Disputed non-free use rationale for File:1960s Arthur Lejwa in Galerie Chalette 1100 Madison Ave. Smithsonian Archives of American Art. J.J. Breit, photographer.jpg
[edit]Thank you for uploading File:1960s Arthur Lejwa in Galerie Chalette 1100 Madison Ave. Smithsonian Archives of American Art. J.J. Breit, photographer.jpg. However, there is a concern that the rationale provided for using this file on Wikipedia may not meet the criteria required by Wikipedia:Non-free content. This can be corrected by going to the file description page and adding or clarifying the reason why the file qualifies under this policy. Adding and completing one of the templates available from Wikipedia:Non-free use rationale guideline is an easy way to ensure that your file is in compliance with Wikipedia policy. Please be aware that a non-free use rationale is not the same as an image copyright tag; descriptions for files used under the non-free content policy require both a copyright tag and a non-free use rationale.
If it is determined that the file does not qualify under the non-free content policy, it might be deleted by an administrator seven days after the file was tagged in accordance with section F7 of the criteria for speedy deletion. If you have any questions, please ask them at the media copyright questions page. Thank you.

Wikipedia and copyright
[edit]Hello Sicklemoon, and welcome to Wikipedia.
It's very important that contributors understand and follow the copyright practices, as policy requires that people who persistently do not must be blocked from editing. If you have any questions about this, you are welcome to leave me a message on my talk page. Thank you. — Diannaa (talk) 15:47, 18 April 2020 (UTC)
It is NOT easy writing about 20th century artists on Wikipedia. There seems to be a general assumption that editors on these articles are working in bad faith to subvert copyright laws, self-promote, or vandalize. Major artists like Josef Albers (1888 – 1976) and Jean Arp (1886 – 1966) are guarded by editors who seem to feel they own these artists' reputations. It is common policy among a certain style of Wikipedia editor to strip information rather than put in the necessary work to rewrite it to an "acceptable" form. Different editors will swoop in, with absolute conviction that their opinions must dominate.
Not every editor--another type flags questions, querying for clarification so work can be confirmed or corrected at a later date. Obviously this is my preferred style of editor.
My personal experience of Wikipedia has been a "learning curve" of when to push back, and when to retreat. And where does that line fall?
Personally speaking: the line is about individual editors, not general Wikipedia policy. If one runs into a long-serving Wikipedia editor with an aggressive sense of ownership--don't bother trying to make rational arguments. Any counterargument made will be dismissed as evidencing a desire for something outside the purlieus of the Wikipedia mission.
The standard applied to artists working post ~1925 regarding self-promotion/copyright protection is, in my view, unreasonable, if not deliberately designed to punish underdog artists of serious reputation. I find it absolutely depressing that significant female artists of the 20th century (including many of Josef Albers's most talented students) are entirely unrepresented on Wikipedia in any way that adequately illustrates the scope of their accomplishments.
Artists like Stephanie Scuris and Jane Davis Doggett will remain unknown while Wikipedia continues these policies.
I recognize that my plaints here will sound... unreasonable and unsupported to some Wikipedia editors. But--through my good faith efforts to write about art created in the 20th and 21st centuries, I recognize that I will continue to run into issues.
But the language of accusations of "persistency" here, and threats that my work will be blocked--that bothers me. I'm not trying to violate Wikipedia's policies. I'm not trying to sell anything, make money off of artist's work, or "promote" anything beyond knowledge that can be supported on a factually established and legitimately cited, basis.
I'm trying to see that accurate representations of contemporary visual artists and their work are included here on Wikipedia. I'm here to see that the "fair use" policy regarding image is consistently and logically applied.
I do not believe that "fair use" should be applied so narrowly that it deletes Wikimedia Commons images off of an artist's page (as was done on the Jon Arfstrom article I worked on)--that's not right. And whoever went onto Wikimedia Commons and deleted the images there--shame on you! Arfstrom is a Minnesotan artist who died in 2015--known for a variety of work. But some editor--evidently they think all Arfstrom did was work on a couple of pulps covers.
Do I need to argue with some crazy science fiction devotee about Jon Arfstrom's reputation? Frankly, no. No I do not. He's an interesting artist, but--I'm not personally invested. I attended one exhibition at the Anoka County Library, I loved his work, I wanted to update his Wikipedia page--but that's where my interest ends.
But honestly, I would like to know who went to the trouble to remove every non-SF reference on his page? Who went in and removed the author photos?
Bizarre. Sicklemoon (talk) 15:10, 12 April 2023 (UTC)

Replaceable fair use File:1960s Jane Davis Doggett in the studio.jpg
[edit]Thanks for uploading File:1960s Jane Davis Doggett in the studio.jpg. I noticed that this file is being used under a claim of fair use. However, I think that the way it is being used fails the first non-free content criterion. This criterion states that files used under claims of fair use may have no free equivalent; in other words, if the file could be adequately covered by a freely-licensed file or by text alone, then it may not be used on Wikipedia. If you believe this file is not replaceable, please:
- Go to the file description page and add the text
{{Di-replaceable fair use disputed|<your reason>}}
below the original replaceable fair use template, replacing<your reason>
with a short explanation of why the file is not replaceable. - On the file discussion page, write a full explanation of why you believe the file is not replaceable.
Alternatively, you can also choose to replace this non-free media item by finding freely licensed media of the same subject, requesting that the copyright holder release this (or similar) media under a free license, or by creating new media yourself (for example, by taking your own photograph of the subject).
If you have uploaded other non-free media, consider checking that you have specified how these media fully satisfy our non-free content criteria. You can find a list of description pages you have edited by clicking on this link. Note that even if you follow steps 1 and 2 above, non-free media which could be replaced by freely licensed alternatives will be deleted 2 days after this notification (7 days if uploaded before 13 July 2006), per the non-free content policy. If you have any questions, please ask them at the Media copyright questions page. Thank you. -- Marchjuly (talk) 06:38, 29 July 2020 (UTC)
Someone felt really, really strongly about eliminating these images. The first time this happened to me (I was writing about pottery!) I actually went to the museum site, applied for, and received, permission to use their image. I went through all the protocols (or so I imagined!) regarding this as a test case for getting other usefully illustrative images through the WIkipedia system. When I described to the Museum how I wanted to use their image, frankly, they were delighted that this obscure piece of Californian pottery was being cited.
Needless to say--having received and recorded these permissions by the copyright holder, I felt I was on safe grounds.
Nope. The image was deleted with the usual accusations of "bad faith use of the fair use rationale."
Pushing back against these arbitrary enforcements takes time and energy. Here--I spent considerable time trying to make responsible additions to these artists' pages. But am I invested enough to go back, retrace my steps, redo the work? No.
I'm sorry all these images were deleted. I am confident of their appropriate fair use value. In my opinion, "the file could NOT be adequately covered by a freely-licensed file or by text alone."
But some other Wikipedian disagreed, and they were not willing to do the work to find a "free equivalent."
Which, I can say, because I did do that work, did not exist at the time the article was written. Sicklemoon (talk) 15:24, 12 April 2023 (UTC)

Hi Dianaa--I'm still looking over the edits, trying to figure out what you changed, and scratching my head because it's not clear to me what exactly has been removed. Is this an issue of my not fluidly making use of my sandbox while working my way through a poorly cited article to clarify and make corrections? I'm going to keep on looking, as much of the work I put in seems to remain, and if there are any corrections needed, I puzzle as to why I'm getting a warning while I'm fixing an article that clearly was in violation of many of Wikipedias stated policies to begin with. Isn't the idea to be collaborating and improving, not threatening? I find your tone in the above extremely off-putting. Sicklemoon (talk) 18:57, 14 January 2022 (UTC)
- I am not in the business of violating copyright. I wonder to this day what was in my John J. Boyle edits that provoked this response.
- John J. Boyle, by the way, is a boring, middle of the road late 19th c artist, but I bumped into him while I was working on something else, and decided he deserved more than a stub. I made extensive use of early 20th c collected biographical works to put a draft of this article together, citing all the sources I used--because credibility in Wikipedia comes via citations, not via plagiarism.
- Looking at the history of this article's drafts this morning, I can only guess that there was some sort of style question about how my citation was made? Sicklemoon (talk) 15:39, 12 April 2023 (UTC)
Irvin M. Cohen moved to draftspace
[edit]An article you recently created, Irvin M. Cohen, is not suitable as written to remain published. It needs more citations from reliable, independent sources. (?) Information that can't be referenced should be removed (verifiability is of central importance on Wikipedia). I've moved your draft to draftspace (with a prefix of "Draft:

I'm tidying up my talk page to remove some automatically generated messages. I started articles on Ann Swinfen, Author and Vasnetsov, Yuri (Artist) (among others) and then lost interest. Ann Swinfen is, I continue to think, and interesting deceased writer who was one of the first generation of self-publishing novelists on Amazon to make a commercial success of her work, I thought she was a good subject for inclusion on Wikipedia. Rather to my disgust, this article was flagged as some sort of self-promotional piece for Ann Swinfen--and personally, I do not wish to lose credibility as an editor on Wikipedia for championing this certainly not first rate writer with whom I have no personal connection. Still--annoying to see a biography of a woman writer who seems to have truly pioneered in this new area of publishing smacked down.
So--I'm planning to be more active in pushing back against these automatically generated Wikipedia spankings, at least here, in my "personal" if not "private" space. Sicklemoon (talk)
