Terms of Service

These terms govern access to EveryFeed and set out the responsibilities that come with publishing through connected channels.

Agreement to these terms

These Terms of Service (“Terms”) are a binding agreement between you and VoltAgent Inc.. They govern your access to and use of EveryFeed’s websites, applications, APIs, browser extension, and related services (the “Service”).

By creating an account, accepting an order, or using the Service, you agree to these Terms. If you use the Service for a company or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.

Eligibility and accounts

You must be at least 18 and legally able to enter into this agreement. You must provide accurate account information, keep it current, and protect your credentials. You are responsible for activity under your account and must promptly notify us of suspected unauthorized access.

Workspace owners and administrators control membership and permissions. If you join a workspace, its owner may access, manage, export, or delete content and settings associated with that workspace.

Connected channels and authority

You may connect third-party social networks, websites, and other services. You authorize EveryFeed to access those services and take actions—such as retrieving account information or publishing, editing, and analyzing content—only as needed to carry out your instructions and the permissions you grant.

You are responsible for having all rights and approvals needed to connect an account and publish through it. Your use of a connected service remains subject to that provider’s terms, policies, quotas, and technical limits. We do not control and are not responsible for a provider’s availability, moderation decisions, account restrictions, API changes, or treatment of published content.

If you connect or use YouTube through EveryFeed, you also agree to be bound by the YouTube Terms of Service.

Your content

You retain ownership of content you submit to the Service. You grant us a worldwide, non-exclusive, limited license to host, reproduce, modify for technical formatting, transmit, and otherwise process that content solely to operate, secure, improve, and provide the Service at your direction.

You represent that you have the rights needed for your content and its intended use, including rights in media, music, trademarks, personal information, and endorsements. You are responsible for reviewing content, audience, channel settings, timing, and legal disclosures before publishing.

AI and generated content

The Service may help research, draft, transform, or generate content. Generated output may be inaccurate, incomplete, offensive, or similar to content produced for others, and it may not be suitable for your intended use. You must review and independently verify output before using or publishing it. You are responsible for ensuring that your prompts, inputs, and use of output comply with law, these Terms, and third-party rights.

Acceptable use

You may not use the Service to:

  • violate law, platform rules, intellectual-property, privacy, or publicity rights;
  • publish spam, deceptive engagement, impersonation, fraud, harassment, or unlawful or harmful content;
  • access accounts or data without authorization, bypass rate or usage limits, or interfere with the Service;
  • introduce malware, probe vulnerabilities, reverse engineer protected portions of the Service, or misuse credentials or API tokens; or
  • use the Service to build or train a competing product through systematic extraction, except as permitted in writing.

We may investigate suspected misuse and suspend access when reasonably necessary to protect users, providers, or the Service.

Subscriptions, fees, and taxes

Paid plans are billed in advance on the interval shown at checkout and renew automatically until canceled. You authorize our payment processor to charge the payment method you provide for fees and applicable taxes. Usage limits, features, and pricing are those presented for your plan at the time of purchase or renewal.

You can manage or cancel a subscription from the billing settings. Cancellation takes effect at the end of the current paid period unless the checkout terms state otherwise. Fees are non-refundable except where required by law or expressly stated at purchase. You remain responsible for charges incurred before cancellation.

We may change future pricing or plan features with notice required by law. A price change applies no earlier than your next renewal after the stated effective date.

The Service and changes

We may add, change, or discontinue features and may perform maintenance that temporarily affects availability. We aim to operate a reliable Service but do not promise uninterrupted delivery, publication at an exact time, or continued compatibility with every third-party platform. Preview, beta, or experimental features may be changed or withdrawn and are provided for evaluation.

Our intellectual property

The Service, including its software, design, documentation, trademarks, and other materials, is owned by VoltAgent Inc. or its licensors and protected by intellectual-property law. Except for the limited right to use the Service under these Terms, no rights are granted to you. If you give us feedback, you allow us to use it without restriction or payment.

Suspension and termination

You may stop using the Service at any time and may delete your account subject to workspace ownership and outstanding subscription requirements. We may suspend or terminate access if you materially breach these Terms, create security or legal risk, fail to pay amounts due, or if required by a connected provider or law. When practical, we will give notice and an opportunity to cure.

Provisions that by their nature should survive termination remain in effect, including ownership, payment obligations, disclaimers, liability limits, and dispute terms.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CONTENT WILL BE ACCEPTED, PUBLISHED, RETAINED, OR PERFORM IN A PARTICULAR WAY ON A THIRD-PARTY PLATFORM. Nothing in these Terms excludes a warranty that cannot legally be excluded.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VoltAgent Inc.’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits do not apply where liability cannot legally be limited.

Indemnity

If you use the Service on behalf of a business, that business will defend and indemnify VoltAgent Inc. and its personnel from third-party claims, damages, and reasonable costs arising from its content, its connected accounts, or its material violation of these Terms or law, except to the extent caused by our breach or misconduct.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Unless applicable law requires otherwise, the state and federal courts located in Delaware will have exclusive jurisdiction over disputes, and each party consents to those courts. Before filing a claim, please contact us and allow 30 days for an informal attempt to resolve it.

General

These Terms and any order or plan terms form the entire agreement about the Service. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets. There are no third-party beneficiaries.

Changes to these terms

We may update these Terms as the Service or law changes. We will post the revised Terms and update the effective date. If a material change affects existing subscribers, we will provide additional notice when required. Continued use after the change takes effect means you accept the revised Terms.
