Terms of Service

Welcome to Aymo AI ("Aymo AI," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of Aymo AI, a multi-model AI platform that enables individuals and teams to create, collaborate, and build using AI-powered tools (the "Service"). Aymo AI is operated by Pimjo ("Pimjo").

By accessing, registering for, or using the Service, you agree to be bound by these Terms and by our Privacy Policy and Refund Policy, which are incorporated here by reference. If you do not agree, you may not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

1. Definitions

  • "Account" means the registered account you create to access the Service.
  • "Content" means any input you submit to the Service ("Input") and any text, code, images, or other output generated by the Service in response ("Output").
  • "Models" means the large language and multimodal AI models, including third-party models, made available through the Service.
  • "Plan" means any free, paid subscription, prepaid credit, or enterprise tier under which you access the Service.

2. Eligibility

You must be at least 13 years old, or the minimum legal age to consent to data processing in your country, whichever is higher, to use Aymo AI. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By creating an Account, you confirm that:

  • You have the legal capacity to enter into a binding agreement.
  • The information you provide is accurate and kept up to date.
  • You will use the Service only for lawful purposes and in compliance with these Terms.

We may suspend or terminate Accounts where we detect misuse, unauthorized access, or violations of these Terms.

3. Accounts and Security

You may need to register for an Account to use parts of the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your Account. You agree not to share your credentials or allow others to access the Service through your Account.

If you believe your Account has been compromised, contact us immediately via support.

4. AI Content and Responsibility

Aymo AI generates text, code, and other Outputs using underlying Models in response to your Input. Because Outputs are probabilistic, they may occasionally be inaccurate, misleading, incomplete, or offensive, and similar Inputs may produce different Outputs for different users.

You are solely responsible for:

  • Reviewing and verifying all Outputs before relying on or using them.
  • Ensuring your Content complies with applicable laws and does not infringe the rights of any third party.
  • Any decisions or actions taken based on Outputs.

You should not rely solely on Outputs for decisions that could have legal, financial, medical, safety, or other significant consequences.

5. Content Ownership and License

As between you and Aymo AI, you retain your rights in your Input, and we do not claim ownership of the Output you generate, subject to the terms of the underlying Models and applicable law.

To operate and improve the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display your Content as reasonably necessary to provide the Service, ensure security and compliance, and meet our legal obligations. We do not use the content of your private conversations to train our own foundation models except as described in our Privacy Policy or with your consent.

6. Acceptable Use

You agree not to use the Service to create, upload, generate, or distribute content, or to engage in conduct, that:

  • Is unlawful, fraudulent, deceptive, defamatory, harassing, threatening, or that promotes violence or hatred against individuals or groups.
  • Infringes or misappropriates the intellectual property, privacy, or other rights of any third party.
  • Contains malware, or is intended to disrupt, overload, probe, or gain unauthorized access to our infrastructure, the Models, or other users' accounts.
  • Reverse-engineers, decompiles, scrapes, or attempts to extract the source code, weights, or training data of the Service or the Models, except to the extent permitted by law.
  • Uses Outputs or the Service to develop or train a competing AI model or service.
  • Generates spam, automated abuse, or high-volume requests outside the limits of your Plan or our published rate limits.

6.1 Adult and Sexual Content

Aymo AI is not intended for the creation, generation, or distribution of adult or sexually explicit content. Such content is not permitted on the Service. This includes pornographic material, sexually explicit text or imagery, and content intended primarily for sexual gratification. Attempting to generate or circulate such content may result in content removal, restriction, suspension, or termination of your Account, at our discretion and without refund.

We maintain zero tolerance for any content that sexualizes, exploits, or endangers minors. Any such content, including any sexual content involving or depicting a minor, is strictly prohibited, will result in immediate termination, and may be reported to the relevant authorities.

We may use automated systems and human review to enforce this section and may suspend access at any time to protect the integrity of the platform, our users, or third parties.

7. Third-Party Models and Services

Aymo AI provides access to third-party AI Models and services. Your use of those Models may be subject to the providers' own terms and usage policies, and availability of any specific Model may change, be limited, or be discontinued without notice. All third-party logos and trademarks are the property of their respective owners and are used for identification purposes only. We are not responsible for the outputs, availability, or practices of third-party providers.

8. Beta Features and Feedback

We may offer features identified as beta, preview, or experimental, which are provided "as is," may be changed or removed at any time, and may be less reliable than generally available features.

If you provide suggestions or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or obligation to you.

9. Payment, Subscriptions, and Refunds

If you purchase a paid Plan or credits, you agree to pay all applicable fees in accordance with our pricing and billing terms in effect at the time of purchase. You authorize us and our payment processors to charge your payment method for all fees incurred.

  • Subscriptions automatically renew for successive periods unless canceled before the renewal date. You may cancel at any time; cancellation takes effect at the end of the current billing period.
  • We may change pricing, Plan features, or credit rates with prior notice. Changes apply to subsequent billing periods or purchases.
  • Fees and consumed usage are non-refundable except as expressly set out in our Refund Policy or as required by applicable law.

Refund eligibility, including for unused credit balances, service malfunctions, and unauthorized charges, is governed by our Refund Policy.

10. Intellectual Property

All platform code, design, and branding, including the Aymo AI name and logo, are owned by Pimjo or its licensors and are protected by intellectual property laws. You may not use, copy, modify, or distribute them without our prior written consent. Except for the rights expressly granted to you in these Terms, we reserve all rights in the Service.

11. Copyright and IP Complaints

We respect the intellectual property rights of others. If you believe content on the Service infringes your rights, contact us at [email protected] with: a description of the work claimed to be infringed, the location of the allegedly infringing material, your contact information, and a statement that you have a good-faith belief that the use is unauthorized. We may remove infringing content and terminate repeat infringers.

12. Privacy

Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your data. By using the Service, you consent to the data practices described in that policy.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that Outputs will be accurate or reliable. AI systems can make mistakes, and you agree to use your own judgment.

14. Limitation of Liability

To the fullest extent permitted by law, Aymo AI, Pimjo, and their affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business, arising from or related to your use of or inability to use the Service.

To the fullest extent permitted by law, our total aggregate liability for any claim related to the Service will not exceed the greater of the amount you paid to us for the Service in the twelve (12) months preceding the claim, or USD 100.

15. Indemnification

You agree to indemnify and hold harmless Aymo AI, Pimjo, and their affiliates from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.

16. Termination

You may stop using the Service and close your Account at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, create risk or legal exposure for us, or engage in harmful activity. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive, including Content Ownership and License, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law, will remain in effect.

17. Governing Law and Disputes

These Terms are governed by the laws of Bangladesh, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Dhaka, Bangladesh, and you consent to their jurisdiction and venue. Nothing in this section limits any mandatory consumer-protection rights you may have under the laws of your country of residence.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by posting the updated Terms on aymo.ai/terms or notifying you in the Service. Your continued use of the Service after changes take effect means you accept the revised Terms. The latest version will always be available at aymo.ai/terms.

19. General

  • Entire Agreement. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Service.
  • Severability. If any provision is found unenforceable, the remaining provisions remain in full effect.
  • No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
