Funy AI (“we,” “us,” or “our”) takes your privacy seriously. This Privacy Policy explains our data protection practices and describes the types of information we may process when you install and/or use the “Funy AI” software application for mobile devices (the “App” or “our App”).

When we refer to personal data (or personal information), we mean any information relating to an identified or identifiable natural person. This includes any data that can be used directly or indirectly—via an identification number or physical, physiological, mental, economic, cultural, or social factors—to identify you.

Our Privacy Policy applies to all users and others who access the App (“Users”). For the purposes of the General Data Protection Regulation (GDPR), Funy AI is the data controller, unless otherwise stated.

RESTRICTED REGIONS: Funy AI is strictly prohibited for use by individuals located in, or residents of, Mainland China and the Hong Kong Special Administrative Region (SAR). By downloading, accessing, or using the App, you represent and warrant that you are not located in, under the control of, or a resident of these restricted regions. We reserve the right to block access to the App from these locations.

II. ACCEPTABLE USE & PROHIBITION OF HARMFUL CONTENT

Funy AI utilizes advanced artificial intelligence to generate content. To ensure a safe environment, we strictly prohibit the use of Funy AI to generate, request, process, or distribute any harmful, offensive, or illegal content.

This includes, but is not limited to, content that:

• Promotes violence, terrorism, or physical harm against self or others.
• Contains hate speech, discrimination, or harassment.
• Involves explicit sexual material, pornography, or non-consensual sexual content (e.g., deepfakes).
• Exploits or harms minors in any way.
• Defames others or infringes upon third-party intellectual property rights.

We, along with our AI service providers (such as OpenAI), employ automated and manual moderation tools to enforce this policy. We reserve the right to block content generation, suspend or terminate accounts, and report illegal activities to the appropriate law enforcement authorities without prior notice.

III. INFORMATION WE PROCESS

We collect and process the following information necessary for the adequate performance of the contract between you and us. Without this data, we cannot provide the complete functionality of the App:

• User Content: Text you enter, prompts you submit, and AI-generated content created via the App. You use and share your User Content at your own risk and are responsible for compliance with applicable laws. We engage OpenAI, L.L.C. to process and create AI-generated User Content (see Section V for more details).
• Contact Information: Your name, email address, and any content included in support requests. We collect and store this via our cloud storage provider (Amazon.com, Inc.) to respond to inquiries, resolve issues, and send transactional or requested communications.

2. Face Data Collection and Usage

For features such as style photo generation (face swapping) and personalized avatars, Funy AI may collect facial images.

• Storage & Security: These facial images are securely transmitted to and stored on our privately owned servers located in Silicon Valley, USA.
• No Third-Party Sharing: We do not share your face data with any third parties.
• Retention: Face data is retained for a maximum of 7 days to allow you to retrieve or edit your creations. After this period, it is permanently and irreversibly deleted from our servers.

By using these specific features, you explicitly consent to the collection and temporary processing of your facial images as described above.

3. Information Processed Automatically

With your permission, we use third-party automatic data processing technologies (analytics and advertising tools) to analyze information sent by your device (e.g., IDFA for iOS, Advertising ID or Android ID for Android). You can withdraw this permission at any time via your device settings (see Section IX).

• Log File & Event Information: Data automatically recorded when you access Funy AI, including in-app events (tutorial steps, level progression, and purchases).

Our e-commerce provider (Apple) handles all billing and charging for in-app purchases. Funy AI does not collect, access, or store your credit or debit card details. Please review Apple’s applicable in-app purchase rules and privacy policies.

IV. THE PURPOSES OF PROCESSING YOUR DATA

We do not rent or sell your personal data. We only share information with authorized third-party service providers who assist us in operating the App, subject to strict confidentiality agreements.

We may also disclose personal information if required by law, to protect our rights and user safety, to investigate fraud, or in the event of a corporate merger, acquisition, or sale of assets.

VI. INTERNATIONAL DATA TRANSFERS

We operate globally. Your information may be transferred to and processed in jurisdictions where data protection laws differ from those in your region. We utilize hosting organizations that meet rigorous security standards and encrypt personal data where possible. By using Funy AI, you consent to these cross-border data transfers.

VII. HOW LONG WE RETAIN YOUR DATA

We retain personal information only for as long as necessary to operate Funy AI and comply with legal obligations.

• General Data: Retained until you request deletion or account closure, unless legally required to hold it longer.
• Face Data: As noted in Section III.2, face data is retained for a maximum of 7 days and then permanently deleted.

VIII. EXERCISING YOUR RIGHTS

Depending on your jurisdiction (e.g., GDPR, CCPA), you may have the following rights regarding your personal data:

• Access and Portability: Request a copy of your personal data.
• Correction: Request corrections to inaccurate data.
• Deletion: Request the erasure of your personal data.
• Restriction: Limit how your data is processed.

We may require additional information to verify your identity before processing your request. We will endeavor to respond within forty-five (45) days.

IX. OPT-OUT OF MARKETING TRACKING

If you prefer not to receive personalized, interest-based advertising, you can opt out via your device settings:

• iOS: Go to Settings > Privacy & Security > Apple Advertising, or Settings > Privacy & Security > Tracking to disable “Allow Apps to Request to Track” (Applen tuki).

X. SECURITY

XI. CHILDREN’S PRIVACY

Funy AI is strictly intended for individuals who are 18 years of age or older. We do not knowingly collect personal information from children under 18. If we become aware that we have collected data from a child under 18, we will take immediate steps to delete that information. If you suspect a child has provided us with personal data, please contact us.

XII. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time to reflect changes in legal requirements or our operational practices. The updated policy will be posted within the App, and the “Effective Date” at the bottom will be revised.
