On this page, "we" means YourKit GmbH. "You" means the visitor of our public websites, or the end-user of our public service, or the end-user of our product, or the legal entity who is the licensee or the user of our product or service — as applicable to the subject matter.
This privacy policy applies to both personal information (which can be attributed to a specific individual) and non-personal information that are collected by us on our websites or in our products.
Data collected on our website
Any data that is entered into any form on yourkit.com website is only used for the indicated purposes. With the exceptions listed below, we will never give away any personal information including your e-mail address to any third party.
We collect anonymous website usage statistics. We also use HTTP cookies to collect the information about how you navigate through our website. We use that information to improve our website usability, and the cookies are anonymous, i.e., they are not linked with the data that you enter into forms on the website. You can safely disable cookies on our website.
Our website hosts a public forum powered by phpBB. A registered user is required to provide an email address. The user may also specify other details such as their real name or company, but we do not require any of this information to be provided. Please note that this information, as well as the content of forum posts you make, may be visible to other visitors of our website, including search engines.
Use of Cloudflare
We use Cloudflare, Inc. ("Cloudflare") as a content delivery network and security service to protect and optimize our website. Cloudflare analyzes the traffic between your browser and our website and filters out potentially malicious requests from the Internet. In doing so, Cloudflare may also use cookies, but these are used solely for security and performance purposes. The legal basis for using Cloudflare is our legitimate interest in ensuring the security, availability, and efficiency of our website (Art. 6(1)(f) GDPR). Data processing is covered by the Cloudflare Data Processing Addendum, which is automatically incorporated into our agreement with Cloudflare. Where personal data is transferred outside the European Economic Area, Cloudflare relies on the EU Standard Contractual Clauses ("EU SCCs") to ensure an adequate level of protection.
Product activation and license checks
Our products may require an activation with the license key, as well as periodically verify license validity by connecting to our servers. As a part of license checks, some information may be transferred to us: (i) versions of the product, platform, operating system, (ii) the license key, (iii) some information allowing to bind an activated copy to a particular machine. This information may include or be based on MAC address, machine serial ID, disk ID, host name, OS user name, gethostid(). This information is transferred to our website encrypted via HTTPS. We never store the received information as plain text, instead we store hash codes or a mangled form of the plain text such that it cannot be recovered by itself. As a result, the collected information by itself does not allow globally identifying the machine or the user.
We may use this information for license validation, analysis and support of the end users.
Product updates
Our products may periodically check for available updates by connecting to our servers. As a part of update checks, some information may be transferred to us: versions of the product, platform, operating system.
We may use this information for analysis, verification and support of the end users.
Product evaluation
Our products may offer free evaluation licenses. We send the evaluation license key by email. Upon requesting the evaluation license, you agree to provide us with a valid email address and to receive from us the email with the license key, as well as further emails in which we (1) ask you how your evaluation is going and (2) inform you on new products and releases from us or other news about us. For the purpose of sending emails under (1) and (2) we store your email address. The emails under (1) and (2) will provide a link to unsubscribe, giving you the opportunity to opt-out from receiving further information from us.
Anonymous usage statistics
Our products may include an option to collect usage statistics and transfer them to our servers to help us improve future versions of the product. The information transferred does not contain any personally identifiable information.
Products that have this capability also have a configuration option to turn off the statistics transfer.
Retention of data
We will retain your personal data only for as long as is necessary for the purposes set out in this privacy policy. We will retain and use your personal data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
Disclosure
The collected information may be disclosed only in the following cases:
- if we are required to do so by law;
- if YourKit is merged or sold to another company.
