During the preliminary investigation the teacher was interviewed on suspicion of assault and breach of official duties. On the basis of the investigation, the Deputy Prosecutor General Jorma Kalske decided not to bring charges.
The decision states that the teacher had the right to remove the pupil from the cafeteria. His shove was, however, more severe than an appraisal of the situation suggests would have been defensible.
He therefore, according to the prosecutor, breached his official duties out of carelessness. That does not, however, meet the criteria for a prosecution. As the incident arose out of carelessness, the incident does not meet the criteria for an assault case either.
