Using Gesttalt
Terms of service
These terms describe the publishing service, early access, customer responsibilities, moderation, termination, and liability.
Contracting party and scope
Gesttalt is operated by Pedro Piñera Buendía, trading as Gesttalt, as a sole proprietor. The contracting party's serviceable address is Jessnerstrasse 27a, 10247 Berlin, Germany. These terms apply when you create an account or use the hosted publishing service. Last updated: 23 July 2026.
Accounts
You must be at least 18 years old and able to enter a binding contract. You must provide accurate account information, keep credentials and connected-application secrets secure, and promptly report suspected misuse. You are responsible for activity performed through your account unless it resulted from a security failure attributable to Gesttalt.
Publishing service and early access
Gesttalt provides tools to create and publish posts and pages, store images, use custom domains, edit themes, and publish through supported programmatic interfaces. The service is free during early access and does not require payment details. Gesttalt may introduce paid plans later, but no charge or paid renewal will begin without clear terms and your express order.
Early access is under active development. Features may change, be unavailable, or contain errors. There is no guaranteed service level or continuous availability during early access. Gesttalt will use reasonable care in operating the service and maintaining backups, but you should keep an independent copy of important content.
Your content and permissions
You retain ownership of content and themes you submit. You grant Gesttalt a worldwide, non-exclusive, royalty-free permission to host, reproduce, adapt technically, back up, and publicly deliver that material only as needed to operate the service at your direction. The permission ends when the material is deleted, subject to backup expiry and legal preservation duties.
You must have the rights and permissions needed to submit and publish all text, images, code, personal information, and other material. You are responsible for connected domain names and for the legal notices, privacy information, and disclosures required for your own publication.
Acceptable use
Do not use Gesttalt to publish illegal material; infringe intellectual-property, privacy, or personality rights; impersonate others; distribute malicious software; evade security controls; facilitate fraud; send unsolicited bulk messages; or threaten, exploit, or endanger people. Do not overload the service or interfere with another person's use.
Reports and moderation
Anyone may use the illegal-content reporting form. Gesttalt assesses reports diligently, objectively, and without arbitrary treatment. Moderation and decisions are performed by a person. Gesttalt does not use automated moderation or automated decision-making.
Gesttalt may preserve evidence, restrict access to content, disconnect a domain, or suspend an account where required by law or reasonably necessary to address a material breach of these terms. Affected users receive a reason where the law permits it and may request another human review by writing to gesttalt@pepicrft.me.
Ending the service and exporting content
You may stop using Gesttalt at any time. The permanent deletion control in account settings removes your account, publication, connected applications, and uploaded media. Deletion cannot be undone; encrypted backups expire within 30 days.
If Gesttalt ordinarily terminates your account or closes the service, it will give at least 30 days' notice and keep access available during that period so you can copy your content. Immediate restriction or termination may be necessary for an urgent legal or security reason, a serious or repeated breach, or conduct that materially endangers another person or the service. Where possible, Gesttalt will still provide a reasonable way to retrieve lawful content.
Liability
Gesttalt has unlimited liability for intent and gross negligence; injury to life, body, or health; guarantees expressly given; liability under the German Product Liability Act; and any other liability that cannot legally be limited.
For ordinary negligence, Gesttalt is liable only for breach of a duty whose performance is essential to the contract and on whose performance you may normally rely. In that case, liability is limited to loss that was typical and reasonably foreseeable when the contract was made. This limitation does not reduce mandatory consumer rights or statutory rights concerning defective digital products.
Gesttalt is not responsible for content you publish, external services you connect, internet or domain-provider failures outside Gesttalt's control, or loss caused by your failure to secure credentials or keep a reasonable independent copy, except to the extent the loss was also caused by a breach for which Gesttalt is liable under the preceding paragraphs.
Changes
Gesttalt may change these terms when reasonably necessary for legal or security requirements, to reflect a changed service, or to preserve a balanced contractual relationship. Material changes will be explained by email at least 30 days before they take effect. Urgent legal or security changes may take effect sooner, with notice as soon as reasonably possible. If you do not accept a material change, you may end the service and copy your content before it takes effect.
Governing law and contact
German law applies, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. A consumer keeps any mandatory protection provided by the law of the country where they habitually live. Mandatory rules on court jurisdiction remain unaffected.
