Service and which features are most popular.
- Measure the effectiveness of campaigns and marketing.
You can control cookies through your browser or device settings, which may allow you to block or delete cookies. If you disable or reject cookies, some features of the Service may not function properly.
Where required by law, we will obtain your consent before using certain cookies or similar technologies.
6. Data Retention
We retain personal information for as long as reasonably necessary to provide the Service, fulfill the purposes described in this Privacy Policy, comply with our legal and contractual obligations, resolve disputes, and enforce our agreements.
The specific retention periods depend on the type of information and the context in which it was collected. For example, we may retain booking and payment records for a longer period to comply with tax, accounting, and financial regulations. We may also retain de-identified or aggregated information that does not identify you, for analytics, research, and business purposes.
Membership records — including Pro Plan application answers, membership status and tier, Stripe Customer and Subscription identifiers, Payment Plan and Coupon records, Werkspace sign-in records, and related timestamps — are retained for as long as your Account exists. If you delete your Account, your associated membership record is deleted along with your Account (as a cascading deletion in our database), subject to any information we are required or permitted to retain under applicable law or for legitimate business purposes (such as records of completed transactions, tax records, fraud prevention, or dispute resolution).
Billing records held by Stripe (such as your Stripe Customer and Subscription records) persist on Stripe's systems in accordance with Stripe's own retention policies, independent of our database. To request deletion of records held directly by Stripe, you may need to contact Stripe in accordance with Stripe's privacy policy.
7. Data Security
We implement reasonable technical and organizational safeguards designed to protect personal information from unauthorized access, use, alteration, and disclosure. These measures may include encryption in transit, access controls, and regular security assessments. Access to membership data and other sensitive Account information by Werk staff is limited to authenticated administrative tools and personnel who need such access to operate, support, secure, or audit the Service.
However, no method of transmission over the internet or method of electronic storage is completely secure. We cannot guarantee absolute security.
8. Your Privacy Rights and Choices
Depending on your location and applicable law, you may have certain rights regarding your personal information. These may include the right to:
- Access or know the personal information we maintain about you.
- Request correction of inaccurate or incomplete personal information.
- Request deletion of your personal information, subject to certain exceptions.
- Request a copy of your personal information in a portable format.
- Object to or request restriction of certain processing activities.
- Withdraw consent where we rely on consent for processing (without affecting the lawfulness of processing before withdrawal).
- Opt out of certain marketing communications.
You can manage certain account information and preferences directly through your account settings, where available. You can also opt out of marketing emails by following the unsubscribe instructions in those communications. Even if you opt out of marketing, we may still send you transactional or service-related messages.
You may delete your Account through your account settings or by contacting us using the details in Section 13. Deleting your Account will delete your associated membership record from our database, subject to the retention exceptions described in Section 6. Records held by third parties such as Stripe are governed by those parties' own retention and deletion practices.
8.1 California Residents
If you are a California resident, you may have additional rights under California law, which may include:
- The right to know the categories and specific pieces of personal information we collect, use, disclose, and "share."
- The right to request deletion of your personal information, subject to certain exceptions.
- The right to correct inaccurate personal information.
- The right to opt out of the "sale" or "sharing" of personal information for cross-context behavioral advertising, if applicable.
- The right to limit the use and disclosure of certain sensitive personal information, if applicable.
- The right not to receive discriminatory treatment for exercising your privacy rights.
To exercise your rights, you may contact us using the methods set out in Section 13. We may need to verify your identity before processing your request, which may require you to provide certain information or use your account.
If we engage in "selling" or "sharing" personal information or use sensitive personal information beyond permitted purposes under California law, we will provide additional disclosures and a mechanism to opt out or limit such use, as required.
9. Children's Privacy
The Service is not intended for individuals under the age of 18, and we do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 13 (or a higher age where required by law) without appropriate consent, we will take steps to delete such information as required by law.
If you believe that a child has provided us with personal information in violation of this section, please contact us using the details in Section 13.
10. International Data Transfers
The Service is operated from the United States. If you access the Service from outside the United States, your information may be transferred to, stored, and processed in the United States or other jurisdictions that may not provide the same level of data protection as your home jurisdiction.
Where required by law, we implement appropriate safeguards for international transfers of personal information, such as standard contractual clauses or other approved transfer mechanisms.
11. Third-Party Services and Links
The Service may contain links to, or integrations with, third-party websites, applications, tools, and services that are not owned or controlled by Werk. These may include, for example, social media platforms, payment processors, analytics providers, and marketing partners.
Werk is not responsible for the privacy practices of these third parties. Your use of third-party services is subject to their own terms and privacy policies, and we encourage you to review those policies carefully before using such services.
11.1 Google API Services and Google Calendar Integration
Werk offers an optional integration with Google Calendar that allows users to synchronize their Werk listings, bookings, and other scheduling activity within the Service with their Google Calendar. If you choose to connect your Google account, Werk will request permission to access certain Google Calendar data through Google API Services using Google's OAuth authentication system.
Depending on the permissions you grant, Werk may:
- Read and manage calendar events in your selected Google Calendar to create, update, and delete bookings, and to detect scheduling conflicts.
- Read your list of Google Calendars so you can select which calendar to sync with Werk (for example, a per-room calendar).
Werk uses Google Calendar data solely to provide these calendar synchronization and scheduling features within the Service. Werk does not use Google Calendar data for advertising, profiling, or marketing, or for any purposes unrelated to these features, and Werk does not sell Google Calendar data.
Werk stores Google Calendar data only to the extent necessary to enable synchronization of bookings and scheduling features within the Service and retains such data only for as long as required to provide those features or as otherwise permitted or required by law.
You may disconnect your Google Calendar integration at any time through your Werk account settings or through your Google account permissions page. Once disconnected, Werk will stop accessing your Google Calendar data going forward. Any events that were previously created in your Google Calendar through the Service will remain in your calendar unless you remove them directly in Google Calendar.
11.2 Google API Services User Data Policy
Werk's use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
Google user data obtained through Google API Services is used solely to provide or improve user-facing features within the Werk platform, such as scheduling synchronization and event management, and is not used for any purposes unrelated to those features.
Werk does not:
- Sell Google user data.
- Use Google user data for advertising or marketing purposes.
- Use Google user data to build user profiles unrelated to the functionality of the Service.
- Use Google user data to develop, improve, or train generalized artificial intelligence or machine learning models.
Access to Google user data is limited to automated systems and, where strictly necessary, to personnel required to operate, secure, maintain, or debug the Service, or to comply with legal obligations.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, where required by law, provide additional notice (such as by posting a notice on the Service or sending you a notification).
Your continued use of the Service after the effective date of any changes to this Privacy Policy constitutes your acceptance of the revised Privacy Policy.
